Spain (ES)
Spain is a parliamentary constitutional monarchy of 17 autonomous communities stretching from the sun-scorched Andalusian coast to the Pyrenean peaks, renowned for its passionate flamenco and football culture, world-famous gastronomy from tapas to Michelin-starred restaurants, 300+ days of sunshine on the Costa del Sol and the Balearic Islands, and a relaxed Mediterranean pace of life that consistently ranks it among Europe's most desirable destinations for expats.
⚠️ Costly Mistakes to Avoid
The most expensive and common mistakes expats make in Spain — and exactly how to avoid them.
Forgetting to renew the padrón (non-EU: every 2 years)
Non-EU residents must renew their empadronamiento every 2 years. Permanent residents and EU citizens renew every 5 years. If you miss the renewal, the Ayuntamiento files a baja de oficio and you disappear from the municipal register — invalidating your NIE/TIE renewal, Tarjeta Sanitaria, and voter status.
⚡ Automatic deregistration. TIE renewal, school enrolment, Tarjeta Sanitaria validity and voter registration all blocked. Must re-empadronar from scratch.
📅 Deadline: Every 2 years (non-EU) or 5 years (EU/permanent)
✅ Mark the renewal date in your calendar the day you register. Most Ayuntamientos notify by post but letters get lost. Renewing is a 10-minute online procedure with digital certificate or Cl@ve.
Missing NIE/TIE renewal deadlines
TIE residence cards are issued with expiry dates. You must file the renewal (renovación) within 60 days BEFORE expiry (or 90 days AFTER expiry in limited cases with justification). Late renewal triggers interruption of legal status.
⚡ Irregular residence. Fines of €501–10,000. Lose progress toward permanent residence. Gap in Seguridad Social contributions.
📅 Deadline: 60 days before TIE expiry
✅ Book cita previa at extranjeria.interior.gob.es the day your reminder letter arrives — slots fill in minutes. Never let the card expire: renewal is easier than re-applying.
Missing Modelo 720 deadline for foreign assets over €50,000
Spanish tax residents with >€50,000 of foreign bank accounts, investments, or real estate must file Modelo 720 by 31 March each year. While the CJEU struck down the draconian 150% penalty in 2022, standard penalties of €100–200 per data item still apply, and Hacienda scrutiny of non-filers remains high.
⚡ Penalties of €100 per data item (min €600) for late filing; €200 per data item for non-filing. Scrutiny flagging.
📅 Deadline: 31 March each year
✅ Work with a gestor who files Modelo 720 for you (€150–400). Only declare once — re-file only when a category grows by >€20,000 or an asset is disposed of. Exempt if under Beckham regime (Modelo 151) or not a tax resident.
Missing the 6-month Beckham Law election window
To elect the Beckham Law special regime (24% flat tax on Spanish income, zero tax on foreign income for 6 years), you must submit Modelo 149 within 6 months of your Seguridad Social alta. Miss this window and you cannot retroactively opt in — you will be taxed under ordinary IRPF at progressive rates up to 47% on worldwide income.
⚡ Tens of thousands of euros per year in extra tax on foreign income (dividends, bond interest, rental, employment from abroad).
📅 Deadline: 6 months from Seguridad Social alta / arrival
✅ If eligible (no Spanish residency in previous 5 years, qualifying employment/directorship/digital nomad), submit Modelo 149 in your first month. Hire a cross-border tax adviser to confirm eligibility before moving.
Missing the Declaración de la Renta (IRPF) filing window
The annual IRPF campaign runs 1 April – 30 June. Late filing with a balance owed triggers recargo extemporáneo: 1% + 1% per month up to 15%, plus interest at 4.0625% annually. Refunds due to you are not paid until you file.
⚡ Recargo up to 15% + interest. Forfeiture of refund if unfiled for 4 years. Fines of 50–150% of undeclared tax if Hacienda discovers non-filing.
📅 Deadline: 30 June each year (direct debit refund filings: 25 June)
✅ Check the borrador at Renta Web from April 1. File by 25 June if a refund is due (ensures direct debit of payment). File by 30 June if payment is due. Split payment option (Modelo 102): 60% by 30 June, 40% by 5 November.
Missing IBI payment deadlines
Ibi (Impuesto sobre Bienes Inmuebles) is charged annually by your Ayuntamiento. Exact dates vary by municipality — typically April–October. Missing the voluntary-payment deadline triggers recargo de apremio: 5% within the following month, 10% thereafter, 20% once it enters ejecutiva (forced collection) plus interest. After 3 years of non-payment, the Ayuntamiento can embargo your bank account or auction the property.
