Family Rights & Benefits
Maternity, parental leave and child benefits in Italy.
Italian family benefits and parental rights are administered primarily by INPS (Istituto Nazionale della Previdenza Sociale). The 2022 Family Act reform (DLgs 105/2022) significantly expanded paternity leave and parental leave. The Assegno Unico e Universale (Universal Single Allowance), introduced in 2022, replaced multiple fragmented child benefits with a single monthly payment for each dependent child from birth to age 21. Italy has one of Europe's most generous maternity pay systems (80% for 5 months) but faces a major fertility challenge — the birth rate in 2026 is among the lowest in the EU (1.20 children per woman).
Congedo di Maternità (Maternity Leave)
Before birth: 2 months before the expected birth date (obbligatorio). Can be extended (anticipato) if the job is hazardous or the pregnancy is at risk — doctor's certificate required.
After birth: 3 months after birth (obbligatorio). Paid at 80% of average daily salary by INPS. Total: 5 months mandatory (2 + 3), with option to shift 1 month to post-birth under "flessibilità" (Art. 20 DLgs 151/2001). For premature births, leave adjusts accordingly. Self-employed and freelancers: INPS pays maternity indemnity for Gestione Separata at 80% for 5 months if contributions are sufficient.
Job protection: Full job protection from pregnancy notification to 1 year after birth. Cannot be dismissed. Cannot be transferred to a different role without consent. Cannot be required to work night shifts. If dismissed during protected period: dismissal is null and void (nullo) and employer must pay back wages plus reinstate.
Congedo Parentale (Parental Leave)
Max duration: Each parent: up to 3 months individually non-transferable (formerly 6 months each, reformed 2022). The remaining months (total 11 months between parents) can be shared. Total parental leave per couple: 11 months (reducible if both parents take their 3 non-transferable months). Children up to 12 years old (extended from 8 in 2022 reform). Self-employed (Gestione Separata): right to parental leave, paid at 30% by INPS for 3 months.
Split rules / Elterngeld: Each parent has 3 non-transferable months. Remaining months up to the family total (11) can be divided by agreement. First month of parental leave: paid at 80% (raised from 30% in 2023 DLgs 105/2022 for 1 month). Additional months: paid at 30% of average daily salary by INPS. Unpaid parental leave: can continue up to child age 12 without pay.
Benefits
Assegno Unico e Universale
€57.50–175/month per child (2026, depending on ISEE). Base amount without ISEE declaration: €57.50/child. Maximum with ISEE under €15,000: up to €175/child/month. Supplement for disabled children, multiple births, both parents working.
Duration: From the 7th month of pregnancy until child age 21 (21 only if studying or doing an apprenticeship and living with parents). Permanent for children with severe disability (disabilità grave) regardless of age.
Eligibility: All residents with dependent children under 21 — citizens, EU residents, and non-EU residents with a long-term Permesso di Soggiorno (CE type). Self-employed, employees, unemployed, and inactive all eligible. ISEE required to receive above-minimum amount.
How to apply: Online at INPS portal (inps.it) with SPID or at CAF (free). Submit ISEE declaration to receive the income-related amount. Payment: monthly bank transfer from INPS.
The Assegno Unico replaced 8 previous fragmented benefits in 2022. All ISEE families receive above the base amount; the maximum is paid to families with ISEE under €15,000 with children under 3. Extra amounts for: third or subsequent children (+€85/month in 2026); disabled children; both parents working.
Congedo di Paternità Obbligatorio
100% of average daily salary (paid by INPS)
Duration: 10 working days (mandatory, DLgs 105/2022). Must be taken within 5 months of birth (or adoption). Additional 5 optional days at mother's request.
Eligibility: All employed fathers. Self-employed (Gestione Separata): paternity indemnity available under reformed rules.
How to apply: Via INPS portal with SPID. Employer must be notified at least 15 days in advance.
Italy increased paternity leave from 7 to 10 days in 2023 under DLgs 105/2022. Unlike Scandinavian countries, Italy's paternity leave is still relatively short — a major policy debate in 2026.
Bonus Nido (Nursery Voucher)
€1,500–3,000/year (means-tested by ISEE). Maximum €3,000/year for ISEE under €25,001.
Duration: Annual, per child aged 0–3 years enrolled in a private authorised asilo nido
Eligibility: Resident families with children 0–3 in private nurseries. Requires an ISEE declaration.
How to apply: INPS portal with SPID, within 90 days of starting nursery. Monthly reimbursement to the family.
Does not apply to children already receiving SSN/public ASL childcare contribution. Cannot be combined with home-care voucher.
Sostegno alla Natalità / Bonus Bebè
€80–160/month (2026, ISEE-based)
Duration: From birth/adoption until child turns 1 year old (12 months)
Eligibility: Families with ISEE under €25,000 for the maximum; all families with newborns may receive a partial amount. Applicable to births and adoptions.
How to apply: INPS portal within 90 days of birth. ISEE declaration required.
The specific amounts and eligibility thresholds are subject to annual budget law revisions. Check INPS website in January of each year for updated 2026 values.
Sick child leave
Congedo per malattia del figlio (sick child leave): parents of children under 3 may take unlimited paid leave (a carico INPS at 30%, or 100% under some CCNLs) when the child is ill — with a paediatric certificate. For children 3–8: up to 5 days/year per parent at 30% of salary. Beyond 8 years: no statutory paid sick child leave (unpaid leave at the Giudice del Lavoro's discretion). CCNL may provide better terms.
Birth registration
All births in Italy must be registered at the Comune (Ufficio di Stato Civile) within 10 days (3 days if declared at the hospital — most maternity wards do this automatically). Required documents: birth certificate from hospital (attestato di nascita), parents' identity documents and Codice Fiscale. For foreign parents: marriage certificate or declaration of partnership. The child automatically receives an Italian Codice Fiscale at birth registration. Non-Italian parents: the child's citizenship depends on the parents' citizenship (jure sanguinis) — Italian citizenship flows automatically if at least one parent is Italian.
Childcare rights
Italy's childcare system is strongly publicly supported but chronically underfunded. Right to return from maternity/paternity leave to the same position (Art. 56 DLgs 151/2001). Breastfeeding breaks: 2 hours/day paid (ore di allattamento) for the first year of the child's life (Art. 39 DLgs 151/2001). Part-time right for parents of children under 3: request to switch to part-time cannot be unreasonably refused. Remote working right (smart working): parents with children under 12 have a priority right to smart working if technologically feasible under the employment contract.
