Consumer Rights
Right of withdrawal, contracts and debt collection in Belgium.
Belgium's consumer rights are governed by the Code of Economic Law (Wetboek van Economisch Recht / Code de Droit Économique), which implements EU consumer directives and adds additional national protections. Key rights include: a 14-day withdrawal right for online/distance purchases, a 2-year legal guarantee on all goods, unfair contract term protection, and strong anti-unsolicited-communication rules. The SPF Economie/FOD Economie is the main enforcement authority.
Right of withdrawal (Widerrufsrecht)
14 calendar days from delivery for online and distance purchases (phone, mail order). No reason required. The seller must refund within 14 days of receiving the returned goods (or proof of return). Return shipping costs are borne by the consumer unless the seller has stated otherwise. For services, the 14-day period runs from the day the contract is concluded. Digital content and clearly personalised goods are exempt.
Contract cancellation
For services (subscriptions, gym memberships, telecoms, insurance): written cancellation notice required. Notice period: maximum 2 months for most service contracts under Belgian law. Telecoms (internet, TV, phone): maximum 2-month notice period; if notice is correctly given, the contract must end on that date. For indefinite-duration services, you can cancel at any time with the contractual notice period. Always use registered post (aangetekende brief / lettre recommandée) for contract cancellations — this creates legal proof of the date.
Belgian law requires that contracts with automatic renewal (stilzwijgende verlenging / tacite reconduction) must notify the consumer of the upcoming renewal between 1–3 months before the renewal date. If no notification is given, the consumer can cancel the renewal without penalties. This applies to gym memberships, magazine subscriptions, insurance, and other annual contracts. Check your contract carefully on anniversary dates.
Debt collection — response deadlines
Informal reminders: Belgian creditors typically send 1–3 payment reminders (aanmaningen / rappels) before escalating. Under Book XIX of the Code of Economic Law (in force September 1, 2023): the first reminder must be sent FREE of charge; for regular supply contracts (subscriptions etc.) the first three reminders per calendar year must be free — from the fourth default per year, max €7.50 + postage may be charged; for other contracts, a second reminder may cost up to €7.50 + postage. Compensation clauses for debts ≤ €150 are capped at €20; for debts between €150–500: max 5% of the debt; above €500: capped amounts per a sliding scale.
Court order: If payment is refused after formal notice, creditors can apply for a payment order (betalingsbevel) from the justice of the peace court (vredegerecht / justice de paix). For sums below €5,000 this is a simple procedure. Court bailiffs (deurwaarders / huissiers) can then enforce recovery.
Response deadline: If you receive a bailiff's letter or court summons, you have typically 1 month to respond or pay. Contact a legal aid service (pro-deo lawyer) immediately if you cannot pay.
