Family Rights & Benefits
Maternity, parental leave and child benefits in Ireland.
Ireland has a generous family benefits system rooted in the Child Benefit, Maternity Benefit, and a growing suite of parental leave entitlements. Key administering bodies: the Department of Social Protection (DSP) for most cash benefits, and Tusla (Child and Family Agency) for child welfare. Child Benefit is universal — paid regardless of income to all resident parents/guardians. Ireland has significantly expanded paid parental leave provisions in recent years following EU directive implementation.
Maternity Leave / Maternity Benefit
Before birth: 2 weeks minimum; maximum 16 weeks before expected birth. Most women take 4–6 weeks before birth.
After birth: 26 weeks minimum paid maternity leave. Additional 16 weeks unpaid maternity leave can follow. Total maximum: 42 weeks. First 26 weeks: Maternity Benefit from DSP (€289/week in 2026). Many employers top up Maternity Benefit to full salary — check your contract.
Job protection: Full job protection throughout maternity leave (paid and unpaid). Right to return to the same job (or equivalent if original is not available). Anti-victimisation provisions.
Parental Leave (unpaid)
Max duration: 26 weeks per parent per child (under 12). Unpaid but job-protected. Can be taken in blocks or more flexibly. Both parents have separate, non-transferable 26-week entitlements.
Split rules / Elterngeld: Each parent is independently entitled to 26 weeks of unpaid parental leave. It cannot be transferred between parents. Parental Leave is unpaid — distinct from paid Parent's Benefit below.
Benefits
Child Benefit
€140/month per child (2026 rate)
Duration: From birth until age 18 (or age 18 if in full-time education)
Eligibility: Universal — available to all children ordinarily resident in Ireland, regardless of parents' income. Both parents must be resident in Ireland or have a habitual residence connection. Apply within 6 months of birth (backdated to birth).
How to apply: Apply at MyWelfare.ie or in person at Intreo centre. Form CB1. Registration of birth at a civil registration office triggers an automatic notification to DSP in most cases.
Child Benefit is not means-tested — paid to all resident families equally. Twin bonus: 1.5x rate for twins; triplets receive 2x rate for each multiple. Payments continue as long as the child is in full-time education post-18 (up to age 18 strictly).
Maternity Benefit
€299/week (2026 — Budget 2026 increase from €289/week in 2025)
Duration: 26 weeks
Eligibility: Employed and self-employed women who have PRSI contributions (minimum 39 weeks paid in the last 12 months, or 39 weeks in the year before that). Applies regardless of nationality for PRSI contributors.
How to apply: Apply to DSP via MyWelfare.ie or by post at least 6 weeks before expected maternity leave (12 weeks for self-employed). Form MB1 for employees or MB2 for self-employed.
If your employer pays full salary during maternity leave, they typically receive the Maternity Benefit directly or it is paid to you and recouped by the employer. Confirm with HR before going on leave.
Paternity Benefit
€299/week (2026 — Budget 2026 increase from €289/week in 2025)
Duration: 2 weeks (10 consecutive days)
Eligibility: Relevant parent (father, non-birth parent in same-sex couple) who has PRSI contributions. Must be taken within 26 weeks of birth or adoption.
How to apply: Apply via MyWelfare.ie or Form PB1. Apply at least 4 weeks before intended start.
Must be taken within 26 weeks of the birth. Employer does not have to top up, but many do. The 2 weeks is separate from parental leave.
Parent's Benefit
€299/week (2026 — Budget 2026 increase from €289/week in 2025)
Duration: 9 weeks per parent (18 weeks total per family)
Eligibility: Each parent is entitled to 9 weeks of Parent's Benefit. Must be taken within 2 years of birth or adoption placement. Requires PRSI contributions.
How to apply: Apply via MyWelfare.ie. Can be taken in separate weeks or as a block.
Parent's Benefit was expanded from 7 to 9 weeks in 2024. Each parent has their own entitlement (cannot be transferred). Designed to encourage both parents to spend time with a new child.
Back to School Clothing and Footwear Allowance
€160 per child (aged 4–11); €285 per child (aged 12+)
Duration: Annual (paid in July/August)
Eligibility: Means-tested. Families receiving a qualifying social welfare payment or in receipt of certain benefits.
How to apply: Apply via MyWelfare.ie between June and September.
Helps low-income families with the cost of school uniforms and footwear. Applied annually.
Working Family Payment (WFP)
Varies based on income and family size — average €150–€350/week supplement
Duration: Ongoing while working and eligible
Eligibility: Families with at least one child where the parent/couple are in employment (minimum 38 hours per fortnight for one parent; 20 hours each for a couple). Income must be below prescribed limits based on family size.
How to apply: Apply via MyWelfare.ie or in person at Intreo. Form WFP1.
Formerly known as Family Income Supplement (FIS). Designed to make work financially attractive over welfare for low-wage workers with children. All children under 18 (or under 22 in full-time education) count.
Domiciliary Care Allowance
€340/month (2026)
Duration: Ongoing while eligible
Eligibility: Child with a severe disability requiring care and attention substantially in excess of that required by a child of the same age. Child must be ordinarily resident in Ireland and the disability must be likely to last at least one year.
How to apply: Apply via MyWelfare.ie or Department of Social Protection. Medical evidence required.
Also entitles the carer to a free travel pass and (with sufficient PRSI) Carer's Benefit. Additional supports available through HSE for children with disabilities.
National Childcare Scheme (NCS) subsidy
Income-based: from €1.40/hour to full-cost subsidy for lowest income families
Duration: While child is in eligible childcare (0–15 years)
Eligibility: All resident families with children in registered childcare are entitled to the universal NCS subsidy. Income-based supplement for lower-income families.
How to apply: Apply at ncs.gov.ie. Requires MyGovID verified account.
Significant expansion of the NCS scheme from 2022 onward has substantially reduced childcare costs for many families. The ECCE free pre-school scheme also provides 15 free hours/week for children in the eligible age range.
Sick child leave
Force Majeure Leave: up to 3 days per year (5 days in 3 consecutive years) for urgent family medical reasons — including a child being ill. Paid at full rate. Parental leave (unpaid, 26 weeks) can also be used for child illness. Some employers offer enhanced sick child provisions in their employment policies.
Birth registration
All births in Ireland must be registered with the General Register Office (GRO) within 3 months. Registration at the local civil registration office. Both parents' names can be on the birth certificate. Non-national parents should ensure the child's birth is registered in both Ireland and their home country for nationality purposes. Irish children born in Ireland from 1 January 2005 may qualify for Irish citizenship depending on parents' status.
Childcare rights
Childcare providers must be registered with Tusla (the Child and Family Agency). Childminders caring for more than 3 children must be registered. NCS subsidy is only available through Tusla-registered providers. Parents have the right to inspect Tusla inspection reports for childcare providers at tusla.ie.
