Family Rights & Benefits
Maternity, parental leave and child benefits in Spain.
Spain offers solid family protections: equal 16-week paid parental leave for each parent (one of the most progressive in Europe since Ley 6/2019), strong job protection during pregnancy and early parenthood, universal subsidised Escuela Infantil from age 0–3 in many regions and free from 3–6. Child benefits are means-tested, but IRPF child deductions and the 2024 Ley de Familias add significant support. Plan your 16 weeks strategically — you lose unused weeks after the child turns 12 months.
Permiso por Nacimiento y Cuidado de Menor (Birth Parent)
Before birth: No mandatory pre-birth leave. Up to 4 weeks of the 16-week permiso can be taken before birth. Pregnant workers with medical risk-of-pregnancy certificate move to riesgo durante el embarazo benefit at 100% of base reguladora.
After birth: First 6 weeks IMMEDIATELY after birth are MANDATORY, continuous, full-time — cannot return to work, cannot be split. Remaining 10 weeks can be taken flexibly (full or part-time, continuous or split) at any time until the child turns 12 months, with 15 days' notice to employer.
Job protection: Kündigungsverbot equivalent: Dismissal during pregnancy, maternity leave, or the first 12 months after birth is automatically null and void (despido nulo) unless employer proves unrelated objective cause (ET art. 55.5). Reinstatement + back-pay is automatic if dismissed.
Permiso por Nacimiento y Cuidado de Menor (Equal for Both Parents)
Max duration: 16 weeks per parent, NON-transferable between parents (Ley 6/2019 full equality since 1 Jan 2021). Paid by INSS at 100% of base reguladora (no income cap, no €1,800 ceiling unlike Germany). Must have 180 days of contribution in last 7 years (under 26: 90 days in last 7 years).
Split rules / Elterngeld: First 6 weeks: MANDATORY full-time continuous after birth, cannot be shared or split. Remaining 10 weeks each parent: flexible — full or part-time, split into chunks, until child is 12 months. Unused weeks LOST at 12 months. Both parents can stay home simultaneously (total 12 weeks of shared time). Additional Excedencia por cuidado de hijo available up to 3 years unpaid but with job reservation (first year guaranteed, years 2–3 preferential).
Benefits
Ingreso Mínimo Vital con Complemento de Ayuda a la Infancia (CAPI)
€115/month age 0–3, €80/month age 3–6, €57/month age 6–18
Duration: While eligible
Eligibility: Low-income households receiving IMV or below certain thresholds. Families in vulnerability situations.
How to apply: Seguridad Social (imv.seg-social.es) or via CAUEO. Automatic review every year.
Replaced the old prestación por hijo a cargo. Not universal — households earning above thresholds get nothing. Thresholds 2026: approx €10,000 single + €5,000 per extra member.
Deducción por Maternidad (IRPF)
Up to €1,200/year per child under 3
Duration: Until child turns 3
Eligibility: Working mothers (employed or autónoma) with children under 3.
How to apply: Request advance monthly (€100/month) via Modelo 140 at agenciatributaria.gob.es, OR claim lump sum in annual IRPF.
Extended 2024 to include non-working mothers receiving unemployment + those with minimum contribution requirement. Plus up to €1,000 extra for daycare (gastos de custodia en guardería).
Prestación por Nacimiento y Cuidado de Menor
100% of base reguladora (salary-based, no cap)
Duration: 16 weeks per parent
Eligibility: Min 180 days contribution in last 7 years (lower if under 26).
How to apply: INSS online with certificado digital / Cl@ve within 15 days of birth. Company provides certificate of contribution. sede.seg-social.gob.es.
Deducción por Familia Numerosa
€1,200/year (3 kids), €2,400/year (4+ kids, categoría especial)
Duration: While status valid
Eligibility: Families with 3+ children (or 2 if one disabled), holding Título de Familia Numerosa from your CCAA.
How to apply: Request Título de Familia Numerosa from Comunidad Autónoma. Apply IRPF deduction via Modelo 143 (monthly advance) or annual IRPF.
Also benefits: 5–50% transport discounts, reduced museum/cultural fees, priority in schooling.
Bono Guardería (0–3 años)
Up to €1,000/year extra IRPF deduction for daycare
Duration: Until child enters free public education (age 3)
Eligibility: Working mothers using authorised Escuela Infantil 0–3. Some CCAAs add regional top-ups.
How to apply: Daycare provides NIF + invoices; declared in annual IRPF Modelo 100.
Excedencia por cuidado de hijo
Unpaid but counts for retirement (first year fully, years 2–3 at 100% during first year, 60% second, 60% third)
Duration: Up to 3 years per child
Eligibility: Any parent with ongoing employment contract.
How to apply: Written notice to employer. Job reservation in full for the first year.
Reducción de jornada por cuidado de hijo
Salary reduced pro-rata (protected from dismissal)
Duration: Until child turns 12
Eligibility: Parent of child under 12. Reduction between 1/8 and 1/2 of working day.
How to apply: Written notice to employer. Protected from dismissal during + after. Employer must respect schedule.
Sick child leave
No specific per-parent-per-year statutory paid sick-child leave allowance. Permiso retribuido de 2 days (4 if requiring travel) under ET art. 37.3.b for "accidente o enfermedad grave, hospitalización o intervención quirúrgica sin hospitalización que precise reposo domiciliario" of children/spouse — paid by employer. For children with CANCER or serious illness: CUME (Cuidado de Menores con Enfermedad Grave) — up to 100% of reduced salary during up to 50% jornada reduction while child has the disease, paid by INSS. Ley de Familias 2024 added 8 weeks unpaid parental leave (transposition of EU directive 2019/1158) in addition to the 16-week permiso.
Birth registration
Register the birth at the Registro Civil within 8 days (extendable to 30 with reason). Many hospitals have Registro Civil staff on-site — you can register immediately before discharge. Bring parents' DNI/NIE/TIE + Libro de Familia (if already have) or marriage certificate. Hospital issues cuestionario para la declaración de nacimiento. The Certificado Literal de Nacimiento is then required for empadronar the baby, getting TSI (health card), requesting Prestación por Nacimiento from INSS, and getting DNI/passport.
Childcare rights
Education is free and compulsory from age 6–16 (ESO). Age 3–6 (Segundo ciclo Infantil): universal and free in public schools in all CCAAs, enrolment competitive for schools outside your zona. Age 0–3 (Primer ciclo Infantil): mixed public/private, fees income-scaled in public schools. FREE 0–3 in: Comunidad Valenciana, Andalucía (3rd year), País Vasco, Madrid (1st year free for all since 2024). Apply via CCAA platform (e.g. escolar.org in Madrid, web.gencat.cat/preinscripcio in Catalonia) Feb–Apr for September start. Long waitlists in big cities — register early. Right to a place from age 3 is universal in practice, but specific school not guaranteed.
