Maternity, parental leave and child benefits in South Africa.
Family rights combine labour-law leave, UIF benefits, constitutional equality, Children's Act protections, maintenance law and a mixed public/private childcare and school system.
Maternity leave
Before birth: Can start up to 4 weeks before expected birth, unless otherwise agreed or medically required.
After birth: Employee may not work for 6 weeks after birth unless medically certified fit. Total statutory maternity leave is at least 4 consecutive months.
Job protection: Dismissal for pregnancy, intended pregnancy or reasons related to pregnancy is automatically unfair.
Parental, adoption and commissioning parental leave
Max duration: Parental leave is currently 10 consecutive days for eligible non-birth parents; adoption/commissioning leave can be longer depending circumstances.
Split rules / Elterngeld: UIF parental/adoption/commissioning benefits have separate application rules. South African parental-leave law has been under constitutional litigation and reform pressure; check the current position before planning leave.

UIF maternity benefits
Sliding-scale UIF benefit, subject to contribution history and cap
Duration: Up to 17.32 weeks for maternity benefits
Eligibility: UIF contributors receiving less than normal pay during maternity leave
How to apply: Apply through uFiling or labour centre with UI-2.7, UI-2.8, UI-2.3 and medical/birth documents

UIF parental benefits
UIF benefit based on contribution and income replacement formula
Duration: Up to 10 days parental leave benefit under current framework
Eligibility: Eligible UIF contributor taking parental leave
How to apply: uFiling/labour centre with employer and birth/adoption documents
Child Support Grant
Means-tested monthly grant; amount updated by SASSA/Budget
Duration: Until qualifying child ages out if eligibility continues
Eligibility: Primarily South African citizens, permanent residents or refugees meeting means test and residency rules
How to apply: SASSA office/online where available
Most temporary expats will not qualify.
Care Dependency / Disability-related grants
Means-tested SASSA amounts updated annually
Duration: While qualifying criteria are met
Eligibility: Citizens/PRs/refugees and qualifying child/adult disability circumstances
How to apply: SASSA with medical assessment and documents
Sick child leave
No separate statutory paid sick-child leave entitlement under the Basic Conditions of Employment Act. Employees may use family responsibility leave: 3 days paid leave per annual cycle for qualifying events (including a sick child) if employed longer than 4 months and working at least 4 days/week.
Birth registration
Births in South Africa should be registered with Home Affairs within 30 days. Foreign parents need passports, visas, marriage/relationship documents where relevant and hospital birth notice.
Childcare rights
Access to childcare is market-based for most expat families. Public schools cannot unfairly exclude children, but capacity, catchment, documents and study/residence status matter.