⚡ Recargo 5–20% + interest. Bank embargo. In extreme cases: forced sale of property after 3+ years of non-payment.
📅 Deadline: Varies — check your Ayuntamiento calendar
✅ Set up domiciliación bancaria for IBI. Many Ayuntamientos (Madrid, Barcelona, Valencia) offer 3–5% early-payment discounts. Get your valor catastral reviewed if it looks inflated — this also affects basura and IRPF imputed income for non-rented second homes.
Driving with an expired ITV
Vehicles without a valid ITV (Inspección Técnica de Vehículos) are illegal to drive. New cars: first ITV at 4 years, then every 2 until 10, then annually. Mopeds from 5 years, every 2. Police random checks and automatic number-plate recognition detect expired ITVs instantly.
⚡ Fine €200 (with valid but expired), up to €500 (never passed). 4 demerit points. Car insurance voided in event of a claim. Vehicle impounded.
📅 Deadline: Varies by vehicle age
✅ ITV stations (Applus+, TÜV Rheinland, SGS) send email reminders. Book online at itvcita.com — inspection takes 30–45 minutes. Failures (~15% first-pass) have 2 months to rectify and re-test without re-paying.
Non-EU driving licence invalid after 6 months of residency
Non-EU driving licences from countries WITHOUT a bilateral exchange agreement (USA, Canada, Australia, China, India, most African countries) are valid for only 6 months from empadronamiento. After that you must pass Spanish theory + practical exams (€600–1,500, 3–6 months wait for slots). No exceptions — this trips up thousands of newcomers annually.
⚡ Driving becomes illegal — €200–500 fine, 4 demerit points, insurance void. The only legal path is to start autoescuela from scratch.
📅 Deadline: 6 months from empadronamiento
✅ Check DGT's bilateral exchange list BEFORE moving. If not listed, enrol in autoescuela in your first month. Some people pre-obtain an International Driving Permit (IDP) in their home country — this does NOT extend the 6-month limit for residents.
Gap between private and public health insurance
Non-EU residents who cancel private health insurance before becoming eligible for Tarjeta Sanitaria (via employment, autónomo, family, or convenio especial after 1-year padrón) face months without cover. Any illness or accident in the gap results in full-price private bills: A&E €150–500, ambulance €300, hospital stay €400–800/day, surgery thousands.
⚡ Full private medical bills. Denial of residence renewal if unable to prove continuous cover. Possible debt collection.
📅 Deadline: Continuous cover from arrival
✅ Keep private insurance active until the Tarjeta Sanitaria is physically in your hand. Digital Nomad Visa and non-lucrative visa holders MUST maintain private insurance — Seguridad Social is not an option for them.
Misunderstanding the Schengen 90/180 rule
Non-EU tourists can stay in the Schengen area for 90 days in any rolling 180-day period. Spain is a Schengen member — days spent in France, Italy, Germany, etc., count against this. Overstaying becomes a criminal immigration offence with entry bans of 1–5 years applying across ALL 27 Schengen states.
⚡ Entry ban 1–5 years across all Schengen. Complication for future work/residence visas. Fines at departure.
📅 Deadline: 90 days in any 180-day rolling window
✅ Use the Schengen calculator at schengenvisainfo.com/visa-calculator. Book a long-stay visa (Digital Nomad, non-lucrative, work) before arrival if planning >90 days. EES biometric entry-exit system (from Oct 2025) will track days automatically.
Fake rental listings on Idealista / Fotocasa / Milanuncios
Scammers post stunning flats at €400–600/month in Madrid and Barcelona (half market rate), claim to be "abroad", and demand a deposit via bank transfer, Western Union, Bizum or crypto before a viewing. Once paid, they disappear with your money and ID copies.
⚡ Loss of €1,000–3,000. Potential identity theft if you sent NIE/passport copies.
✅ NEVER pay before viewing in person. NEVER send money by Western Union, crypto, or Bizum to a stranger. Red flags: landlord "abroad for work", extreme urgency, "the keys are with my lawyer". Ask for a video tour AND an in-person viewing before any payment.
