Right of withdrawal, contracts and debt collection in Kazakhstan.
Consumer protection in Kazakhstan is governed by the Law on Consumer Protection (Закон о защите прав потребителей, 2010, amended 2022). The main regulatory body is the Agency for Protection and Development of Competition (АЗРК). Consumer protections are in place but practical enforcement can be slower and more bureaucratic than Western Europe. Major retailers and Kaspi Marketplace generally have good informal return policies to maintain reputation. Court processes for small claims under ₸100,000 are simplified.
Right of withdrawal (Widerrufsrecht)
14 calendar days to return goods of acceptable quality (товары надлежащего качества) if unused, in original packaging, with tags attached — no reason required. For distance sales (online, phone orders), the same 14-day period applies from receipt. No right of withdrawal for: personalised items, intimate apparel, food, cosmetics (if packaging opened), medicines, software, and live animals. Defective goods (товары ненадлежащего качества): no time limit for returning — seller must repair within 45 days, replace, or provide a full refund. Present receipt and original packaging when returning; keep all documentation.
Contract cancellation
Service contracts (gym memberships, subscriptions, insurance) can be cancelled per the contract terms. For indefinite service contracts, 30 days written notice to the provider is the standard requirement unless the contract specifies differently. Mobile operators (Kcell, Beeline, Tele2) require in-person or app-based cancellation. Insurance cancellations must be requested in writing with the effective date specified. Auto-renewable contracts: the provider must notify you of the renewal date and terms at least 30 days before renewal — if they fail to do so, you can cancel without penalty.
Kazakhstan law requires service providers to notify consumers before auto-renewal of contracts. If you have not been notified, you may be entitled to cancel without penalty and claim a refund for the renewed period. Common in: fitness club memberships, internet contracts, insurance policies, and parking subscriptions. Notify providers in writing (email or certified letter) before the renewal date if you wish to cancel.
Debt collection — response deadlines
Informal reminders: Creditors typically send SMS, email, and written notices for overdue payments (просрочка). First reminder usually within 1–7 days of missed payment. Multiple reminders are standard practice before formal action. Kaspi Bank and other lenders send automated notifications immediately on missed payment dates.
Court order: Formal debt collection in Kazakhstan follows a court process. For debts under ₸100,000 (simplified procedure / упрощённое производство): court issues a payment order (судебный приказ) without a hearing. The debtor is notified by the court. Larger debts proceed through standard civil court proceedings. Enforcement of court orders is carried out by court bailiffs (судебные исполнители).
Response deadline: 10 calendar days to dispute a simplified court payment order (судебный приказ) after receipt. Failure to respond within 10 days may result in automatic enforcement against your bank accounts. If you dispute the debt, file a written objection with the court immediately.
Consumer protection authority
Agency for Protection and Development of Competition (АЗРК — Агентство по защите и развитию конкуренции): azrk.kz. File complaints online or by post. Handles: unfair trade practices, false advertising, product quality disputes, market monopoly abuses. Financial disputes: Financial Ombudsman (Финансовый омбудсмен): finombudsman.kz, handles disputes with banks and insurance companies up to ₸5,000,000. For banking disputes over the threshold: National Bank of Kazakhstan (nbrk.kz).
Consumer goods/service complaints: e-tutynushy.kz (new unified consumer complaints platform launched 2025) or azrk.kz — online complaint form. Financial institution disputes: finombudsman.kz. Internet fraud and phishing: Cybercrime Police at +7 7172 71 39 90 or via 102. Kaspi Bank fraud specifically: hotline 595 (24/7). For persistent landlord-tenant disputes: local akimat (city administration) housing department. Anti-corruption (bribery in government services): Anti-Corruption Agency hotline 1477 or ardc.gov.kz.
