Right of withdrawal, contracts and debt collection in India.
The Consumer Protection Act 2019 significantly modernised India's consumer rights framework. Consumers can file complaints online through the National Consumer Helpline (NCH) or Consumer Dispute Redressal Commission at district (up to ₹50 lakh), state (₹50 lakh–₹2 crore), or national level (above ₹2 crore) — thresholds set by notification of 30 December 2021 under CPA 2019. E-commerce companies must now have grievance officers and clear return/refund policies. The Act covers misleading advertisements, unfair trade practices, and defective products and services. Foreign nationals in India have the same consumer rights as Indian citizens — you can file a consumer complaint regardless of nationality.
Right of withdrawal (Widerrufsrecht)
India does not have a statutory "cooling-off" withdrawal right equivalent to EU Consumer Rights Directive. However, under the Consumer Protection (E-Commerce) Rules 2020, e-commerce platforms must disclose return policies, and many major platforms (Amazon India, Flipkart, Myntra) offer 7–30 day returns as company policy. Physical retail: no statutory right of return unless goods are defective. Always check the store's return policy before purchasing — it varies widely. High-end electronics and clothing stores often have 30-day exchange (not refund) policies.
Contract cancellation
Service contracts can be cancelled per the terms of the contract. Telecom (Jio, Airtel): cancel monthly plan anytime; prepaid recharges are non-refundable. Gyms and subscription services: cancellation per contract terms — India has no statutory minimum cancellation period for services. Insurance policies: free look period of 15 days (life insurance) or 30 days (health insurance) from receipt — you can return and get full refund. Banking: close accounts by following bank's closure procedure. OTT/streaming: cancel monthly subscription before next billing cycle. Airlines: DGCA (Directorate General of Civil Aviation) rules govern flight cancellations — full refund for cancelled flights, partial refund for voluntary changes depending on fare class.
Auto-renewal is common for subscription services in India (OTT platforms, cloud storage, gym memberships). The Consumer Protection (E-Commerce) Rules 2020 require e-commerce companies to clearly disclose terms including auto-renewal. However, enforcement is inconsistent. Best practice: set calendar reminders for subscription renewal dates. Indian Credit Card issuers now require explicit approval for each subscription charge (RBI's recurring transaction rules) — your card may be declined for subscription renewals unless you pre-authorise through your bank.
Debt collection — response deadlines
Informal reminders: Creditors can send payment reminders by post, email, or SMS. No harassment allowed. NBFC and bank collection agents are regulated by RBI guidelines — they cannot call before 8am or after 7pm, cannot use abusive language, and cannot contact your employer without permission.
Court order: If a consumer dispute reaches the consumer commission or civil court, a formal notice (legal demand notice) is sent first. Consumer commission orders are enforceable.
Response deadline: Consumer commission complaints: respond within 30–45 days typically. Formal legal notices: 15–30 days response window usually specified in notice.
