Steps to register:
- 1 Register as a sole proprietor with the Companies Commission of Malaysia (SSM) via MyCoID portal at ssm.com.my โ RM60/year registration fee (Peninsular Malaysia). NOTE: This option is only available to Malaysian citizens and permanent residents โ foreign nationals with Employment Passes cannot register a sole proprietorship.
- 2 Foreign freelancers should consider registering a Sdn Bhd (private limited company) โ 100% foreign-owned permitted, minimum paid-up capital RM1, appoint a Company Secretary (legally required), register with SSM.
- 3 Register with LHDN (Inland Revenue Board) for income tax: apply for a Tax Reference Number at hasil.gov.my or nearest LHDN branch within 1 month of starting business.
- 4 Register for SST (Service Tax) if annual turnover exceeds RM500,000 โ mandatory registration at customs.gov.my. Service Tax (6%) must be charged to clients and remitted bi-monthly.
- 5 Register with SOCSO/PERKESO as a self-employed individual for employment injury insurance coverage โ optional but recommended (RM10โ20/month voluntary contribution).
- 6 Open a business bank account (Maybank Business Account, CIMB Business, or Public Bank Business) โ separate from personal account for clean accounting.
- 7 Set up accounting software: Autocount, SQL Accounting, or cloud-based Wave/Xero for invoicing, expense tracking, and tax preparation.
- 8 Consider professional indemnity insurance if working in consulting, IT, or professional services.
Tax registration
Register at LHDN (hasil.gov.my) within 1 month of starting business. Self-employed file Form B (not Form BE) annually by June 30. Monthly estimated tax payments (CP500) may be required if annual tax exceeds RM1,000. Keep all business receipts, invoices, and bank statements for 7 years.
VAT threshold
RM500,000 annual turnover for mandatory Service Tax (SST) registration. Below this threshold: no SST registration required. Most freelancers fall below this threshold. Sales Tax applies to manufactured goods at 10% โ typically not applicable to service-based freelancers.
Invoicing
Invoices must include: your name/business name and address, client name and address, invoice number, invoice date, description of services, amount, SST number (if registered), and SST amount (if applicable). No e-Invoice mandate for individuals yet (B2B e-Invoice mandate for large businesses from August 2024, extending to smaller businesses progressively to 2027).
Social security
Self-employed individuals may voluntarily contribute to SOCSO under the Self-Employment Social Security Scheme (SESS) โ RM10/month to RM20/month for employment injury coverage. EPF voluntary contributions accepted from self-employed โ no employer match but any amount can be contributed and earns the EPF dividend. EIS: not available to self-employed. Consider private income protection insurance as the primary safety net.
๐ก Malaysia is a good location for remote freelancers due to the DE Rantau Digital Nomad Pass (12-month stay permit for remote workers earning USD24,000+/year from overseas clients). This pass does not allow working for Malaysian clients. Tax residency after 182+ days in Malaysia means Malaysian-sourced income (not overseas income from foreign clients, in most cases) is taxable here. The key advantage for freelancers: no capital gains tax in Malaysia, low income tax rates (compared to European countries), and 100% EPF dividends tax-free.
