🏛️ Social Contributions
Kenya's mandatory health insurance contribution introduced under the Social Health Insurance Act 2023, replacing NHIF from October 2023. Deducted directly from payroll. Covers SHA-registered public and private hospitals. Many expats supplement with private international health insurance. Minimum contribution: KES 300/month for informal workers.
Reformed NSSF contributions under NSSF Act 2013 (implementation contested but in effect 2024). Tier I: KES 480 employee + KES 480 employer on first KES 8,000 earnings. Tier II: 6% employee + 6% employer on earnings between KES 8,001 and the upper earning limit. Funds retirement pensions. Legal challenge led to delays — verify current deduction rates with your employer.
Affordable Housing Levy introduced in Finance Act 2023. Employee contributes 1.5% and employer matches 1.5% of gross salary. Collected by KRA through payroll. Funds the government affordable housing programme. Some challenge to its legality has been raised but it is currently enforced.
🛒 VAT Rates
Kenya's Value Added Tax (VAT) is 16% on most goods and services. Zero-rated items include most basic foodstuffs, exports, and medical supplies. Exempt items include financial services and educational services. VAT registration required for businesses with annual turnover above KES 5,000,000. The Finance Act 2023 introduced a digital service tax (DST) of 1.5% on digital marketplace revenues.

🌍 Special Expat Tax Rules
Kenya does not offer a formal expat tax regime or territorial tax system. All income earned in Kenya is subject to Kenyan income tax regardless of nationality. Tax residency is determined by physical presence (183+ days in Kenya in a tax year, or 122+ days in Kenya on average over 3 years). Expats on diplomatic assignments (UN, embassy staff) typically enjoy tax exemptions under their respective agreements. The personal relief of KES 28,800/year (KES 2,400/month) is available to all resident taxpayers. Non-residents pay withholding tax rates of 15–30% on Kenyan-source income. Expats from countries with DTAs may be eligible for relief — consult a Kenyan tax adviser.
📋 Double Tax Treaties
Kenya has double taxation agreements (DTAs) with approximately 20 countries including: UK, Germany, France, India, Canada, South Africa, UAE, Zambia, Tanzania, Uganda, Denmark, Norway, Sweden, Finland, Netherlands, Iran, and EAC partner states. The EAC Common Market Protocol also provides regional tax harmonisation. Check current DTA list on KRA website (kra.go.ke). Tax treaties may provide reduced withholding tax rates on dividends (5–15%), interest (10–15%), and royalties (10–15%).
