South Africa offers multiple permanent residence routes. Key routes: (1) Work-based: 5 years of continuous work permits in the same occupational category; (2) Critical Skills: applicants with 5+ years of post-qualification experience in a Critical Skills occupation may apply directly for PR without first accumulating years on a standard work permit; (3) Spousal/life partner of a South African citizen or PR holder — assessed case-by-case without a fixed minimum years requirement; (4) Business investment, retirement and qualifying relatives each have separate statutory eligibility criteria.

Processing can take many months or years — keep temporary status valid throughout. The White Paper on Immigration (2026) proposes introducing a points-based system that may change eligibility frameworks; this is not yet law. Naturalisation is discretionary — meeting the statutory requirements does not guarantee approval. Absences, expired permits and inconsistent records create problems. Processing can be slow at DHA. The White Paper (2026) proposes delinking PR from the citizenship pathway; this is not yet enacted — apply for PR before any policy change if citizenship is a goal.

Children born outside South Africa to at least one South African citizen parent may claim South African citizenship by descent. Registration requirements and rules vary depending on the date of birth and the parent's citizenship status.

Dual Citizenship (May 2025 Constitutional Court Reform)
Eligibility
South African citizens who wish to acquire foreign nationality no longer need prior retention permission from the Department of Home Affairs (DHA Form 1664) following a landmark Constitutional Court ruling in May 2025. The ruling declared the prior retention-permission requirement unconstitutional and deemed South Africans who previously lost citizenship for failing to obtain permission to have never lost it.

The May 2025 Constitutional Court ruling is retroactive — South Africans who were previously told they had lost citizenship by acquiring foreign nationality without permission should check whether their status has been restored. Naturalising foreigners as South African citizens: South Africa permits dual citizenship so no renunciation of prior nationality is required when becoming South African.

Foreign nationals who naturalise as South African citizens do not need to renounce their prior nationality under South African law.