Owning a PPP dog without a licencia de tenencia
Potentially Dangerous Breeds (Rottweiler, Akita Inu, American Staffordshire Terrier, Pit Bull Terrier, Dogo Argentino, Fila Brasileiro, Tosa Inu, and others) require a licencia de tenencia de PPP from the Ayuntamiento. Requires clean criminal record, physical and psychological fitness certificates, and compulsory civil liability insurance (>€120,000 coverage).
⚡ Fines of €2,404–15,025. Removal of the dog. Criminal record for repeat offence.
✅ If adopting a PPP breed, apply for licencia BEFORE taking the dog home. Muzzle + short lead (<2m) in all public spaces is mandatory. Insurance ~€100–180/year.
Not declaring worldwide income after becoming tax resident
Once you pass 183 days in Spain (or your centre of economic interests is here), you are a Spanish tax resident and must declare WORLDWIDE income on Modelo 100 — not just Spanish income. Many newcomers declare only their Spanish job and hide rental income, dividends, or savings interest from abroad. Hacienda receives automatic data exchange (CRS) from 100+ countries.
⚡ Fines 50–150% of undeclared tax + interest. Criminal fraud charges above €120,000/year undeclared.
✅ From your first Spanish tax year, declare ALL global income. Use double-tax treaties and Modelo 100 Annex to claim relief for foreign tax paid. Work with a cross-border asesor fiscal — especially for US citizens (FATCA), UK pensioners, and rental property owners.
Non-residents forgetting Modelo 210 on Spanish property
Non-residents owning Spanish property (second home, rental property) must file Modelo 210 annually declaring either imputed income (1.1% of valor catastral × 19% for EU residents / 24% for non-EU) or actual rental income. Filing deadline: 31 December of the following year for imputed income; quarterly for rentals.
⚡ Recargo 5–20% + interest. Hacienda detects from property ownership records. Repeat non-filing: fines 50–150%.
📅 Deadline: 31 December for imputed income; quarterly for rental income
✅ Hire a gestor (€100–250/year) who handles Modelo 210 automatically. British, American and Irish non-residents are prime audit targets — Hacienda cross-references with FATCA/CRS.
Missing registered letters (notificaciones electrónicas) on DEHú
Hacienda, Seguridad Social, INSS and local councils are migrating to electronic notifications (DEH / DEHú). If you are registered, letters are served digitally with a 10-day acceptance window — after which they are legally deemed received even if unopened. Legal deadlines start running from that moment.
⚡ Missed objection deadlines. Default judgements. Enforced collection on your bank account.
📅 Deadline: 10 days from notification publication
✅ Check DEH at notificaciones.060.es and DEHú at dehu.redsara.es weekly. Set up email alerts. If you cannot commit to weekly checking, do not register for electronic notifications voluntarily.
Not filing baja de autónomo when stopping activity
When you stop freelance activity, you must file Modelo 037/036 (baja censal with Hacienda) AND baja RETA (TA.0521/2 with Seguridad Social). Miss either and you continue to be billed cuotas (€225–590/month) and expected to file quarterly IVA/IRPF returns. Many autónomos discover year-old debts at Hacienda data checks.
⚡ Accumulated Seguridad Social cuotas, surcharges, fines from Hacienda for unfiled Modelo 303/130. Debt can reach €5,000–15,000 within a year.
📅 Deadline: Within 30 days of stopping activity
✅ File baja immediately on both portals. Keep the resguardo. If you're pausing rather than stopping, the cuota is still due — or declare cese temporal (not available in RETA, only suspension of activity at Hacienda).
DANA flash floods can kill within hours — Mediterranean Spain residents must know the red alert protocol and never drive into floodwater
DANA (Depresión Aislada en Niveles Altos — an isolated cold air mass at high altitude) causes sudden, catastrophic flash flooding across Mediterranean Spain. The October 2024 Valencia DANA killed over 220 people in a single afternoon — making it Spain's worst natural disaster in decades. DANA events are a recurring seasonal risk affecting Valencia, Murcia, Alicante, Almería, Catalonia, and southern Andalucía — primarily September through November when the warm Mediterranean sea supercharges convective rainfall. A DANA can dump 200–500mm of rain in 4–8 hours, turning dry riverbeds (rambles and barrancos) and underground car parks into death traps within minutes. The October 2024 disaster killed most victims in their cars or underground garages — the storm drained into Valencia's urban drainage system faster than it could cope. The Spanish weather agency AEMET issues alert levels (amarillo/yellow, naranja/orange, rojo/red) by province, published on aemet.es and the AEMET app. Red alerts indicate extreme risk; when a rojo is issued for rain, schools, businesses, and non-essential transport should close immediately. The Valencian autonomous community also operates its own alert system (112 CV app and ES-Alert emergency SMS). Most deaths in 2024 occurred because people were caught in cars — the leading cause of death in European flash flood events.
