Austria (AT)
Austria is a landlocked Central European republic of nine federal states (Bundesländer), renowned for its stunning Alpine landscapes, imperial history, world-class classical music, and high standard of living.
⚠️ Costly Mistakes to Avoid
The most expensive and common mistakes expats make in Austria — and exactly how to avoid them.
Missing the 3-day Meldezettel deadline
Austrian law requires you to register your address (Meldezettel) within 3 days of moving in — much stricter than in most EU countries. Without the Meldebestätigung you cannot open a bank account, get your e-Card, register a car, or complete most other setup tasks.
⚡ Fine up to €726. Complete blockage of all subsequent registration tasks.
📅 Deadline: Within 3 days of moving in
✅ Fill in the Meldezettel form (available at meldewesen.at or at any Magistratisches Bezirksamt) and have your landlord countersign it. Submit in person at your local Meldeamt/MBA or, in Vienna, at the MA 35 or any Kundenzentrum. Allow for appointment queues — book early.
Having a gap in health insurance (ÖGK)
Health insurance is mandatory for all residents in Austria. Employed persons are automatically covered through ÖGK from day one of employment. However, self-employed persons, students, and those between jobs must actively register — a coverage gap leaves you personally liable for all medical costs at private rates.
⚡ Illegal. Medical costs during gap charged at private rates. ÖGK may demand backdated premiums going back years.
✅ Employed: your employer handles ÖGK registration automatically. Self-employed: register with SVS (Sozialversicherung der Selbständigen) immediately when starting. Job seekers: AMS registration activates ÖGK coverage. EU students: bring a valid EHIC or apply for Mitversicherung.
Overstaying your visa or Schengen entry permission
Non-EU nationals on a 90-day Schengen visa or visa-free entry must apply for an Austrian residence permit before their 90 days expire. Many assume they can simply extend or stay informally — this is a criminal offence in Austria. The Rot-Weiß-Rot-Karte and other long-stay permits require applications submitted while your current legal status is valid.
⚡ Criminal record. Deportation. Entry ban of 1–5 years. Jeopardises all future EU residence applications.
📅 Deadline: Apply for residence permit well before 90 days expire
✅ Book your appointment at MA 35 (Vienna) or your regional Bezirkshauptmannschaft immediately on arrival. Processing takes 8–12 weeks — do not delay.
Missing the 14-day dismissal-challenge deadline
In Austria, if you receive a dismissal (Kündigung or Entlassung), you have only 14 calendar days to file an Anfechtungsklage at the Arbeitsgericht. This deadline is considerably shorter than in Germany (21 days) and catches many expats off guard. Miss it and the dismissal becomes final — regardless of how unjust it was.
⚡ Dismissal becomes legally final. No compensation claim. Cannot reclaim your job.
📅 Deadline: 14 calendar days from receipt of written dismissal
✅ Contact the Arbeiterkammer (AK) free legal advice line or a Rechtsanwalt specialising in Arbeitsrecht immediately. AK provides free legal representation for members. Keep all dismissal correspondence.
Assuming Austria allows dual citizenship
Austria has one of the strictest dual citizenship prohibitions in the EU. Acquiring Austrian citizenship (Staatsbürgerschaft) automatically requires you to renounce your other citizenship(s). Equally, if you naturalise in another country while holding Austrian citizenship, Austria will revoke your Austrian passport — usually without notice, creating a stateless period.
⚡ Loss of Austrian citizenship. Potential statelessness if other citizenship was also relinquished. Criminal penalties in some cases.
✅ Never naturalise in another country without understanding Austrian law. Limited exceptions exist (e.g., Holocaust victim restitution under §58c StbG, EWR citizens applying for professional reasons). Consult a Rechtsanwalt für Staatsbürgerschaftsrecht before any naturalization steps.
Driving on Austrian motorways without a Vignette
All Austrian motorways and expressways (Autobahnen and Schnellstraßen) require a valid Vignette (toll sticker). ASFINAG uses camera-based electronic enforcement — a missing Vignette is detected automatically within minutes of entering the motorway, even on foreign-registered vehicles.
⚡ Spot fine of up to €120 (discounted from €240 enforcement rate) if caught. Foreign plates are not exempt.
