Maternity, parental leave and child benefits in Peru.
Peru family rights combine labour-law maternity protections, EsSalud benefits, RENIEC civil registration and school/health documentation. Foreign documents need apostille/legalisation and Spanish translation for many family processes.
Descanso pre y post natal
Before birth: 49 days before birth in standard rules
After birth: 49 days after birth in standard rules, with extensions for multiple births/complications
Job protection: Pregnancy and maternity are protected; dismissal linked to pregnancy/maternity can be challenged.
Licencia por paternidad (Paternity Leave)
Max duration: 10 consecutive days paid paternity leave from the date of birth (Law 29409). Extended to 20 days for complicated births, premature deliveries, or births requiring immediate hospitalisation of the newborn. Paid at 100% of salary by the employer.
Split rules / Elterngeld: Paternity leave is employer-funded and taken immediately at the time of birth. No shared parental leave scheme exists in Peru — maternity and paternity leave are separate, non-transferable entitlements. Eligibility: employee must have completed at least 3 months of service with the same employer in the 6 months before the leave commences.
Benefits
EsSalud Maternity Subsidy (Subsidio por Maternidad)
100% of average insured monthly remuneration over the 3 months preceding the leave. EsSalud pays the full benefit directly to the employer who then credits it to the employee's payroll.
Duration: 98 days (49 pre-natal + 49 post-natal) — extended for multiple births or complications
Eligibility: Female employees contributing to EsSalud who have 3 months of consecutive contributions in the 6 months before the expected delivery date.
How to apply: Notify employer of pregnancy. Employer submits to EsSalud: CITT (Certificado de Incapacidad Temporal para el Trabajo) from an ESSALUD doctor, average salary record, and birth certificate after delivery. EsSalud reimburses the employer who pays the employee.
Expat employees must be registered with EsSalud from day one (9% of salary contributed by employer). Verify your ESSALUD enrollment via essalud.gob.pe or the Vía EsSalud app. For employees under AFP (private pension) rather than public system, EsSalud maternity rules still apply.

Sick child leave
Family-care leave rights are narrower than in much of Europe; check employer policy and labour lawyer guidance for serious illness.
Birth registration
Births in Peru are registered through RENIEC/municipal civil registry. Foreign parents need passports/CE and hospital birth certificate.
Childcare rights
Public early education exists, but expat families often rely on private daycare/nannies; domestic workers must be paid formally with legal benefits.