⚡ Flash floods can arrive with little warning and fill underground car parks, underpasses, and valley roads in minutes. Vehicles are swept away in water that looks shallow but is fast-moving — 30cm of fast-moving water is enough to knock an adult off their feet; 60cm can carry a car. 220+ deaths in Valencia in October 2024 demonstrate the lethal potential of a major DANA event.
✅ Install the AEMET app and enable push notifications — configure alerts for the province where you live and work. Follow the 112 CV app if you live in the Valencian Community. Enable ES-Alert emergency SMS on your Spanish phone (automatic if your SIM is registered in Spain). On any naranja or rojo rain alert: do not drive, do not park in underground garages, do not walk near riverbeds, barrancos, or rambles. If caught in a car in rising water: abandon the car immediately and move to high ground — do not wait. Never attempt to drive through flooded roads — the depth is impossible to judge and currents are lethal. Store a Go Bag: torch, portable charger, water, first aid kit, and important documents in a waterproof bag. Know your home's flood risk by checking your municipality's PGOU flood zone maps and the Sistema Nacional de Cartografía de Zonas Inundables (SNCZI) at mapas.miteco.gob.es.
Assuming Convenio Especial covers you immediately
The Convenio Especial (voluntary Seguridad Social) requires at least 1 year of continuous empadronamiento BEFORE you can apply — you cannot activate it on arrival. Many newcomers discover this only when they try to get their Tarjeta Sanitaria, leaving them scrambling for private cover.
⚡ First 12 months without public healthcare access. Forced to pay for private insurance you thought was unnecessary.
✅ Budget for at least 1 year of private insurance from arrival (€60–150/month). After 1 year of padrón, apply for Convenio Especial via form TA.0040 at TGSS — costs €60/month under 65, €157/month over 65.
Autónomo cuota escalation after the €80 tarifa plana
The €80/month tarifa plana reducida lasts 12 months (extendable 12 more if earnings remain below SMI). Afterwards you jump to the income-based tramos: €225/month at low earnings, rising to €590/month for earnings over €6,000/month. Many first-time autónomos budget for the €80 rate and are shocked when it quadruples.
⚡ Monthly cuota can jump from €80 to €225–590 overnight. Backdated cuotas if you under-report income tramo.
✅ Forecast your real income honestly on the RETA alta form — Seguridad Social reconciles annually and will back-charge if your declared tramo was too low. Set aside 25–30% of invoiced income for cuota + IRPF + IVA combined.
Paid "NIE booking" scam websites
Third-party websites charge €50–150 to "secure" a cita previa for NIE, TIE or Empadronamiento. The Spanish cita previa system is 100% free at sede.administracion.gob.es and extranjeria.interior.gob.es. These sites scrape the free portal, re-sell the slot, or simply take your money.
⚡ Wasted €50–150. Delayed appointment. Loss of personal data.
✅ Only use the official sites: sede.administracionespublicas.gob.es, icp.administracionelectronica.gob.es, and your Ayuntamiento's official .gob.es / .es domain. Try the free portal at 8:00 and 20:00 — new slots are released throughout the day.
Phishing SMS / emails impersonating Agencia Tributaria
Fraudulent SMS and emails impersonating "Hacienda", "Agencia Tributaria" or "AEAT" demand urgent tax payment via a link. Hacienda NEVER communicates tax debts via SMS/email and NEVER requests payment at an unofficial URL. The real tax agency uses registered post (burofax) or the official portal.
⚡ Bank details stolen. Thousands of euros drained. Identity theft. Cards blocked for weeks during investigation.
✅ Never click links in unsolicited "Hacienda" messages. Check your tax status only at agenciatributaria.gob.es. Report phishing to INCIBE at incibe.es or call 017 (Spain's cybersecurity hotline).
Landlord fails to lodge fianza with IVIMA/INCASOL/AVS
By law (LAU + autonomous regulations), the landlord must lodge your fianza (1 month rent) with the regional housing agency within 30 days. In 40%+ of private contracts this is skipped. Without lodgement, the tenant has far less protection and recovery of the deposit at the end can be difficult.
