Kenyan Citizenship by Registration (Spousal Route)
Eligibility
Foreign nationals who have been married to a Kenyan citizen for at least 7 years and have maintained continuous lawful residence in Kenya may apply for citizenship by registration under Section 15 of the Kenya Citizenship and Immigration Act 2011. This is a discretionary grant, not an automatic entitlement.

Citizenship by registration is at the Cabinet Secretary's discretion and is not automatically granted on meeting the criteria. Approval rates are inconsistent and legal representation is advisable. Processing time: 12–24+ months. Dual citizenship is permitted under the Constitution of Kenya 2010.
Other Routes to Residency & Citizenship
Naturalisation by Ordinary Residence
Eligibility
Foreign nationals who have resided lawfully and continuously in Kenya for at least 7 years may apply for citizenship by naturalisation under Section 16 of the Kenya Citizenship and Immigration Act 2011. Applicants must demonstrate good character, adequate knowledge of Swahili or a local language, and an intention to remain in Kenya.

Naturalisation by residence is distinct from the spousal registration route. Both require 7 years but the spousal path focuses on marriage duration whereas the ordinary naturalisation path focuses on lawful residence. Both are discretionary. Kenya allows dual citizenship so renunciation of prior nationality is not required.
EAC Common Market (Sectoral Work Rights)
Eligibility
Citizens of EAC partner states (Uganda, Tanzania, Rwanda, Burundi, South Sudan, DRC) benefit from sectoral labour-market access in Kenya under the EAC Common Market Protocol. This applies specifically to professionals, managers and technicians in defined sectors — it is not a blanket right to work without a permit.

Kenya introduced a dedicated Class R work permit for EAC nationals (effective December 2024) — Class R is free with no application or annual fees, joining Rwanda and Uganda in eliminating fees. Tanzania still charges USD 1,500. EAC citizens must still register for KRA PIN, banking KYC and comply with sector-specific licences. Check the EAC Secretariat (eac.int) for the current list of covered occupations before relying on this route.

Dual citizenship is allowed — Kenya allows dual citizenship under the Constitution of Kenya 2010 (Article 16). Kenyan citizens who acquire foreign nationality do not automatically lose their Kenyan citizenship. Foreign nationals who acquire Kenyan citizenship can retain their original nationality if their home country also allows dual citizenship. This is a significant change from pre-2010 law.
