Family Rights & Benefits
Maternity, parental leave and child benefits in Germany.
Germany has generous family protections: strong job protection for pregnant women, 14 months paid parental leave split between parents, universal Kindergeld and a legal right to daycare from age 1. Planning the timing of Steuerklasse changes and parental leave split can add €2,000–8,000+ to benefits.
Mutterschutz
Before birth: 6 weeks paid Mutterschutz before the due date (mandatory job protection, not mandatory leave — you can work if you choose).
After birth: 8 weeks after birth (12 weeks for multiple or premature births). MANDATORY — cannot return to work.
Job protection: Kündigungsverbot from moment pregnancy is reported until 4 months after birth — absolute dismissal ban except in very narrow cases (authority approval required).
Elternzeit / Elterngeld
Max duration: Elternzeit up to 3 years per child, can be taken any time until the child turns 8. Must give employer 7 weeks notice for the first 3 years and 13 weeks for leave after age 3.
Split rules / Elterngeld: Elterngeld: min €300 / max €1,800 per month for 12 months (14 months if both parents take at least 2 months — "Partnermonate"). Based on net salary in the 12 calendar months before the month of birth. Income cap: combined taxable income must not exceed €175,000/year (current as of 2026). Apply at your Bundesland's Elterngeldstelle.
Benefits
Kindergeld
€259 per month per child (2026)
Duration: Until child turns 18 (up to 25 if in education)
Eligibility: All children under 18 resident in Germany; up to 25 if in education.
How to apply: Familienkasse at the Agentur für Arbeit. Need child's tax ID.
Paid regardless of parents' income. Increased from €255 to €259 on 1 Jan 2026. Child tax allowance (Kinderfreibetrag) also increased to €6,828/year (€3,414 per parent) in 2026.
Kinderzuschlag
up to €297 per month per child
Duration: While eligible
Eligibility: Low-to-mid income working parents whose income covers their own needs but not the child's.
How to apply: Apply at Familienkasse alongside Kindergeld.
Elterngeld Basis
€300–1,800 per month
Duration: 12/14 months after birth
Eligibility: 12/14 months after birth.
How to apply: Elterngeldstelle of your Bundesland — many offer online applications (e.g. ElterngeldDigital in Berlin, NRW, Bayern).
Wohngeld
Regional, up to ~€400/month for a family of 4
Duration: While eligible
Eligibility: Low-income households not receiving Bürgergeld.
How to apply: Wohngeldstelle at local city hall.
Massively reformed in 2023 — more families qualify now.
Kita-Gutschein
Reduced / free childcare
Duration: Until school age
Eligibility: Depends on Bundesland. Berlin: free from age 1. Hamburg: 5h/day free. Bayern & BW: income-scaled fees.
How to apply: Local Jugendamt.
Kinderkrankentage
up to 15 days per parent per child (30 single parent), 2026
Duration: Per calendar year
Eligibility: Statutorily insured parents to care for sick children under 12.
How to apply: Doctor's note (Kinderkrankenschein) → Krankenkasse pays Kinderkrankengeld (~90% of net).
Sick child leave
Up to 15 sick child days per parent per child per year (30 for single parents). Kinderkrankengeld ~90% of net salary paid by Krankenkasse. Requires a Kinderkrankenschein from the child's Kinderarzt.
Birth registration
Register the birth at the Standesamt within 7 days. Bring parents' passports/ID, marriage certificate (apostilled + translated if foreign), birth certificates of parents (often required). The Geburtsurkunde is needed for Elterngeld and Kindergeld.
Childcare rights
Every child has a legal right (Rechtsanspruch) to a Kita/Tagesmutter place from their first birthday. If your city cannot offer one, you can claim compensation for private childcare costs. Apply 6–12 months before desired start — waitlists in big cities are brutal.