⚡ Difficulty recovering deposit at lease end. Landlord loses some eviction rights but tenant still suffers.
✅ Insist on a copy of the resguardo de depósito within 30 days of signing. Verify with the agency (IVIMA — Madrid, INCASOL — Catalonia, AVS — Valencia, AVRA — Andalucía). If not lodged, report to the agency and the autonomous consumer protection office.
Living in Spain without responsabilidad civil insurance
Unlike Germany, private liability insurance is not culturally expected in Spain, yet a single accident (flooding the flat below, a bicycle incident, a dog bite) can cost tens of thousands in damages. Many seguro de hogar policies include responsabilidad civil — check yours.
⚡ Personal liability for damages. A water leak damaging the flat below can cost €3,000–20,000.
✅ Tenants: take out seguro de hogar para inquilinos with responsabilidad civil (€60–120/year). Dog owners: mandatory RC insurance for all dogs since the 2023 Ley de Bienestar Animal.
New Reglamento de Extranjería 2025: rule changes catch renewers off guard
The updated Reglamento de Extranjería (RD 1155/2024) entered force 20 May 2025. It simplified some procedures (arraigo reduced from 3 to 2 years, student work rights expanded to 30 hours, new arraigo por formación) BUT also tightened others (reduced financial thresholds for family reunion, stricter criminal record checks). Many renewers discover changed rules mid-procedure.
⚡ Unexpected rejection. Lost fees. Need to re-apply under different category.
✅ Review the current Reglamento at extranjeros.inclusion.gob.es before ANY renewal or first application. Pay for an immigration lawyer (€250–600) for complex cases — arraigo, family reunion, retired non-lucrative.
Missing the 25 June direct-debit deadline for tax payments
If you owe tax on your Declaración de la Renta and want to pay via direct debit (domiciliación), you must file by 25 June — not 30 June. Filings between 26 and 30 June with a balance owed require immediate card payment or NRC reference at a bank. Many filers discover this only on the last day.
⚡ Cannot use direct debit. Must pay by card or bank reference — sometimes impossible on Sunday 30 June.
📅 Deadline: 25 June for direct debit; 30 June for final filing
✅ File by 25 June if you owe tax. If you are due a refund, 30 June works fine.
Autónomos forgetting the Modelo 347 annual filing
Modelo 347 is the annual declaration of operations with third parties exceeding €3,005.06 (total per year per supplier/client). Filing deadline: 28 February for the previous year. Often forgotten because it is an informational filing with no tax to pay — but fines apply.
⚡ Fines €20 per incorrect/missing data item, min €300 up to €20,000.
📅 Deadline: 28 February each year
✅ Calendar it. Most accounting software (Holded, Quipu, Anfix) auto-generates Modelo 347 from your invoice database. Your gestor should handle it automatically if on a monthly package.
30-day notice period for cancelling mobile / fibre contracts
Spanish telecom contracts (Movistar, Vodafone, Orange, MásMóvil) require 30 days' notice to cancel. Even prepaid and "no-commitment" SIMs can be billed for another month after you think you've stopped. Companies are legally required to accept portability immediately, but "baja total" cancellation is another story.
⚡ Extra month's bill (€30–60). Debt collection if unpaid. ASNEF credit bureau listing.
📅 Deadline: 30 days notice before desired cancellation
✅ Give notice in writing via the operator portal or by burofax. Portability (portabilidad) to another operator automatically cancels the old contract — use this instead of calling to cancel.
Incorrect valor catastral inflating IBI, basura and IRPF
The valor catastral of your property determines IBI, basura (rubbish tax), and IRPF imputed income for second homes. Catastro data is often outdated — wrong surface area, missing improvements, old boundaries. Overvaluation costs hundreds of euros per year.
⚡ Overpayment of €100–500/year in IBI, basura, and IRPF imputed income.
✅ Check your nota catastral at sedecatastro.gob.es with your referencia catastral. File a Modelo 901N "subsanación de discrepancias" to correct errors. Appeals are free and often successful.
Hiring an unlicensed "gestor" or online-only tax service
In Spain, "gestor administrativo" is a regulated profession requiring membership of the Colegio de Gestores Administrativos. Many online tax services market themselves as gestores but are unregulated. If they make errors or commit fraud, you remain liable — Hacienda fines fall on the taxpayer, not the adviser.
