Consumer Rights

Right of withdrawal, contracts and debt collection in Czech Republic.

Czech consumer rights are based on Czech civil law (Nový občanský zákoník — NOZ, zákon č. 89/2012 Sb.) and fully implement EU consumer protection directives. Consumers have strong rights for online purchases, returns, warranties, and protection against unfair trading practices. The Czech Trade Inspection Authority (Česká obchodní inspekce — COI) enforces consumer protection law and handles complaints. The overall framework is EU-standard and well-enforced.

Right of withdrawal (Widerrufsrecht)

For online and distance selling: consumers have 14 days to withdraw from any contract without giving reasons (právo na odstoupení od smlouvy bez udání důvodu — §1829 NOZ). The 14-day period starts from the day of delivery. Merchants must provide a clear withdrawal notice and a model withdrawal form. Refund within 14 days of receiving withdrawal notice. Consumer pays return shipping unless seller advertised free returns. Exceptions: custom-made goods, perishables, digital content already delivered/accessed, sealed hygiene/health products once opened.

Contract cancellation

Záruční lhůta (warranty): 2 years for all consumer goods (§ 2161 NOZ). Seller is liable for defects that existed at the time of purchase. Consumer can claim: repair (oprava), replacement (výměna), price reduction (sleva), or refund (vrácení peněz). Defects appearing within 6 months are presumed to have existed at purchase. After 6 months: consumer must prove defect existed at purchase.

Automatic contract renewal (automatické prodloužení smlouvy): allowed but seller must clearly notify consumer of upcoming renewal at least 30 days before. Consumer must have clear and easy way to cancel. Contracts renewed automatically without clear notice are challengeable. Subscriptions: consumer must have an easy cancellation mechanism. App/online subscriptions must allow cancellation in the same way they were entered into.

Debt collection — response deadlines

Informal reminders: Informal payment reminders (upomínky/výzvy k platbě) — typically 3 stages. Seller may add contractual interest (smluvní úrok z prodlení: max prime rate + 8% per annum) and administration fees. Check your contract for the debt recovery clause.

Court order: Platební rozkaz (payment order): creditor can apply for a payment order at Obvodní soud (district court). Issued without hearing the debtor. Served to debtor's registered address.

Response deadline: 15 days from delivery of platební rozkaz to file odpor (objection). If objection filed, full court hearing follows. If no objection: platební rozkaz becomes an executory title (exekuční titul).

Once a platební rozkaz becomes enforceable, a soudní exekutor (court-appointed bailiff) can garnish wages, freeze bank accounts, seize assets, and register a lien on property. Do not ignore court correspondence. Czech law deems mail delivered after two failed delivery attempts — missing the 15-day deadline has serious consequences.
