Austria implements EU consumer protection law comprehensively. The Konsumentenschutzgesetz (KSchG — Consumer Protection Act) and EU directives on distance selling (FAGG — Fern- und Auswärtsgeschäfte-Gesetz) provide strong consumer rights. Austria's Arbeiterkammer (AK) has a specialist consumer protection unit (AK Konsumentenschutz) providing free advice to all employees. The Wirtschaftskammer (WKO) mediates business disputes. Consumer complaints for online purchases from EU businesses can be submitted through the EU ODR platform.
Right of withdrawal (Widerrufsrecht)
For online, phone, and door-to-door purchases (Fernabsatz- und Auswärtsgeschäfte): you have a 14-day right of withdrawal (Rücktrittsrecht) from the date of receipt of goods, without giving any reason. To exercise the right: send a clear written statement (email is sufficient) to the seller before the 14-day deadline. The seller must refund within 14 days of receiving the withdrawal notice (or the returned goods). You bear the cost of return shipping unless the seller agrees otherwise or the goods are faulty. Exceptions: digital content once download begins (with your explicit consent waiving the right), customised goods, hygiene items once unsealed, airline/hotel reservations with specific dates.
Contract cancellation
Contracts for services (gym, mobile phone, insurance, internet, streaming) can be cancelled according to the contract terms. Minimum terms (Mindestvertragsdauer) must be clearly stated at conclusion. After the minimum term: cancel in writing (email acceptable) observing the contractual Kündigungsfrist (typically 1 month). Contracts that renew automatically (Stillschweigende Verlängerung) must be clearly disclosed — undisclosed auto-renewal is not binding. If the provider significantly changes the contract terms (e.g. price increase): extraordinary cancellation right (außerordentliches Kündigungsrecht) arises.
Automatic contract renewal (Stillschweigende Verlängerung) is legal in Austria but must be: clearly disclosed in the original contract, and the consumer must receive a reminder before the renewal date (some service categories). To cancel: send written notice (eingeschriebener Brief or email with delivery receipt) observing the cancellation period. Gym memberships: KSchG §15 and OGH (Oberster Gerichtshof) case law establish that unreasonably long minimum binding periods in fitness studio contracts are void; the OGH has ruled 12-month or longer binding periods to be unreasonably long for standard (non-trainer-led) gym memberships, and clauses denying cancellation for injury, illness, or relocation are unlawful under §879 ABGB.
Debt collection — response deadlines
Informal reminders: First notice: informal Mahnung (reminder) by letter or email — no legal significance but a warning. Ignore at your peril — unpaid invoices attract interest (4–9.2% per annum) and are reported to KSV1870 if sent to collection.
Court order: If informal reminders fail: the creditor can apply for a gerichtlicher Mahnbescheid (court payment order) at the Bezirksgericht. The court issues the order without hearing your side. You have 4 weeks to file a Widerspruch (objection). If you do not: the order becomes enforceable (vollstreckbar) — your wages, bank accounts, and property can be seized.
Response deadline: 4 weeks from delivery of the Mahnbescheid (RSa registered letter from the Bezirksgericht). Missing this deadline: the debt becomes a legal judgement — very hard to reverse. The 4-week deadline runs from the 3rd day after posting (Zustellfiktion).