⚡ Errors go unnoticed. Fines and interest accrue to YOU. No professional liability recourse.
✅ Verify registration at consejogeneral.org or your autonomous Colegio de Gestores. Asesores fiscales should be members of AEDAF or REAF. Tax Scouts, Entre Trámites, Balcells Group are reputable English-friendly options.
SL directors forgetting they must pay Autónomo Societario cuota
Directors of Spanish limited companies (SL) must pay into Autónomos Societarios even if the SL already pays them a salary. The 2026 minimum base is €1,000/month → ~€350/month cuota. This is separate from the employee Seguridad Social deducted from their payroll.
⚡ Backdated cuotas + 20% recargo. Blocked renewal of NIF company tax ID.
✅ At the moment of company formation, register the administrador as Autónomo Societario via Modelo TA.0521/1 within 30 days. Factor the €350/month into your company cash flow.
Certificado Digital FNMT expiring and locking you out
The FNMT digital certificate is valid for 4 years. Once expired, you lose access to all online Hacienda, Seguridad Social, Ayuntamiento and Extranjería services until you physically visit an office to re-verify identity. The 4-year mark often coincides with tax campaign deadlines.
⚡ Cannot file Modelo 100, 303, 130, or renew TIE online. Missed deadlines.
📅 Deadline: Every 4 years
✅ Renew online 60 days before expiry (self-service if certificate still valid). Use Cl@ve Permanente as a backup so you always have at least one working credential.
Not registering on VIES (ROI) for EU B2B sales
Autónomos and companies invoicing businesses in other EU countries must register on the Registro de Operadores Intracomunitarios (ROI) via Modelo 036. Without ROI, you must charge Spanish IVA 21% to EU clients instead of the reverse-charge (IVA autoliquidación). Spanish IVA on a cross-border B2B invoice can make your invoice unusable.
⚡ Clients refuse invoices. Must re-issue and refund IVA. Loss of contracts.
✅ Tick the ROI box on your Modelo 036 alta (or file a modification). Wait 1–3 months for approval. Verify your VAT number at ec.europa.eu/taxation_customs/vies.
Breaking community quiet hours (horas de descanso)
Most comunidades de propietarios establish quiet hours 23:00–08:00 daily and often 15:00–17:00. Construction noise, drilling, loud music, dog barking during these hours triggers Ayuntamiento fines and neighbour complaints via the presidente de la comunidad. Repeated violations can lead to legal eviction from rented property.
⚡ Fines €100–3,000 from Ayuntamiento. Written warnings from comunidad. Ultimate risk: eviction for breach of normas de convivencia.
✅ Read the estatutos de la comunidad and normas de régimen interior when moving in. Warn neighbours before parties. Schedule drilling/construction for 09:00–14:00 weekdays only.
Unpaid bills damaging your ASNEF / RAI credit record
Unpaid utility, mobile, bank or loan bills are reported to ASNEF (consumer) or RAI (corporate) — Spain's credit blacklists. One listing can block you from mortgages, phone contracts, rental deposit reductions, and some employment contracts for up to 6 years after debt resolution.
⚡ Mortgage denied. Contracts refused. Listing persists 6 years.
✅ Respond to every debt claim in writing — even disputed ones. Request your free annual ASNEF report at equifax.es to check for errors. Negotiate payment plans before listing. If listed wrongly, file AEPD complaint.
Major regional differences in ISD (inheritance tax)
Impuesto sobre Sucesiones y Donaciones (ISD) varies enormously between autonomous communities. In Madrid, Andalucía, Cantabria, Galicia — close relatives pay near zero. In Asturias, Valencia, Catalunya — 7–34%. Your autonomía of residence at death determines applicability, not the deceased's.
⚡ Unexpected tax bills of tens to hundreds of thousands of euros on inheritance.
✅ Get specialist estate planning if you have significant assets. Consider residence in tax-friendly autonomías for your last years. EU Succession Regulation election may help cross-border families.
Spanish will alone does not cover foreign-held assets
A Spanish testamento is valid for Spanish assets. For property, bank accounts, or investments in the UK, USA, Canada, Australia, or other non-EU countries, each jurisdiction applies its own probate rules. Under EU Regulation 650/2012 (Brussels IV), expats can elect their home country's succession law — but only in an explicit written declaration, ideally in a notarial will.
⚡ Probate delays. Double inheritance tax. Foreign assets distributed under local intestacy law instead of wishes.
