Consumer Rights

Right of withdrawal, contracts and debt collection in Canary Islands.

Spanish consumer protection is governed by the Ley General para la Defensa de los Consumidores y Usuarios (TRLGDCU, RDL 1/2007, repeatedly updated). Strong 14-day cooling-off right (derecho de desistimiento) for distance/online/doorstep sales. Auto-renewal clauses are regulated. Always respond to burofaxes and court summonses — these are the only reliable evidence in Spanish civil law. Comunidades Autónomas enforce via OMIC (Oficina Municipal de Información al Consumidor).

Right of withdrawal (Widerrufsrecht)

14 calendar days from receipt of goods (or contract conclusion for services) for all distance/online/off-premises sales (TRLGDCU arts. 102–108). No reason required (derecho de desistimiento). Exclusions: custom-made goods, opened hygiene/cosmetic items, sealed audio/video/software opened, digital content after download starts with your consent, perishables, time-specific leisure (hotel/concert on fixed date), financial services have separate 14-day rule. Notify seller in writing (email with read-receipt or burofax is strongest). Return within another 14 days. Seller must refund within 14 days of being notified — including original outbound shipping cost.

Contract cancellation

Telecom, energy and subscription contracts: mandatory 15 days before auto-renewal to notify consumer of upcoming renewal (Ley 11/2022 General de Telecomunicaciones for telecom; equivalent sector rules for energy). Consumer can cancel any time with no penalty after minimum permanence (max 24 months permanence allowed; cancellation during permanence triggers penalty proportional to remaining months but capped). Phone-based sales require confirmation in durable medium (email, PDF) that consumer can verify, else contract is unenforceable.

Auto-renewal clauses (cláusulas de prórroga tácita) are permitted but must be prominent in pre-contract information. Silent renewal clauses in consumer contracts can be void under Ley 7/1998 General de Condiciones de la Contratación if they are abusive (cláusulas abusivas — art. 85 TRLGDCU lists 16 types). Typical abuse: renewal with notice period longer than 1 month, or requiring burofax to cancel.

Debt collection — response deadlines

Informal reminders: Informal: 1st aviso → 2nd notice → call-based harassment → debt sold to agency (Intrum, GESTORA DEL ÁTICO, etc). You can register at ASNEF defaulters list for as little as €50 unpaid.

Court order: Monitorio (payment order procedure, LEC art. 812): creditor files claim at Juzgado de Primera Instancia. Court notifies you by burofax or personal service. You have 20 working days to oppose (oponerse) OR pay. No opposition + no payment = automatic enforceable order → embargo de cuenta bancaria / nómina / bienes.

Response deadline: 20 working days from personal service (NOT from burofax — burofax alone is not service for judicial purposes unless explicitly stated). File oposición al monitorio using simple written form. Failure to respond within 20 days converts the claim to an executable judgment — enforceable for 5 years on property, accounts, future salary.

Ignoring a burofax or a court notification is the single most expensive Spanish civil mistake. Once converted to sentencia firme the claim becomes enforceable for 5 years (10 if re-filed) — embargo on your account or nómina can happen within 2 weeks. Always reply in writing, even disputing. Consumer debt of over €2,000 can be discharged via Ley de Segunda Oportunidad (since 2015, reformed 2022) if you meet good-faith criteria.

Consumer protection authority

OMIC (Oficina Municipal de Información al Consumidor) at your Ayuntamiento — free advice and formal complaints. Junta Arbitral de Consumo of each CCAA — binding arbitration procedure, free, decisions within 4 months. National: DSCA — Ministerio de Derechos Sociales, Consumo y Agenda 2030 (dsca.gob.es); AECOSAN consumer protection functions now integrated within DSCA. Consumer associations: OCU (ocu.org), FACUA (facua.org), CECU.

For immediate complaint: Hoja de Reclamaciones (official complaint form) — businesses are legally required to provide one. Submit stamped copy to Dirección General de Consumo of your CCAA or OMIC. For finance/banking: Banco de España's Servicio de Reclamaciones. For telecom: Secretaría de Estado de Telecomunicaciones (sedeaplicaciones.minetur.gob.es/reclamaciones). For airlines: AESA (aesa.gob.es). Always keep: original contract, receipts, email confirmations, screenshots, burofaxes received/sent. Send important formal notices by burofax con acuse de recibo — Correos service costing €40 that provides legal proof of content and delivery.
