Right of withdrawal, contracts and debt collection in Kosovo.
Consumer protection in Kosovo is governed by the Law on Consumer Protection (Law No. 04/L-121) and administered by the Market Inspectorate under the Ministry of Industry, Entrepreneurship and Trade (MINT). Kosovo is an EU accession candidate and has been progressively aligning consumer law with EU standards. The Coordination Body for Market Surveillance (CBMS — tkmt.rks-gov.net) oversees product safety and non-food product compliance. Practical enforcement is improving but remains weaker than in EU member states. Keep all receipts, contracts, and written correspondence for any significant transaction.
Right of withdrawal (Widerrufsrecht)
Kosovo's consumer protection law provides a 14-day right of withdrawal for distance and off-premises contracts (online purchases, door-to-door sales), in line with EU Consumer Rights Directive standards adopted as part of EU accession alignment. The 14-day period starts from the day of delivery for goods, or from contract conclusion for services. Notify the seller in writing within 14 days — no reason required. For in-store purchases, returns depend on the seller's stated policy unless the goods are defective. Always inspect goods before leaving the shop and check the return policy before purchasing expensive items.
Contract cancellation
Service contracts (telecom, internet, gym, rental) are governed by the written contract terms. Telecom contracts (IPKO, Vala): typically 12–24 month minimum terms with early termination fees; month-to-month plans can usually be cancelled with 30 days written notice. Rental agreements: cancellation per the written lease terms, typically 30–60 days notice. Cancel in writing and request written confirmation of cancellation.
Auto-renewal clauses are permitted in Kosovo service contracts. Providers must disclose renewal terms at the time of contract signing. Diarise all annual contract renewal dates and give written cancellation notice before the renewal date. Request written confirmation. Mobile subscription plans and internet contracts often auto-renew monthly — check your billing statements.
Debt collection — response deadlines
Informal reminders: Creditors typically contact by phone, SMS, and written letter before formal action. Respond promptly to formal written demands and keep all records. Do not ignore formal correspondence even if you dispute the debt.
Court order: Formal debt recovery in Kosovo proceeds through the civil courts. Creditors must obtain a court judgment before enforcing collection through asset seizure or wage garnishment. The Basic Court (Gjykata Themelore) handles first-instance civil matters. Court processes can be slow for contested claims.
Response deadline: Respond to formal court documents within the deadline stated in the summons (typically 15–30 days). Ignoring court documents results in a default judgment against you. Seek legal advice from a Kosovo Bar Association-registered lawyer (Oda e Avokatëve të Kosovës — oak-ks.org) immediately if you receive court papers.
