Extended in case of multiple births, premature birth, or medical complications — consult ISS for the applicable extension. Payment is at 100% of average salary and is funded by ISS (not the employer directly).
Job protection: Employment protection during maternity leave is comprehensive under San Marino labour law. Dismissal for pregnancy-related reasons is unlawful. The employee has the right to return to the same or equivalent position. Contact the Ufficio del Lavoro (Labour Office) if you experience any adverse treatment during pregnancy or maternity leave.
Congedo di Paternità / Parentale (Paternity / Parental Leave)
Max duration: 5 days paid paternity leave for fathers (around the time of birth). Additional parental leave provisions may exist under collective agreements — check your specific CAL (contratto collettivo di lavoro). San Marino's family leave legislation has been expanding — confirm current paternity entitlements with ISS (iss.sm) or the Ufficio del Lavoro.

Maternity Benefit (ISS)

Duration: 5 months (2 months prenatal + 3 months postnatal)
Eligibility: Employed women registered with ISS (Istituto per la Sicurezza Sociale) who have paid the required minimum contributions before the maternity period. Foreign nationals working in San Marino under a valid work permit and contributing to ISS are entitled to the benefit.
How to apply: Notify your employer of pregnancy and expected delivery date. Employer notifies ISS and processes the maternity leave declaration. Birth registration
Births in San Marino must be registered at the Ufficio di Stato Civile (Civil Registry Office) within 10 days of birth.
