Consumer Rights

Right of withdrawal, contracts and debt collection in Romania.

Romanian consumer protection is based on Ordonanța 21/1992, transposed EU directives (including the Consumer Rights Directive), and enforcement by ANPC (Autoritatea Națională pentru Protecția Consumatorilor). The 14-day right of withdrawal applies to almost all online and doorstep purchases. Always respond to formal debt-collection letters and court orders (ordonanță de plată) within the deadline — ignoring them is the most expensive mistake.

Right of withdrawal (Widerrufsrecht)

14 calendar days from receipt of goods (or contract conclusion for services) for distance sales and off-premises contracts (online, telephone, doorstep). Send a written withdrawal (formular de retragere or email) within 14 days — no reason required. Return goods within another 14 days at your own cost unless the seller agreed otherwise. Seller must refund within 14 days of receipt of the goods, including standard outbound shipping. Exceptions: custom-made goods, opened hygiene/sealed items, digital content after download starts, dated travel/event tickets.

Contract cancellation

Service contracts (telecom, gym, subscription services) must allow cancellation with reasonable notice. Fixed-term contracts longer than 12 months must allow cancellation after the first 12 months with the stipulated notice (typically 30 days). Phone/online sign-ups for telecom services require written confirmation after the call — unconfirmed contracts are invalid.

Ordonanța 85/2014 and consumer-protection rules: auto-renewal clauses are valid only if explicitly agreed in a clear, separate clause. Consumers retain the right to cancel with 30 days notice after an auto-renewal, and the trader must provide advance written notice before the renewal takes effect.

Debt collection — response deadlines

Informal reminders: Informal notices (notificare) from the creditor or in-house collections; followed by referral to a private recovery agency (firmă de recuperare creanțe).

Court order: Ordonanță de plată under Codul de Procedură Civilă Art. 1014-1025 — fast-track court order issued by judecătoria. If not contested or settled, it becomes enforceable through a bailiff (executor judecătoresc) for salary/account seizure (poprire) or asset execution.

Response deadline: 10 days from service of the ordonanță de plată to file a contestation (cerere în anulare) at the issuing court. Full debt-collection court actions allow a standard 15-25 day response window stated on the summons.

Unsolicited "debt" calls from fake collectors are a known scam — always demand the written contract and itemised claim, and verify the collector at anpc.ro. Never pay by phone or to a personal account. If unsure, report the caller to ANPC and consult an attorney before acknowledging anything.

Consumer protection authority

ANPC (Autoritatea Națională pentru Protecția Consumatorilor) — anpc.ro. Each county has a Comisariat Regional pentru Protecția Consumatorilor (CRPC). ANPC handles complaints about retail, e-commerce, misleading advertising, product safety and unfair contract terms.

Submit complaints at anpc.ro/reclamatii or call the consumer helpline 021-9551. Keep copies of every contract, confirmation email, invoice and cancellation letter. For financial-services disputes, use SAL-Fin (alternative dispute resolution for financial services). General mediation is available through the Centre for Mediation. In-person complaints can be filed at the regional CRPC office.
