Consumer protection in Nepal is governed by the Consumer Protection Act 2075 (2018) and enforced by the Department of Commerce, Supplies and Consumer Protection (DoCSCP) under the Ministry of Industry, Commerce and Supplies. District Consumer Forums handle local disputes. Practical enforcement is uneven, particularly outside Kathmandu Valley. Receipts, written contracts, photos and polite escalation are your most effective tools.
Right of withdrawal (Widerrufsrecht)
There is no EU-style universal 14-day withdrawal right for all purchases in Nepal. Shop return policies vary widely. For defective goods, you are entitled to repair, replacement or refund under the Consumer Protection Act 2075. Notify the seller in writing promptly after discovering the defect. Online platforms (Daraz) have their own return windows — check before purchasing.
Contract cancellation
Phone, internet, gym and rental contracts depend on written terms. Get cancellation rules in writing before signing. Cancel in writing and keep written confirmation. NTC and Ncell (telecoms) typically require prior written notice for plan changes.
Auto-renewal is less formally regulated than in Europe but schools, gyms and services may retain deposits or advance fees unless cancelled within the contractual notice period. Keep all cancellation receipts and confirmations.
Debt collection — response deadlines
Informal reminders: Creditors often call or contact via WhatsApp first. Respond promptly and keep records of all communications.
Court order: Formal debt recovery requires civil litigation in the District Court. The process is slow in Nepal. Arbitration clauses in business contracts may provide a faster alternative. Court judgments can be enforced through wage or account attachment.
Response deadline: Respond immediately in writing on receiving any formal legal notice. Ignoring court summons can result in ex parte decisions. Consult a local Nepali lawyer (advocate) for any significant dispute.
