Renting in Uruguay

Uruguay's rental market is primarily managed through real estate agencies (inmobiliarias) and private platforms (InfoCasas, Gallito). Formal written contracts (contratos de arrendamiento) are standard. Most Montevideo leases are 24-month terms denominated in USD or UYU (sometimes indexed to IPC/inflation). A garantía de alquiler (rental guarantee) is almost always required — either a Uruguayan property-owning fiador (guarantor), a bank guarantee (fianza bancaria — requires depositing 5–6 months' rent with a bank), or a rental guarantee insurance policy (BSE, Porto Seguro, SURA, MAPFRE — the most accessible option for expats). The 2020 LUC (Ley de Urgente Consideración) reform created a streamlined "garantía-light" lease aimed at tenants without a local guarantor, typically backed by a larger deposit and clearer process. This requirement remains the primary barrier for newly arrived expats without local connections.

2. Before move-in

Handover protocol

Photograph every room, fixture, and appliance at key handover. Create a written inventory (inventario) signed by both parties — essential for deposit recovery. Note any existing damage, missing items, appliance condition, and meter readings. Send the photo documentation to the landlord by WhatsApp or email immediately so the timestamp is preserved.

Deposit

Max: 1–2 months' rent is standard in Uruguay. Some landlords request up to 3 months for furnished apartments.

Rules: Deposit (depósito de garantía) is paid upfront and held by the landlord (or inmobiliaria) for the duration of the tenancy. No interest is paid on the deposit. If damage-free, the full deposit must be returned within 30 days of the official handover (entrega de llaves).

Return deadline: 30 days from official key handover (entrega de llaves) under standard Uruguayan tenancy practice. No statutory deadline codified in law — written contract should specify.

Alternatives: BSE rental guarantee policy (garantía de alquiler) can replace the traditional deposit in some arrangements. Check with landlord and inmobiliaria.

3. During your tenancy

UTE / OSE utility billing

Frequency: Monthly (UTE electricity) and bi-monthly (OSE water)

Dispute window: 15 days from bill receipt to dispute at UTE (ute.com.uy/reclamos) or OSE

Watch for
  • - Landlord charging electricity above the official UTE rate (tariff fraud is illegal but occurs)
  • - No physical meter — estimate-based billing without sub-meter
  • - Utility accounts still in landlord's name after 60 days

Repairs: Major structural repairs (roof, plumbing, electrical systems) are the landlord's responsibility under Uruguayan law. Minor repairs and consumables (light bulbs, door knobs) are typically the tenant's responsibility as specified in the contract. Request all repairs in writing (WhatsApp is legally acceptable). Landlord must respond within a reasonable period — typically 30 days for non-emergency repairs.

4. Moving out

Notice period: 30 days written notice (notificación fehaciente) is standard for lease termination by tenant for fixed-term contracts that have expired. During a fixed term, early termination may trigger a penalty (comisión de desocupación) typically equivalent to 1–3 months' rent. Always give notice in writing — WhatsApp message timestamps are generally accepted but carta document notice is safer.

Final handover: Schedule an entrega de llaves (formal key handover) with landlord or inmobiliaria present. Final meter readings (UTE electricity, OSE water) must be taken and documented. Verify all items in the inventario are present and in the same condition as on arrival. Clean the property to "broom clean" (escoba limpia) standard — professional cleaning not always required unless specified in contract.

Deposit return: Deposit must be returned within 30 days of formal key handover (entrega de llaves). Landlord can deduct for documented damage beyond fair wear and tear, unpaid rent, or missing items from the inventario. Dispute any deductions in writing within 15 days. If landlord refuses return, MVOTMA (Ministerio de Vivienda) mediation or SICE (consumer protection) complaint can be filed.

Your tenant rights

Tenant association: FUCVAM (Federación Uruguaya de Cooperativas de Vivienda por Ayuda Mutua) and MVOT (Ministerio de Vivienda y Ordenamiento Territorial) oversee housing rights. Rent control: No formal rent control system in Uruguay as of 2026. Rents are freely negotiated. USD-denominated leases do not carry automatic inflation escalation. UYU leases are often IPC-indexed. Government has discussed rent control legislation but none enacted as of mid-2026.

Eviction protection: Tenants with valid contracts cannot be evicted without a court order (proceso de desalojo). Landlords cannot change locks or remove belongings without legal process. Eviction proceedings take 3–12 months in court. Tenant may negotiate directly with landlord to agree early departure with deposit return instead of pursuing eviction to completion.