✅ Consult a cross-border estate lawyer. Make an explicit EU Succession Regulation election. Consider parallel wills in each relevant jurisdiction — coordinated, not contradictory.
Anti-okupa security for empty second homes
Squatting (okupación) has become a high-profile issue in Spain, especially for empty second homes in Madrid, Catalonia and Andalucía. Once squatters are inside for >48 hours, legal eviction takes 6–24 months. The 2023 Ley de Vivienda added slightly faster remedies but problem persists.
⚡ Empty property occupied, 6–24 months legal eviction, ongoing costs of community + utilities during occupation.
✅ Empty properties: contract anti-okupa security (€30–80/month), install monitored alarm (Securitas, Prosegur, Movistar Prosegur Alarmas €35–50/month), have a neighbour/admin report unauthorised entry IMMEDIATELY. If under 48 hours, Policía Nacional can evict without court order.
Ley de Vivienda 2023: zona tensionada rules differ city-to-city
Ley 12/2023 de Vivienda created stressed-zone (zona de mercado residencial tensionado) designations where rent increases between tenants are capped by an index set by INE and the Ministry of Housing. Only certain communities have designated zones so far (Catalonia, Basque Country, parts of Navarra). Elsewhere, old LAU rules apply with IRAV caps (~2.2% for 2026).
⚡ Different rules apply to your contract depending on where you live. Tenants may miss rent-cap protections they are entitled to.
✅ Check whether your municipality has declared zona tensionada on the Ministerio de Vivienda website. In stressed zones: agency fees must be paid by landlord; new-tenant rent cannot exceed the reference index; large landlords (>5 properties) have tighter caps.
Assuming supermarkets are open on Sundays
Most supermarkets, shops and department stores are closed or have restricted hours on Sundays and public holidays under each autonomous community's horario comercial law. Madrid and tourist zones (Málaga, Palma, Tenerife, Valencia old town) are exceptions with many Sunday openings. Small cities and most towns: everything shut except a few petrol stations and 24-hour pharmacies.
⚡ No groceries on Sunday in most of Spain. Must rely on expensive convenience stores or petrol station shops.
✅ Stock up on Saturday afternoon. In Madrid, many El Corte Inglés, Carrefour and Alcampo branches open Sundays. Outside Madrid, check your local Ayuntamiento's calendario de aperturas.
Missing oposiciones exam deadlines for public-sector jobs
Spanish public-sector jobs (funcionario) are won via oposiciones — competitive public exams announced in BOE with strict registration windows (typically 15–20 working days) and non-extensible exam dates. Many opposers miss the announcement in BOE and lose the chance for a year.
⚡ Missed exam cycle. Wait 1–2 years for the next call.
✅ Subscribe to BOE alerts. Use platforms like Opositor.com, Adams Oposiciones, Academia Preparadores for automated notifications. Foreigners: most oposiciones require Spanish (and sometimes autonomous language) fluency + EU nationality.
Paying full price for prescriptions without Tarjeta Sanitaria
With Tarjeta Sanitaria, prescription copay is 10–60% of price (capped monthly for pensioners and chronic patients). WITHOUT TSI, you pay 100% — a €50 monthly medication becomes €150–200. Many newcomers delay getting TSI not realising the ongoing cost.
⚡ Pay full price for prescriptions until TSI arrives. Can cost hundreds per month for chronic conditions.
✅ Prioritise TSI in your first month. Pensioners and IMV recipients get free medications. Patients on specific chronic-disease lists (diabetes, cancer) also get 10% max copay.
Large-family (Familia Numerosa) benefits left unclaimed
3+ children qualifies you for the Título de Familia Numerosa, offering 5–50% discounts on transport, museums, electricity (bono social), college tuition, IBI and IRPF deductions. Many eligible families never apply because the process is autonomous-community-level and poorly publicised.
⚡ Missed savings of €500–3,000/year.
✅ Apply at your autonomous community's Dirección General de la Familia. Requires Libro de Familia and registration. Title valid 2–4 years, renewable.
Landlord, bank or employer demanding excessive personal data
Under Spanish GDPR + Ley Orgánica 3/2018, landlords cannot demand banking statements or nóminas before a viewing; employers cannot request criminal records for unrelated positions. Many newcomers hand over everything without knowing their rights.
⚡ Personal data misused. Identity theft risk. Weaker negotiating position.
