Austria (AT)
Austria is a landlocked Central European republic of nine federal states (Bundesländer), renowned for its stunning Alpine landscapes, imperial history, world-class classical music, and high standard of living.
Family Rights & Benefits
Maternity, parental leave and child benefits in Austria.
Austria has a generous family support system with comprehensive maternity protection (Mutterschutzgesetz), flexible parental leave (Elternkarenz), multiple Kinderbetreuungsgeld (childcare benefit) models, and free healthcare through the Mutter-Kind-Pass programme. EU/EEA citizens with social insurance contributions receive full benefits from arrival. Non-EU citizens are generally entitled to benefits once employed with ÖGK coverage. The system is administered primarily through Finanzamt (for Familienbeihilfe), ÖGK (for maternity/parental leave payments), and the relevant employer (for Karenz/job protection).
Mutterschutz (Maternity Protection)
Before birth: 8 weeks before the expected birth date (or more if medical advice requires — high-risk pregnancies: longer). Salary is replaced 100% by Wochengeld from ÖGK.
After birth: 8 weeks after birth (12 weeks for multiple births, caesarean, or premature births). Wochengeld continues at 100% replacement.
Job protection: Absolute job protection during Mutterschutz (8 weeks before birth to 8 weeks after birth) — the employer cannot dismiss you and must hold your position. This protection extends through the entire Elternkarenz period and for 4 weeks after returning to work.
Elternkarenz (Parental Leave)
Max duration: Up to 24 months per parent (each parent can take up to 22 months; the final 2 months are only available if the other parent also takes at least 2 months — "Papamonat" incentive). Total family leave maximum: 24 months per child.
Split rules / Elterngeld: Either parent can take Elternkarenz. The parents can split it between them in up to 2 blocks per parent, with at least 3 months per block. The "Vaterkarenz" (paternity leave in the first 4 weeks, "Papamonat") gives fathers the right to 1 month of leave immediately after birth with job protection — not automatically income-replaced but some employers and the Familienbeihilfe provide support.
Benefits
Wochengeld (Maternity Allowance)
100% of the average daily net income of the last 3 months before Mutterschutzbeginn
Duration: Duration of Mutterschutz: 8 weeks before + 8 weeks after birth (longer in special cases)
Eligibility: Women insured with ÖGK for at least 3 months before Mutterschutz. Self-employed (SVS): entitled to Wochengeld from SVS.
How to apply: Apply to ÖGK (oegk.at) immediately on becoming pregnant — notify your employer and ÖGK. Application form available at ÖGK or your doctor.
Kinderbetreuungsgeld (Childcare Benefit — KBG)
€33.88/day (~€1,016/month) for the pauschales KBG (flat rate). "Einkommensabhängiges KBG" (income-based): 80% of net daily income up to max €66/day (~€1,980/month). Additional partner bonus (Familienzeitbonus for fathers taking "Papamonat").
Duration: Flat-rate KBG: choose from 4 models — 12+2 months (12 months one parent + 2 if partner takes at least 2 months), 15+3 months, 20+4 months, or 30+6 months. Longer models = lower daily rate. Income-based: up to 12+2 months. Must choose model before birth/return to work.
Eligibility: All parents with Austrian health insurance and residence in Austria. EU/EEA citizens: from arrival with ÖGK coverage. Non-EU: with valid residence permit and ÖGK coverage.

Familienbeihilfe (Family Allowance / Child Benefit)

Duration: From birth until age 18 (up to 24 if in education or training, or up to 25 for disabled children)
Eligibility: All parents legally resident in Austria (EU/EEA citizens with Austrian residence; non-EU citizens with valid permits). Must be the primary caregiver. Child must live with you in Austria.

Familienbeihilfe replaces the German "Kindergeld" concept. Austria additionally pays a Kinderabsetzbetrag (€58.40/month 2026) automatically with Familienbeihilfe — you do not need to apply for it separately.
Schulstartgeld (School Starting Allowance)
€100/year per school-age child
Duration: Annual payment in September
Eligibility: All Familienbeihilfe recipients with children aged 6–15
How to apply: Paid automatically with Familienbeihilfe in September — no separate application needed.

Eligibility: Fathers/second parents who take the "Papamonat" (1 month unpaid job-protected leave) within first 91 days of child's birth.
How to apply: Apply to ÖGK within 91 days of birth. Employer must grant the Papamonat leave but does not pay salary — the €700 bonus comes from ÖGK.
Kindergartengeld (Childcare Support Vienna)
Varies by income — Vienna subsidises Kindergarten fees heavily
Duration: Duration of childcare
Eligibility: Vienna residents using municipal or subsidised private Kindergarten
How to apply: Automatic for Gemeinde Wien Kindergarten (kinder.wien.gv.at). For private providers: apply via MA 10.
Sick child leave
Employees can take paid leave to care for a sick child under 12 (Pflegefreistellung) for up to 1 week per year per employment relationship (2 weeks if the usual caregiver is also ill). Additional Sonderbetreuungszeit (special childcare leave) may be available for emergencies. Extended care: unpaid Pflegekarenz available for up to 3 months for care of seriously ill close relatives.
Birth registration
Births must be registered at the Standesamt (registry office) in the district where the birth occurred, within 1 week of birth. Parents must present passports, Meldezettel, and hospital birth documentation. The Standesamt issues the official birth certificate (Geburtsurkunde). For unmarried parents: paternity acknowledgement (Vaterschaftsanerkennung) done at Standesamt or Jugendamt.
Childcare rights
All children aged 5–6 (Kindergartenpflichtjahr — the year before school) must attend Kindergarten in Austria. This is a compulsory attendance year. Children 3–5 have a right to a Kindergarten place in most Bundesländer. Children under 3: no universal right to a Krippe place but Vienna and most major cities offer sufficient places. The Mutter-Kind-Pass (Mother-Child Passport) programme schedules mandatory health check-ups from birth to age 5 — failure to complete reduces KBG payments.