✅ Buy the annual Vignette (€106.80 in 2026) or a 10-day version (€12.80) at any petrol station, ASFINAG toll points, post offices, or at shop.asfinag.at before entering the motorway. From 2027 only the digital e-vignette (plate-linked) will be available — 2026 is the final year for the adhesive sticker.
Fake apartment listings on willhaben / ImmobilienScout24
Vienna's tight rental market breeds scammers who post beautiful flats at below-market rent, claim to be abroad, and demand a "deposit" via bank transfer, PayPal Friends&Family, or crypto before a viewing. Once paid, they disappear.
⚡ Loss of €1,000–5,000. Identity theft risk if you sent passport copies.
✅ Never pay any deposit before viewing the property in person and verifying the landlord's identity. Legitimate landlords do not ask for payment before a Besichtigung. Use Immobilienscout24 or willhaben with "Verifizierter Anbieter" badges. Report scams to Polizei (133).
Not registering your dog (Hundesteuer + Wiener Tierhaltegesetz)
Every dog kept in Vienna must be registered with the MA 60 (Veterinäramt) and annual Hundesteuer paid (€72/year for the first dog). In most other Austrian states, registration is at the Gemeinde. Unregistered dogs are detected by inspectors and fines are significant. Listenhunde (restricted breeds) also require special permits.
⚡ Fine up to €3,600. Back-tax payments. Possible confiscation of the dog if restrictions apply.
📅 Deadline: Within 2 weeks of arrival with your dog
✅ Register immediately at MA 60 (Vienna) or your Gemeindeamt. Listenhunde require a Hundehalterprüfung and muzzle/leash rules in public. All dogs need microchip and liability insurance (Hundehaftpflicht).
Pension contribution refund misunderstanding for non-EU citizens leaving Austria
Non-EU citizens leaving Austria permanently can apply for a Beitragserstattung (pension refund) — but only after a 24-month waiting period, and only the employee share (10.25% of salary) is returned. The employer share (12.55%) is never refunded. EU/EEA, Swiss, and totalization agreement citizens (US, Canada, Australia, India, Japan, etc.) are NOT eligible for any refund.
⚡ Loss of thousands of euros in expected pension refunds if eligibility is misunderstood. 24-month wait if you qualify.
📅 Deadline: Apply to PVA 24 months after permanently leaving Austria
✅ Check Austria's totalization agreements at sozialministerium.at before leaving. Keep all Austrian payslips. Apply via pva.at — provide proof of permanent departure, foreign IBAN, and SV-Nummer. Note: the refunded amount is subject to Austrian withholding tax.
Living in Austria without private liability insurance (Privathaftpflicht)
Privathaftpflichtversicherung is not legally mandatory in Austria but is considered essential. A single accident — breaking something at a friend's home, a bicycle collision, a child damaging a neighbour's property — can create unlimited personal liability for tens of thousands of euros.
⚡ Unlimited personal liability. A serious accident can bankrupt you. Many landlords require proof of Haftpflicht.
✅ Take out a combined Haushaltsversicherung + Haftpflicht for €80–150/year via Ergo, Uniqa, Wiener Städtische, or comparison sites like durchblicker.at. This is the highest-priority insurance item for every Austrian resident.
Driving with an unexchanged non-EU licence after 6 months
Non-EU driving licences must be exchanged at a Führerscheinbehörde within 6 months of gaining Austrian residency (Meldezettel). After this period, your original licence is no longer valid in Austria. Many drivers are unaware of this deadline and continue driving illegally.
⚡ Driving illegally. Fine and possible driving ban. Car insurance may be invalidated in an accident.
📅 Deadline: 6 months after Anmeldung/Meldezettel registration
✅ Apply for licence exchange at your local Führerscheinbehörde (MA 65 in Vienna, BH elsewhere). You need: valid identity document, current residence confirmation, eye test, medical certificate (for some licence classes), and your original licence. Allow 2–6 weeks processing time.
Missing administrative appeal deadlines (Bescheid)
When you receive an official Bescheid (administrative decision) from an Austrian authority — MA 35, BH, Finanzamt, ÖGK — you typically have only 4 weeks (Beschwerdefrist) to file a Beschwerde or Einspruch. Missing this deadline is almost always irreversible; the decision becomes final and legally binding.
