Consumer Rights

Right of withdrawal, contracts and debt collection in Germany.

German consumer protection is among the strongest in the EU. The 14-day right of withdrawal applies to almost all online and doorstep purchases. Auto-renewal clauses are now tightly regulated (since 2022). Always respond to Mahnungen and, especially, to court letters (yellow envelope) within the stated deadline.

Right of withdrawal (Widerrufsrecht)

14 days from receipt of goods (or contract conclusion for services). Applies to all online, telephone and doorstep sales to consumers (B2C). Does not apply to: custom-made goods, opened hygiene items, digital content after download starts, travel/hotel on a fixed date. Send Widerruf in text form (email is fine) within 14 days. No reason needed. Then return goods within another 14 days. Seller must refund within 14 days of receipt, including original outbound shipping.

Contract cancellation

For contracts signed after 1 March 2022: maximum initial term 24 months; cancellation with 1 month notice AFTER the initial term. Silent renewal for another year is no longer allowed — contracts auto-continue month-to-month with 1-month cancellation. Phone/energy sales over the phone now require written text confirmation (since Aug 2021) — otherwise the contract is invalid.

If the contract pre-dates March 2022 or is a business contract, older rules with up to 3 months cancellation before year-end apply.

Debt collection — response deadlines

Informal reminders: 1st informal Mahnung → 2nd-3rd Mahnung with fees → Inkasso-Büro (private collection)

Court order: Gerichtlicher Mahnbescheid (yellow envelope from Amtsgericht) → Vollstreckungsbescheid → Zwangsvollstreckung (enforcement: wage/account seizure).

Response deadline: 14 days from delivery of the gelber Brief to file a Widerspruch (objection) using the enclosed form. For a Vollstreckungsbescheid, another 14 days to Einspruch.

Ignoring a yellow envelope is the single most expensive mistake. After 14 days the claim becomes enforceable against your salary, bank accounts and property for up to 30 years. Always open and respond — even if you dispute it.
