Family rights in Bosnia and Herzegovina are governed by entity Family Laws (Porodični zakon FBiH and Porodični zakon RS) and Labour Laws. Both entities provide maternity and parental leave tied to social insurance, with 12 months of paid leave as the standard. Benefits are administered by cantonal health funds (FBiH) or the RS Health Insurance Fund. Child benefits (dječji doplatak) are means-tested and modest but available to legally resident expats. Employed foreign nationals with valid work permits and health insurance contributions are entitled to the same family rights as Bosnian nationals.
Porodiljsko odsustvo (Maternity Leave)
Before birth: 28 days before the expected due date — obligatory pre-natal leave.
After birth: Minimum 42 days after birth (obligatory). Total duration including pre-birth period is 12 months (365 days) in both FBiH and RS. Extended to 18 months for multiple births or children with disabilities.
Job protection: Full job protection during the entire maternity/parental leave period. Dismissal during maternity leave is unlawful. Return to the same or equivalent position is guaranteed. Protection begins from the moment pregnancy is reported to the employer.
Roditeljsko odsustvo (Parental Leave)
Max duration: After the obligatory maternity period (42 days), one parent can take extended parental leave to bring the total to 12 months from the date of birth. FBiH allows extension to 18 months for multiple births or children with serious health conditions. RS has similar provisions. The leave is paid through the entity health fund at a rate based on the parent's average salary.
Split rules / Elterngeld: Either parent can take parental leave after the mandatory maternity period. In FBiH, the right to continued paid parental leave transfers to the father or co-parent if the mother returns to work early. Adoptive parents have the same parental leave rights as biological parents in both entities.
Benefits
Dječji doplatak (Child Benefit)
KM 30–80/month per child depending on canton in FBiH; approximately KM 25–50/month in RS
Duration: Paid monthly until the child reaches age 15 (or age 26 if in full-time education)
Eligibility: Means-tested — families below the applicable income threshold qualify. Legally resident expats with valid work permits and registered children are eligible to apply.
How to apply: Apply at the cantonal Social Welfare Centre (Centar za socijalni rad) in FBiH or the equivalent RS authority. Bring employment confirmation, income documentation, birth certificate and residence papers.
Child benefit amounts are low — a nominal supplement rather than meaningful income support. Most cantons in FBiH apply slightly different thresholds and amounts.
Naknada za porodiljsko odsustvo (Maternity Benefit)
100% of the employee's average salary for the first 12 months (FBiH); similar in RS
Duration: 12 months from birth (or 18 months for multiple births)
Eligibility: Employed persons registered with the cantonal health fund (FBiH) or RS fund. Must have contributed to health insurance for at least 12 months before the birth.
How to apply: Employer initiates the process with the cantonal Zavod zdravstvenog osiguranja (FBiH) or RS fund. Employee provides birth certificate and medical documentation. Benefit is paid directly to the employee.
Maternity benefit is paid at 100% of average salary from the health insurance fund — significantly more generous than many EU countries. The employer pays during the first 42 days then the health fund takes over.
Jednokratna novčana pomoć (Birth Grant)
KM 150–500 depending on canton/municipality
Duration: One-time payment at birth
Eligibility: Mothers resident in the relevant canton at the time of birth. Expat mothers with legal residence are generally eligible.
How to apply: Apply at the local Centar za socijalni rad within 3 months of birth. Bring birth certificate, residence proof and ID.
Amount varies significantly by canton in FBiH. Some cantons have suspended the benefit due to budget constraints — confirm availability in your canton of residence.
Sick child leave
Parents are entitled to paid leave to care for a sick child. In FBiH: up to 7 days per incident paid by the employer, with extended sick child leave covered by the cantonal health fund for serious illness. A doctor's certificate (ljekarsko uvjerenje / potvrda ljekara) is required. The health fund reimburses the employer for extended periods (beyond 7 days). RS has similar provisions through the RS Health Insurance Fund.
Birth registration
Register the birth at the Matičar (civil registrar) at the municipal authority (opština/opštinska uprava) within 30 days of birth. Bring: birth confirmation from the hospital (potvrda o porođaju), parents' identification documents, and marriage certificate if applicable. If parents are unmarried, the father must be present to register paternity. The birth certificate (izvod iz matičnih knjiga rođenih) is needed for all subsequent registrations including health insurance co-insurance, child benefit and school enrollment.
Childcare rights
Every child has access to municipal kindergartens (javne jaslice and vrtići) from age 1, subject to availability. Places are heavily oversubscribed in Sarajevo — apply 6–18 months before the desired start date at your municipal authority (opština). Monthly fees: public vrtić KM 100–250/month; private KM 300–600/month; international pre-school KM 700–1,200/month. QSI International School Sarajevo and the Sarajevo British School serve the expat community with English-medium education.