⚡ Decision becomes final. Cannot challenge residency refusals, tax assessments, or benefit denials.
📅 Deadline: 4 weeks from delivery of the Bescheid
✅ Open and read every official letter immediately. Note the Bescheid date and count 4 weeks. Contact the Arbeiterkammer or a Rechtsanwalt specialising in Verwaltungsrecht or Fremdenrecht immediately if you need to appeal.
Moving in or out without an Übergabeprotokoll
Without a signed handover protocol with photos and meter readings documenting the flat's condition, a landlord can retain your entire Kaution (deposit, up to 3 months' rent) by blaming you for pre-existing damage.
⚡ Loss of full Kaution (€1,500–4,500 typical in Vienna).
✅ Insist on a written Übergabeprotokoll for both move-in and move-out. Photograph every room, every wall, all meter readings. Both parties sign. Keep a copy. If landlord refuses to sign, note this in writing (e-mail is sufficient).
Failing to register with AMS immediately after job loss
Austrian law requires you to register as a job seeker with AMS (Arbeitsmarktservice) immediately — ideally before your last working day. A delay reduces or eliminates Arbeitslosengeld (ALG) for the days you should have been registered. AMS also provides ÖGK health insurance coverage from day one of registration, which stops if you delay.
⚡ Loss of Arbeitslosengeld for each day of delay. Loss of health insurance coverage during unregistered period.
📅 Deadline: Register with AMS before or on your last working day
✅ Register at ams.at online or in person at your regional AMS office. Bring your Meldezettel, ID, and dismissal letter (if applicable). Registration and benefit application are separate processes — do both.
Forgetting the ORF Beitrag (broadcasting fee)
The ORF Beitrag (€15.30/month, €183.60/year per household) is a mandatory household fee for all Austrian residents, regardless of whether you own a TV or radio. It replaced the old GIS fee in 2024 and is now collected through tax authorities. Failure to pay leads to enforcement by the Abgabenbehörde.
⚡ Accumulated debt. Enforcement by Finanzamt. Possible surcharges.
📅 Deadline: Register and pay from the first month of residence
✅ Set up a direct debit (Lastschriftauftrag) at orf.at/beitrag. Low-income exemptions (Befreiung) are available — apply via ORF Beitrag Service with proof of benefits (Ausgleichszulage, Sozialhilfe, Studienbeihilfe).
Ignoring an official Mahnbescheid (court payment order)
A Mahnbescheid is a court-issued payment order delivered by post. In Austria you have 4 weeks (28 days) to file a Widerspruch (objection). Miss this deadline and the demand becomes an enforceable judgement — your bank account, salary, or property can be seized via Pfändung.
⚡ Enforceable judgement. Wage/account garnishment (Pfändung). KSV1870 credit damage for years.
📅 Deadline: 4 weeks (28 days) from delivery
✅ Open every letter immediately. A Widerspruch can be filed using the enclosed response form — no lawyer required for the objection itself. Contact the Arbeiterkammer or a Rechtsanwalt if the claim is disputed.
Betriebskosten annual reconciliation bill shock
Your annual Betriebskostenabrechnung (operating costs reconciliation from your landlord) can demand €400–1,500 if your monthly prepayments were insufficient or if energy prices rose. In Austria, tenants have only 6 months to dispute errors in the Betriebskostenabrechnung after receipt.
⚡ Surprise bill due within 30 days. Only 6 months to dispute errors.
✅ Keep a €1,000–1,500 buffer. Request the itemised Abrechnung from your landlord. The Arbeiterkammer (AK) provides free Betriebskostenprüfung — bring your Abrechnung and they will check it for free.
Not activating ID Austria (digital identity) before you need it
ID Austria (formerly Handy-Signatur) is Austria's digital identity system — required to use FinanzOnline, access official government portals (oesterreich.gv.at), sign contracts, and complete many digital official processes. It requires in-person activation at a registration point (bank, post office, Kundenzentrum) and cannot be done remotely.
⚡ Unable to file taxes online, access pension account, or use digital government services.
✅ Register for ID Austria at any Kundenzentrum, Erste Bank, Raiffeisen branch, or post office shortly after Meldezettel. Bring your Reisepass and phone number. Activation takes 10 minutes in person.
