Maternity, parental leave and child benefits in Philippines.
Philippine family law is governed by the Family Code (EO 209, 1987) and various special laws. The Philippines is the only country in the world (besides Vatican City) with no divorce law — legal separation and annulment are the only options for marriage dissolution. The Magna Carta of Women (RA 9710) and Solo Parent Welfare Act (RA 8972) provide protections. SSS, PhilHealth, and Pag-IBIG provide family benefits. The Expanded Maternity Leave Act (RA 11210) is one of the most generous in Southeast Asia.
Expanded Maternity Leave (RA 11210)
Before birth: Flexible — mother chooses when to start leave within the 105-day total allowance. Many choose 2–4 weeks before due date.
After birth: 105 calendar days total leave (live birth). 120 days if a solo parent (Solo Parent Welfare Act, RA 8972). 60 days for miscarriage/emergency termination. Paid via SSS Maternity Benefit (100% of average daily salary credit × 105 days). Additional 30 days unpaid leave available upon request.
Job protection: Absolute prohibition on dismissal due to pregnancy, childbirth, or related conditions. Dismissal is illegal and void. Employee must be reinstated to same position with same terms after leave. SSS pays the maternity benefit — employer advances pay, SSS reimburses.
Paternity Leave / Parental Leave
Max duration: 7 days paid paternity leave (Paternity Leave Act RA 8187) for married male employees for first 4 deliveries. Solo parents (RA 8972): additional 7 days parental leave per year (above normal leave). RA 11210 option: maternity leave holder may allocate 7 days to qualified father/partner.
Split rules / Elterngeld: Under RA 11210, the birthing parent may transfer up to 7 days of the 105-day maternity leave to the father or partner (qualified alternate caregiver). This transfer reduces the mother's leave by 7 days. Both parents must be SSS members and meet contribution requirements.
Benefits
SSS Maternity Benefit
100% of average daily salary credit × 105 days (or 120 for solo parents, 60 for miscarriage)
Duration: 105 calendar days per qualified delivery
Eligibility: SSS members who have at least 3 monthly contributions in the 12 months before the semester of delivery. Covers married and unmarried members. No delivery limit per RA 11210.
How to apply: File SSS Maternity Benefit notification and claim at SSS branch or online (My.SSS portal) before or after delivery. Employer advances benefit; SSS reimburses employer.
RA 11210 removed the previous 4-delivery limit for SSS maternity benefits. Self-employed and voluntary members also qualify.
SSS Sickness Benefit
90% of average daily salary credit × number of days confined (up to 120 days per year)
Duration: Per confinement, up to 120 days/year
Eligibility: 3 monthly SSS contributions in the 12 months before semester of confinement. Must be unable to work for 4+ consecutive days.
How to apply: Notify employer within 5 calendar days of start of confinement. Employer files claim to SSS. Self-employed: file directly at SSS.
PhilHealth Maternity Benefit
Case rate packages: ₱6,500 (normal delivery) or ₱19,000 (C-section) — covers portion of hospital and professional fees
Duration: Per delivery
Eligibility: Active PhilHealth member with at least 9 monthly contributions in the 12 months before delivery.
How to apply: Present PhilHealth MDR at accredited hospital. Hospital files claim directly to PhilHealth on member's behalf.
Solo Parent Benefits (RA 8972)
10% discount on goods and services (similar to senior citizen discount); additional 7 days parental leave; housing and livelihood assistance programs
Duration: While Solo Parent ID is valid (renewable annually)
Eligibility: Parent caring for child alone due to: death of spouse, abandonment, legal separation, unmarried status, work abroad, physical/mental incapacity of spouse. Apply at DSWD office for Solo Parent ID.
How to apply: Apply at DSWD field office with: solo parent circumstances documentation, birth certificate of child, barangay certification.
Solo Parent ID provides priority in government services and some private sector benefits.
Pag-IBIG Housing Loan Program
Up to ₱6,000,000 housing loan at concessional rates (2026: ~5.75%–6.375% per annum)
Duration: Up to 30 years repayment
Eligibility: Active Pag-IBIG members with at least 24 monthly contributions. Both Filipino and foreigner contributors with AEP qualify.
How to apply: Apply at Pag-IBIG Fund office or online. Foreigners can access the housing loan program for condo purchases (not land).
Sick child leave
No statutory sick child leave per the Labour Code. However, employees may use their own SIL (Service Incentive Leave) or company-provided sick/emergency leave for sick child care. Solo parents have the additional 7 days parental leave annually which can be used for child sickness.
Birth registration
All births must be registered with the Local Civil Registry (LCR) within 30 days of birth (RA 9048 as amended). Hospital-born babies: hospital administrator is the informant. Home births: attending physician or midwife. The LCR issues a Certificate of Live Birth. PSA (Philippine Statistics Authority) authenticated copy needed for all government transactions. Foreign-born children of Filipino citizens should register at the nearest Philippine consulate (Report of Birth).
Childcare rights
Under RA 11210 and DOLE Department Order 143-15: companies with 200+ employees must provide a lactation station (designated breastfeeding room). RA 10028 (Expanded Breastfeeding Promotion Act) mandates 40-minute daily breastfeeding break (split 20 minutes twice). Breastfeeding mothers employed in companies with 10+ employees may use this break during work hours. Lactation break is counted as paid work time.
