Family Rights & Benefits
Maternity, parental leave and child benefits in Mauritius.
Mauritius significantly reformed its family leave entitlements in June 2024. Maternity leave increased to 16 weeks at full pay; paternity leave increased from 5 days to 4 consecutive weeks. Both changes are under the Workers' Rights Act (2019, as amended). Mauritius is a mid-level expat destination for finance, hospitality, and regional headquarters roles — the improved family leave provisions make it more attractive for families. Private schools, private healthcare, and a strong work permit system are the key family planning considerations for incoming expats.
Maternity Leave (Workers' Rights Act)
Before birth: Mothers may take up to 7 weeks of prenatal leave before the expected delivery date as part of the 16-week total entitlement, OR take the entire 16 weeks after birth (no mandatory prenatal leave period).
After birth: 16 weeks total employer-paid maternity leave (from 7 June 2024 amendment). At least 8 weeks must be taken after delivery. Extended to 18 weeks for multiple births or premature babies. Full salary is paid by the employer for the entire period. Additionally, expectant mothers receive a monthly maternity allowance (amount set annually) for 9 consecutive months commencing from the start of the 3rd trimester of pregnancy.
Job protection: Employment is protected during maternity leave under the Workers' Rights Act. Dismissal related to pregnancy or maternity leave is unlawful. Return to the same position is protected. The employer must not reduce benefits or change terms of employment because of pregnancy.
Paternity Leave (Workers' Rights Act, amended June 2024)
Max duration: 4 consecutive calendar weeks (28 days) of paid paternity leave — increased from 5 working days (June 2024 amendment). Requires 12 months of continuous service with the same employer. Paid at full salary by the employer.
Split rules / Elterngeld: Paternity leave must be taken as a consecutive 4-week block around the time of the birth. It cannot be split into shorter periods. No statutory shared parental leave scheme exists in Mauritius — maternity and paternity leave are separate entitlements for each parent. Any leave arrangements beyond these statutory minimums require employer agreement.
Benefits
Maternity Benefit (employer-paid under Workers' Rights Act)
100% of salary for 16 weeks; 18 weeks for multiple births or premature babies. Additionally, a monthly maternity allowance for 9 months from the 3rd trimester.
Duration: 16 weeks (standard); 18 weeks (multiple/premature births)
Eligibility: Female employees covered by the Workers'Rights Act. Note: the 12-months service requirement must be confirmed against current statutory requirements — verify with your employer.
How to apply: Notify your employer of pregnancy and expected delivery date. The employer pays directly through payroll. Provide a medical certificate confirming the pregnancy and expected due date. The maternity allowance is administered through the employer — confirm the current monthly amount with your HR department.
The June 2024 amendment increased maternity leave from 14 to 16 weeks — if you see older references to 14 weeks, they are out of date. The additional monthly allowance during the 3rd trimester and maternity leave is a Mauritius-specific benefit that enhances the total financial support.
School Allowance (employer negotiated)
Varies; can be MUR 100,000–500,000+/year at international school level
Duration: Employment contract term
Eligibility: Negotiated in expat employment contract — not a statutory benefit
How to apply: Negotiate before signing contract; specify per-child cap, eligible schools, and payment terms in writing
International schools in Mauritius (International School of Mauritius, École Ruisseau Créole, Northfields International School) charge significant fees. School places are competitive — apply before accepting the relocation offer.
Dependent Residence Permit
Permit fee approximately USD 500–1,500/permit (varies by category)
Duration: Linked to the primary permit holder's permit term
Eligibility: Spouse and minor children of qualifying permit holders (Occupation Permit, Professional Occupation Permit, Investor permit)
How to apply: Apply through the Economic Development Board (EDB) eServices portal (edbmauritius.org) or the Prime Minister's Office Immigration Division. Required: marriage certificate (apostilled), children's birth certificates, passport copies, primary permit documentation.
Dependent permit spouses are not automatically authorised to work — a separate work permit or amendment to the permit is required for the dependant spouse to take paid employment. Factor in permit timeline (4–8 weeks typical) when planning a family move.
Sick child leave
No specific statutory sick-child leave under the Workers' Rights Act 2019. Parents use annual leave, employer-agreed flexibility, remote work where possible, or unpaid leave for child illness situations. Some multinational and financial sector employers include dedicated family emergency leave days in their HR policies — check your employment contract.
Birth registration
All births in Mauritius must be registered at the Civil Status Office within 45 days of birth. For in-hospital births, the hospital provides initial birth notification assistance. Required documents: hospital birth certificate, both parents' National Identity Cards or passports, marriage certificate (if applicable, apostilled if issued abroad). The Acte de Naissance (birth certificate) is issued by the Civil Status Office and is required for all subsequent applications including child benefit, health insurance enrollment, and school registration. Foreign parents must also register the birth at their home-country embassy or high commission in Port Louis for the child's citizenship documentation.
Childcare rights
No universal public childcare subsidy in Mauritius for expat families. Private nurseries and pre-primary schools are available across the island (Grand Baie, Quatre Bornes, Curepipe, and other expat areas). Monthly fees for private daycare range from MUR 5,000–15,000/month. Government-run crèches exist but are primarily accessible to qualifying Mauritian families. The Early Childhood Care and Education (ECCE) programme covers ages 3–5 at government pre-primary schools — non-citizen children may attend subject to availability and work permit conditions. Nanny/au pair arrangements are common for expat families; establish written terms covering pay (above minimum wage), hours, leave, and emergency procedures.