Breaking Hausordnung quiet hours (Ruhezeit)
Austrian apartment buildings (particularly in Vienna) have strict Hausordnung (building rules) with quiet hours: typically 22:00–06:00 and often 12:00–14:00 Mittagsruhe. Noise complaints can lead to Abmahnungen and ultimately lease termination by the landlord.
⚡ Written Abmahnung. Repeated violations can lead to lease termination under MRG §30.
✅ Read your Hausordnung on move-in day. Avoid loud music, drilling, and running washing machines after 22:00 or before 06:00. Warn guests. Check if Mittagsruhe applies in your building.
Self-employed persons face unexpected retroactive SVS contributions
When you register a Gewerbeschein (business licence) or become self-employed in Austria, SVS (Sozialversicherung der Selbständigen) automatically begins charging minimum advance contributions (~€160/month in 2026, based on a minimum contribution base of ~€551/month). In the second year, SVS retroactively adjusts based on your actual income — this often results in a large additional bill. New founders are surprised when the first-year "low" contributions are revised upward retroactively.
⚡ Unexpected retroactive SVS bill of €2,000–6,000+ in year 2 or 3 of self-employment.
✅ Set aside at least 25% of all self-employed income for SVS and tax. Use a Steuerberater from year one. Keep SVS informed of income estimates — voluntary advance payments reduce the retroactive shock.
A handwritten Austrian will does not automatically cover foreign-held assets
Under EU Succession Regulation (Brussels IV), the default law for Austrian residents is Austrian law. Austria has no inheritance tax, which is favourable. However, property or accounts in non-EU countries (UK, USA, Australia, Canada) require separate local probate. Expats without a will are subject to Austrian ABGB intestate succession — unmarried partners inherit nothing without a will.
⚡ Foreign assets frozen in probate. Unmarried partner receives nothing. Assets distributed against your wishes.
✅ Consult an Austrian Notar about a notarially certified will with explicit EU Succession Regulation election. Register it with the ÖZTR (Österreichisches Zentrales Testamentsregister) for €19. For cross-border assets, consult an internationaler Erbrechtsexperte.
Pets from outside the EU and Listenhunde in Vienna require specific permits and documentation
Pets from non-EU countries entering Austria require: ISO microchip, rabies vaccination, and (for listed third countries including USA, UK, and Australia) a Rabies Neutralising Antibody Test (RNATT) plus a 21-day wait before travel. Within Austria, Vienna has specific Listenhunde (restricted breed) rules under the Wiener Tierhaltegesetz: breeds including Pitbull Terrier, Rottweiler, Bullmastiff, and others require a Wiener Hundeführschein, psychological assessment, and mandatory liability insurance.
⚡ Non-EU pets without RNATT refused entry at border. Listenhunde in Vienna without required permits: fines up to €3,600 and mandatory breed assessment. Liability insurance claims may be refused if the dog is an unregistered Listenhund.
📅 Deadline: RNATT must be completed at least 21 days before travel — plan 3–4 months ahead for non-EU pets
✅ Contact AGES (ages.at) for current Austrian pet import rules for your pet's country of origin. For Listenhunde in Vienna: contact MA 60 (Veterinäramt) immediately. Take the Hundeführschein course (~2 days, ~€150) and obtain breed-specific Hundehaftpflicht insurance.
Kinderbetreuungsgeld has 5 models with very different payment amounts and durations — must be chosen within 91 days of birth
Austrian Kinderbetreuungsgeld (KBG) provides parental allowance after birth but must be applied for — it is not automatic. There are 5 models ranging from 365+92 days (€33.88/day flat rate) to 1,063+106 days (~€14.53/day). The income-based model pays 80% of prior net income up to €66/day. The choice of model must be made within 91 days of birth — switching afterwards is not possible. Both parents must divide leave to receive the bonus period.
⚡ Choosing the wrong KBG model: up to €10,000+ in missed benefit over the parental leave period. Failure to apply: no benefit paid. Missing the 91-day model election deadline: locked into the default model with no possibility of switching.
