A highly centralised Eastern European country with Soviet-era urban planning, low local costs, strong public transport, good basic infrastructure, sanctions-affected banking, strict migration registration and a complex risk profile for foreign residents.
Employment Rights
Sick leave, dismissal protection and red flags in Belarus.
Belarus employment law is governed by the Labour Code of the Republic of Belarus (Трудовой кодекс Республики Беларусь, TC RB). Key 2026 baselines: minimum wage BYN 858/month (from January 1, 2026, +18.2% from BYN 726 in 2025); 24 calendar days minimum annual leave; 40-hour standard workweek. IMPORTANT GEOPOLITICAL CONTEXT: Belarus is under extensive international sanctions (EU, US, UK) following the disputed 2020 election and Belarus's role in the Russia-Ukraine war. The practical consequence for expats: most Western companies have withdrawn, banking access for foreigners is severely limited (EU/US cards blocked at ATMs), and Belarus is listed by the US and EU as a sanctions jurisdiction requiring compliance precautions. Very few Western expats work in Belarus as of 2026; those who do are typically employed by Russian companies, local Belarusian entities, or international organisations. Work permits: required for foreign nationals (except Russian citizens who can work freely under Union State rules). Contract-system employment (контракт, срочный трудовой договор) is widespread in Belarus — fixed-term contracts of 1–5 years are common even for permanent roles, and employers have greater flexibility to terminate on contract expiry.
Sick leave
Rules: Official medical certificate (листок нетрудоспособности) from a licensed state polyclinic or licensed private doctor is required from day 1 of sick absence. The certificate is issued in paper or electronic form through the eHealth system. Employer pays sick pay based on the certificate. FSZN (Social Protection Fund) reimburses the employer. Entitlement: sick pay from the first day of illness.
Doctor note: Day 1 — employee must notify employer and visit a state polyclinic (поликлиника) or licensed private doctor on the first day of illness. Electronic or paper sick certificate (листок нетрудоспособности) required. Contact the doctor at the state polyclinic where you are registered (прикрепление).
Employer pay: Day 1: employer pays 80% of average daily earnings from its own funds. From day 7: FSZN Social Protection Fund reimburses. The % can vary by illness type and contribution years (some categories receive 100%). For work accidents and occupational illness: 100% from day 1. Sick pay is calculated on the average daily earnings for the 6 months preceding the illness.
Long-term: For long-term incapacity (beyond the sick pay period): medical-rehabilitation expert commission (MREC) assesses for disability group assignment. Disability pension through the FSZN Pension Fund. The level depends on disability group and contribution history. Foreign nationals with FSZN contributions are entitled to these benefits on the same basis as Belarusian citizens.
Dismissal protection
Law: TC RB Art. 42: employer-initiated dismissal requires a lawful ground including: liquidation, redundancy (with 2-month notice), unsatisfactory performance, systematic misconduct, gross misconduct, or contract expiry (under the contract system). Dismissal procedure: written notice; union consultation where applicable; opportunity for employee to respond. Under the contract system: employer can terminate at contract expiry without cause or compensation — this is a key feature of Belarusian employment that differs significantly from EU standards. Protected categories: pregnant women and women on maternity leave cannot be dismissed except on company liquidation. Wrongful dismissal: claim at the District Court; reinstatement and compensation available.
Deadline to sue: Reinstatement claim: within 1 month of dismissal (TC RB Art. 242). Wage arrears claims: within 3 years. File at the District Court (Районный суд) of the employer's location. IMPORTANT: under the current political and sanctions environment, access to Belarusian courts for foreign nationals may face practical obstacles. Seek legal advice from a Belarusian labour lawyer (Association of Lawyers of Belarus — bar.by) immediately on dismissal.
Probation
Probationary period (предварительное испытание): maximum 3 months for standard employees; maximum 1 month for workers/blue-collar. Must be stated in writing in the employment contract or order. During probation, either party can terminate with 3 days written notice. Most employment in Belarus uses a "contract system" (контрактная форма) — fixed-term contracts of 1–5 years with specific terms. Under the contract system, termination at contract expiry is generally lawful without compensation. Protected categories who cannot be on probation: pregnant women, single parents of children under 14, young workers in their first job after graduation.
Notice periods
Redundancy: 2 months advance written notice. Other grounds: as specified by TC RB for each ground. Employee resignation (по собственному желанию): 1 month notice. Contract system contracts: can specify different notice periods. Under the contract system, no advance notice is required for non-renewal at contract expiry — the contract simply ends on its expiry date.
Working time
Max hours: 40 hours per week (8 hours/day, 5-day week) standard under TC RB Art. 111. Overtime: maximum 10 hours per week; must be compensated at 1.5× for first 2 hours daily and 2× thereafter. Night work (22:00–06:00): minimum 1.2× premium. Some sectors (IT, export) have special regimes. Reduced working hours for certain protected categories (pregnant women, workers with disabilities, workers with children under 3).
Min rest: Minimum 2 rest days per week. Daily rest between shifts: 12 hours. Meal break: 20–30 minutes per shift. Public holidays: 10 official non-working holidays in 2026. Working on holidays: double pay or compensatory time off.
Overtime: Overtime must be documented in writing. First 2 overtime hours/day: 1.5× pay. Subsequent hours: 2×. Annual overtime maximum: 180 hours. Time off in lieu is permitted by agreement. Employer cannot systematically require overtime without proper authorisation and documentation.
Vacation
24 calendar days minimum paid annual leave per year under TC RB. Additional leave for hazardous work, irregular schedules, and some professional categories. Leave must be taken during the calendar year; deferral requires employee consent. Unused leave on termination: paid out at the daily rate. Under the contract system: some contracts specify that leave deferred at employer request is paid out on termination.
Anti-discrimination
TC RB prohibits employment discrimination based on sex, race, national origin, language, disability, religion, political opinion, family status, property status, trade union membership, and other grounds. Practical enforcement: the Prosecutor's Office and labour inspectors (Департамент государственной инспекции труда) can investigate complaints. For foreign nationals: practical access to remedy is limited by the political environment. Document all incidents in writing. Contract red flags
- !Fixed-term contract ("contract system" / контракт) used where a permanent role was expected — Belarus contract system allows non-renewal without cause; negotiate explicit conditions for renewal or conversion to permanent
- !Salary partly paid as cash ("grey salary" / серая зарплата) — reduces FSZN social insurance base, sick pay entitlements, and creates tax liability
- !Work begins before work permit is obtained (non-Russian foreign nationals) or before FSZN registration
- !Employer retains your passport — illegal under Belarusian law; provide only a certified copy
- !Net salary quoted without gross and FSZN deduction breakdown (employee FSZN contribution: 1% of gross)
- !Civil-law contract (гражданско-правовой договор) used to conceal an employment relationship — denies you TC RB protections
- !Non-compete or penalty clauses not reviewed by a Belarusian lawyer — these can be enforced under Belarusian law
- !Russian-language contract text differs from English offer letter — Belarusian/Russian text is legally controlling
- !Salary below BYN 858/month (minimum wage from January 1 2026, up from BYN 726 in 2025)
- !No FSZN registration confirmation — employer must register you with the Social Protection Fund; verify your FSZN personal account
