Family Rights & Benefits
Maternity, parental leave and child benefits in Luxembourg.
Luxembourg has comprehensive family rights and benefits, administered primarily through the Caisse pour l'Avenir des Enfants (CAE — formerly CNPF). Benefits are available to all residents of Luxembourg regardless of nationality, once commune-registered. Luxembourg's family benefits include generous child allowances (allocations familiales), free childcare subsidies (chèque-service accueil), and well-structured parental leave. The family law framework broadly follows the French civil code model with local adaptations. Same-sex couples in registered partnerships (partenariat) have equal family rights in Luxembourg.
Congé de maternité (maternity leave)
Before birth: 8 weeks before the expected delivery date (congé prénatal). This period is mandatory — the employer cannot ask you to work during this time.
After birth: 12 weeks after delivery (congé postnatal). Total maternity leave: 20 weeks. Full salary paid by CNS (Caisse Nationale de Santé) during maternity leave at 100% of the reference wage (up to the CNS ceiling — five times the social minimum wage, approximately €12,855/month gross in 2026). SECU affiliation required for the preceding 6 months to qualify for CNS maternity allowance.
Job protection: During maternity leave, dismissal is absolutely prohibited (protection against dismissal). The prohibition extends for 12 weeks after the end of maternity leave. Returning to the same position at the same salary is guaranteed.
Congé parental (parental leave)
Max duration: 6 months full-time per parent (or 12 months part-time), for a total of 12 months full-time per family. The leave can be taken in full-time, half-time, or part-time formats. Leave must be taken before the child's 6th birthday (12th birthday for adopted children).
Split rules / Elterngeld: Each parent is individually entitled to their own parental leave — it cannot be fully transferred to the other parent. Both parents can take parental leave simultaneously or consecutively. To encourage the sharing of parental responsibilities, Luxembourg provides a 6-month bonus parental leave if both parents take at least 1 month each. During parental leave, the CAE pays a parental leave benefit (indemnité de congé parental) based on salary.
Benefits
Child allowance (allocation familiale)
€299.86/month per child (flat rate, regardless of birth order, 2026). Plus: additional back-to-school allowance (allocation de rentrée scolaire) and age supplements.
Duration: From birth until age 18. Continued until age 27 if in full-time education or training.
Eligibility: All families resident in Luxembourg (or frontaliers with employment in Luxembourg) for each dependent child. No means test. No minimum income requirement. Applies regardless of nationality.
How to apply: Apply at CAE (Caisse pour l'Avenir des Enfants — cae.lu) within 6 months of birth or arrival in Luxembourg with a child. Forms available online via guichet.lu. Very straightforward process.
Luxembourg's flat-rate child allowance is generous and universal. Unlike some EU countries, it is not means-tested. The additional back-to-school allowance (allocation de rentrée scolaire) is paid annually in August for school-age children.
Birth allowance (prime de naissance / prime d'adoption)
€580.27 (2026) per new birth or adoption
Duration: One-time payment
Eligibility: All families with a newborn or adopted child resident in Luxembourg. SECU affiliation required for at least 6 months prior.
How to apply: Apply at CAE within 6 months of birth/adoption. Maternity ward at hospital typically provides the necessary forms.
Chèque-service accueil (childcare subsidy)
State pays the majority of approved childcare costs; parental contribution is income-tested — from nearly zero for minimum wage families to a maximum of approximately €3.50/hour for higher incomes.
Duration: From birth until end of primary school (age 12)
Eligibility: All children resident in Luxembourg using registered childcare providers (crèches, maisons relais, pre-school programmes).
How to apply: Automatic when you use a registered childcare provider. The provider invoices the CAE/MENJE directly. Register your childcare place at guichet.lu to activate the subsidy.
One of Luxembourg's most significant family supports — makes high-quality childcare accessible for all income levels. The subsidy is applied automatically to all registered childcare facilities and after-school provision.
Parental leave benefit (indemnité de congé parental)
Based on preceding salary from the 12 months before leave: minimum €2,570.93/month; maximum €4,284.88/month (2026 CAE official figures — = 5/3 of the social minimum wage, adjusted annually). Half-time parental leave: 50% of these amounts.
Duration: For the duration of parental leave taken (6 months full-time per parent maximum)
Eligibility: Parents who have been insured with SECU Luxembourg for at least 12 months preceding the leave.
How to apply: Apply at CAE 2 months before the planned start of parental leave. Employer must be notified of dates in advance.
Supplementary benefit for children with disabilities
Additional supplement of €213/month (2026) on top of standard child allowance
Duration: For the duration of the disability/dependency
Eligibility: Children with recognised physical or mental disability that requires care or supervision beyond normal child needs.
How to apply: Apply at CAE with medical documentation of the disability.
Sick child leave
Congé pour raisons familiales (family leave): parents of children under 15 (or older for disabled children) are entitled to take up to 12 days/year (per household, not per parent) of paid family leave to care for a sick child or to deal with urgent family matters. The employer pays the salary but is reimbursed by the CNS. A medical certificate from the child's doctor is required. Two parents may not be on paid family leave simultaneously for the same family reason.
Birth registration
All births in Luxembourg must be registered at the état civil (registry office) of the commune where the birth occurred within 5 days. For home births, registration is at the commune of the home address. Hospital births: the hospital administration typically assists with registration. Bring: parents' identity documents, marriage certificate (if married), and other relevant documents. The child receives a Luxembourg birth certificate (acte de naissance) which is needed for all subsequent administrative purposes. For children born to parents of different nationalities, the choice of the child's nationality may arise — consult your commune or a lawyer.
Childcare rights
All children resident in Luxembourg are entitled to access childcare (right to a childcare place guaranteed by law). The commune is obligated to ensure sufficient childcare provision. Wait times for crèche places can be long in Luxembourg City — register on multiple lists as early as possible (even before birth). The chèque-service accueil system means cost is not the barrier — place availability is the key challenge.