✅ Decline unreasonable data requests. Report abuses to AEPD (aepd.es). You can black-out account numbers on bank statements before sharing. Landlords must destroy applicant data after tenant selection.
Wrong IRPF retention rate on autónomo invoices
Autónomos invoicing Spanish companies apply IRPF retention: 15% standard, 7% for the first 2 years of activity. The client withholds and pays Hacienda on your behalf. Using the wrong rate results in Hacienda reconciliation errors — either owing tax at year-end or claiming a larger refund.
⚡ Surprise Modelo 100 balance (positive or negative). Cash flow shock.
✅ On facturas to Spanish companies, apply 7% in years 1–2, then 15%. Always include the retention line clearly. Do NOT apply retention on invoices to private individuals or foreign clients — it doesn't apply.
2026 SMI: €1,184/month × 14 payments (€16,576/year)
The Salario Mínimo Interprofesional for 2026 is €1,184 gross/month (14 payments: 12 monthly + 2 pagas extraordinarias) = €16,576/year or €39.47/day. Employers paying below this face fines of €7,501–225,018 per worker. All contracts must be automatically upgraded — your payslip should reflect the new rate from January.

✅ Check your January 2026 nómina. If you're paid by the hour: gross minimum is ~€8.20/hour. Domestic workers and interns are included since 2023. Report underpayment to Inspección de Trabajo.
2026 IVA rates: 21% / 10% / 4% (superreducido restored)
Standard IVA in 2026: 21% general, 10% reducido (hospitality, transport, hotels), 4% superreducido (bread, milk, fruit, vegetables, medicines, books). The 2023 temporary 0% on basic foods ended 31 December 2024 and is NOT in force in 2026. Electricity and gas returned to 21% from 1 January 2025.

2026 tarifa plana for first-year autónomos: €80/month
First-year autónomos and those coming back after 2+ years pay a reduced flat rate of €80/month in 2026 for the first 12 months, regardless of income. This can be extended another 12 months if net earnings stay below SMI. From month 13+ (or 25+), income-based tramos apply (€225–590/month).

✅ Tick the "tarifa plana reducida" option on your RETA alta. First-time autónomos or those not registered in RETA for the previous 2 years qualify.
2026 IRPF brackets and autonomous surcharges
State IRPF 2026: 9.5% up to €12,450, 12% to €20,200, 15% to €35,200, 18.5% to €60,000, 22.5% to €300,000, 24.5% above. Autonomous communities apply their own tramos on top (Madrid is lowest, Catalonia and Valencia highest). Total marginal rate reaches 45–54% in top brackets.

✅ Use agenciatributaria.gob.es/Simulador to estimate your net. Compare autonomías before choosing where to settle — a Madrid vs Catalonia move can mean €2,000–5,000/year difference at €60,000 gross income.
Mandatory Plan de Pensiones de Empleo enrolment (2026)
Since 2024–2025, companies with collective agreements must offer a Plan de Pensiones de Empleo (PPE). Contributions are tax-deductible up to €8,500/year (on top of the €1,500 individual cap). Many employees are auto-enrolled without realising.
⚡ None — informational.
✅ Check your payslip for PPE deductions. Employer-matched contributions are free money — don't opt out without reviewing the convenio colectivo. Low-cost index plans (VidaCaixa, MyInvestor Empleo) outperform traditional guaranteed-return plans.
Complementos por maternidad/paternidad in pension calculation missed
Fathers and mothers with children born/adopted after 1 January 2016 receive a pension supplement: €35.90/month per child (2026), paid for life after retirement. Often overlooked during pension application — INSS processes it only if you actively request it.
⚡ Missed lifetime pension supplement of €400–1,700/year per child.
✅ At retirement application, explicitly request "complemento por reducción de brecha de género" on Modelo 006. Apply for arrears up to 4 years backdated if already retired and missed it.
Assuming everything closes for siesta
The traditional 14:00–17:00 shop closure is largely gone in city centres of Madrid, Barcelona, Valencia and Málaga. Supermarkets, chains and major retailers open continuously. Small local shops (panadería, carnicería, ferretería), especially in small towns and Andalucía, DO still close 14:00–17:00 and reopen until 20:30.
⚡ Minor inconvenience. Plan errands around local hours.
✅ Check individual shop hours on Google Maps. Banks are only open 08:30–14:00 Mon–Fri (never afternoons, never Saturdays in most branches). Pharmacies rotate with farmacia de guardia 24-hour service.