📅 Deadline: Apply at ÖGK within 91 days of birth; model election also within 91 days
✅ Use the KBG calculator at oesterreich.gv.at before birth to compare all 5 models based on your salary and planned leave duration. Apply at ÖGK immediately after registering the birth. If both partners will take leave, coordinate the split upfront — using both parents' allowances unlocks the 30-day bonus period.
Klimaticket Österreich is €1,400/year in 2026
The Klimaticket Österreich provides unlimited travel on all regional and urban public transport across Austria (ÖBB trains, city metros, trams, buses). The 2026 price is €1,400/year (Classic) or €1,050/year for those under 26, over 65, or with disability/civil service status. It does not require a permanent address and is available to all residents. Monthly equivalent: ~€117/month — typically cheaper than a car and parking.
⚡ None — informational.
✅ Buy at klimaticket.at, ÖBB ticket offices, or official sales points. No subscription lock-in — annual purchase. Consider the Wiener Linien Jahreskarte (€365/year) if you only travel within Vienna.
Familienbeihilfe is not paid automatically — you must apply
Austrian child benefit (Familienbeihilfe) pays €138.40–€200.40/month per child (depending on age: €138.40 from birth, €148.00 from age 3, €171.80 from age 10, €200.40 from age 19 — 2026 rates, frozen through 2027) plus a Kinderabsetzbetrag. It is not automatic for new arrivals — you must apply at your local Finanzamt (or online via FinanzOnline). EU/EEA families: eligible from the first day of residence and employment. Non-EU families: eligible after legal residence permit is granted. Backdated payments are limited to 5 years.
⚡ Missed monthly payments. Backdated claims limited to 5 years.
✅ Apply at your local Finanzamt or through FinanzOnline (finanzonline.bmf.gv.at) shortly after arrival. Required: Meldezettel, employment proof or permit, child's birth certificate, proof of schooling/kindergarten.
Check your Austrian pension account annually at pensionskonto.at
Every person who has worked in Austria has a Pensionskonto at the PVA showing accumulated pension entitlements. It is free to view at pensionskonto.at using ID Austria login. The annual Pensionskontomitteilung (statement) should be reviewed for errors — missing employment periods or incorrect wage recordings reduce your future pension and can be corrected, but old errors become harder to fix over time.
⚡ Unreported pension credit errors reduce your final pension permanently if not corrected.
✅ Log in to pensionskonto.at annually with your ID Austria. Compare the recorded employment periods and incomes against your own payslip records. Report discrepancies to PVA in writing within reasonable time.
Austrian minimum wage is set by Kollektivvertrag, not a single national rate
Unlike most EU countries, Austria has no single statutory minimum wage. Instead, minimum wages are set by sector-specific collective agreements (Kollektivverträge, KV). The general minimum across most KV agreements is ~€2,041/month gross in 2026, but some sectors (construction, retail, hospitality) have higher or lower rates. Your employer is legally bound by the KV for your industry — check your sector's KV at wko.at.
⚡ Potentially being underpaid without knowing it — some employers rely on employees not checking their sector's KV.
✅ Find your Kollektivvertrag at kollektivvertrag.at or wko.at. If your salary is below KV minimum, this is immediately legally actionable — contact the Arbeiterkammer for free advice.
Mietrechtsgesetz (MRG) gives strong tenant protections in pre-2002 buildings — know your rights
The Austrian Mietrechtsgesetz (MRG) provides rent caps (Richtwertmiete) and security of tenure for apartments in buildings constructed before 2002, particularly in Vienna. Under full MRG application, the landlord cannot evict you without specific legal grounds, and annual rent increases are limited. Landlords frequently attempt to avoid MRG by renting via GmbH structures, claiming "Dachbodenausbau" (attic conversion) status, or using "möbliert" (furnished) contracts — all worth checking before signing.
⚡ Paying above-MRG rents without realising you have legal recourse. Accepting illegal eviction or rent increases. Losing tenant protections due to incorrect contract wording.
✅ If your apartment is in a pre-2002 Vienna building, ask the Arbeiterkammer (AK) to review your rental contract before signing. The AK Mietrechtsabteilung provides free advice and will identify if MRG applies and whether your rent exceeds the Richtwert (€6.74/m² base calculation in Vienna for 2026 (from 1 April 2026)). Report excessive rents to the Schlichtungsstelle (Vienna rent arbitration board).
