Right of withdrawal, contracts and debt collection in Fiji.
Consumer protection in Fiji is governed by the Fijian Competition and Consumer Commission Act 2010 (FCCC Act) and enforced by the Fijian Competition and Consumer Commission (FCCC — fccc.gov.fj). The FCCC regulates fair trade, price controls on essential items, and investigates consumer complaints. The Consumer Council of Fiji (consumersfiji.org) is an independent advocacy body offering free advice and complaint assistance. Practical enforcement is improving but slower than in developed markets — documentation and persistence are essential. Keep receipts, written contracts, and WhatsApp/email correspondence for all significant transactions.
Right of withdrawal (Widerrufsrecht)
Fiji does not have a universal EU-style 14-day statutory withdrawal right for all purchases. Returns and refunds depend on the individual store or platform return policy and defect rights under the FCCC Act. For defective goods, the seller must repair, replace, or refund under the Act. Always confirm return policies in writing before purchasing expensive items — major retailers (MH, COURTS, RB Patel) have their own return windows, typically 7–14 days with receipt for unused items. E-commerce purchases from overseas platforms (Amazon, eBay) are governed by the seller's own terms and conditions.
Contract cancellation
Service contracts (telecom, gym, rental, school, resort club) are governed by the written contract terms — Fiji has no statutory minimum cooling-off period beyond the FCCC Act's unfair contract term protections. Telecom contracts (Vodafone Fiji, Digicel Fiji): cancel in writing with 30 days notice; prepaid plans simply lapse. Resort and timeshare clubs: read all cancellation, deposit, and force-majeure clauses carefully before signing. Cyclone and force-majeure clauses are common in Fijian resort and accommodation contracts — review these before committing. Rental agreements: governed by contract terms; 30 days written notice is the common practice. Get written confirmation of any cancellation.
Auto-renewal is common for insurance, gym memberships, internet contracts, and subscription services in Fiji. There is no statutory obligation for providers to send pre-renewal notifications. Diary all annual contract renewal dates 45–60 days in advance and give written cancellation notice before the renewal date. Request written confirmation of cancellation. For overseas subscription services (Netflix, Spotify, Microsoft 365), follow the international platform's cancellation procedure.
Debt collection — response deadlines
Informal reminders: Creditors typically contact by phone, letter, or WhatsApp. In Fiji's community-oriented culture, personal contact and negotiation are common before formal action. Respond promptly to any formal written demand and keep records of all communications.
Court order: Formal debt recovery requires court proceedings. The Small Claims Tribunal handles disputes up to FJ$5,000 without a lawyer — a quick and accessible process. For larger amounts, the Magistrates Court or High Court is used. A court judgment allows enforcement through wage garnishment or asset seizure via court bailiff.
Response deadline: Respond to formal court documents within the deadline stated (typically 21 days for Magistrates Court matters). Ignoring court documents results in a default judgment. Contact the Legal Aid Commission (legalaid.org.fj) for free advice if you receive court papers.
