Employment Rights
Sick leave, dismissal protection and red flags in Russia.
Russia employment law is governed by the Labour Code of the Russian Federation (Трудовой кодекс РФ — TK RF, 2001 as amended). Key 2026 baselines: federal minimum wage (MROT) RUB 27,093/month (from 1 January 2026, +20.7%, Federal Law No. 429-FZ — regional minimums may be higher); 28 calendar days minimum annual leave; 40-hour standard workweek. CRITICAL GEOPOLITICAL CONTEXT: Russia is under extensive international sanctions (EU, US, UK, Canada, Japan and others) following the February 2022 invasion of Ukraine. Consequences for expats: most Western companies have exited Russia; banking access for foreign nationals is severely restricted; SWIFT-connected international payments are blocked; many Western citizens face legal and reputational risks working in Russia under their home-country sanctions laws. Very few Western expats work in Russia as of 2026. Foreign nationals employed in Russia require a work permit (разрешение на работу) or, for Highly Qualified Specialists (HQS — ВКС), an HQS work permit (salary threshold: RUB 167,000/month for most; RUB 83,500/month for educators and researchers). Foreign workers from CIS/EAEU states (Belarus, Kazakhstan, Armenia, Kyrgyzstan) can work without permits. Social insurance: Unified Social Fund (SFRF/СФР) — employer pays approximately 30% of gross salary in social insurance contributions.
Sick leave
Rules: Official sick certificate (листок нетрудоспособности / электронный больничный) issued by a licensed Russian doctor is required from day 1. The electronic sick certificate (электронный больничный) is now mandatory for most employers (since 2022); paper certificates still accepted in some regions. Employer submits the certificate to the Social Fund of Russia (СФР) and pays the benefit.
Doctor note: Day 1 — visit a licensed polyclinic (поликлиника) or private clinic on the first day of illness. Electronic sick certificate submitted directly to the Social Fund by the medical institution. Employer receives notification automatically. Without a valid certificate, absence may be treated as unauthorised.
Employer pay: Days 1–3: employer pays from its own funds. From day 4: the Social Fund of Russia (СФР) pays directly to the employee (since 2021 direct payment reform). Rate: 60% of average earnings if less than 5 years of insurance contribution; 80% for 5–8 years; 100% for 8+ years. Maximum insurable earnings cap applies. Work accident: 100% from day 1 (via FSS mechanism).
Long-term: Sick leave has no annual time limit — continues as long as medically certified. After 4 months of continuous incapacity: disability assessment (МСЭ — медико-социальная экспертиза) may be triggered. Disability group assignment determines pension entitlement through СФР. Foreign HQS workers with Russian social insurance contributions have the same entitlement as Russian citizens.
Dismissal protection
Law: TK RF Art. 77–84: dismissal requires a lawful ground listed in the Labour Code. Lawful grounds: employee resignation (2 weeks notice); mutual agreement (soглашение сторон — most common for negotiated departures); redundancy (сокращение штата — 2 months notice + severance); unsatisfactory probation; systematic misconduct after warnings; gross misconduct (theft, intoxication, disclosure of trade secrets). Protected categories: pregnant women and women with children under 3 cannot be dismissed (except company liquidation). Wrongful dismissal: reinstatement and back pay, or damages.
Deadline to sue: TK RF Art. 392: reinstatement claim — within 1 month of receiving the dismissal order (приказ об увольнении). Wage arrears claims — within 1 year. File at the District Court (Районный суд) of the employer's location. The 1-month deadline is strict — do not wait. Under the current sanctions and conflict environment, practical access to courts for Western expats may be complicated by banking and travel restrictions.
Probation
Probationary period (испытательный срок): maximum 3 months for most employees; maximum 6 months for senior managers, chief accountants, and their deputies; maximum 2 weeks for contracts under 6 months. Must be stated in writing in the employment order (приказ) and contract. During probation: 3 calendar days notice from either party for termination. Protected categories who cannot be subject to probation: pregnant women, women with children under 1.5 years, workers under 18, new graduates entering first job within 1 year of graduation, disabled persons.
Notice periods
Employee resignation: 2 weeks notice (can be reduced by mutual agreement). Employer redundancy (сокращение): 2 months advance written notice + severance pay of 1 month's average earnings (extendable to 2–3 months if employment not found within 2 months). Mutual termination agreement (соглашение сторон): negotiated — most commonly used in Russia for smooth departures; can include any agreed compensation.
Working time
Max hours: 40 hours per week (8 hours/day, 5 days) standard under TK RF Art. 91. Reduced working hours for certain categories: workers under 16 (24h/week), workers under 18 (35h), disabled workers (35h for disability groups I–II). Overtime: maximum 4 hours over 2 consecutive days; 120 hours per year total. Night work (22:00–06:00): minimum 20% premium. For HQS workers on summarised working time (суммированный учёт): averaged over reference periods up to 1 year.
Min rest: Minimum 2 rest days per week. Daily rest between shifts: minimum 12 hours. Meal break: 30 minutes–2 hours (not working time unless employee cannot leave workplace). Public holidays: 14 official non-working holidays in Russia in 2026. Work on public holidays: double pay or a substitute day off (employee's choice).
Overtime: Overtime: first 2 overtime hours/day: 1.5× pay; subsequent hours: 2× pay. Total annual maximum: 120 hours. Employee consent required (except emergency situations). Time off in lieu is permitted. Document all overtime in writing.
Vacation
Minimum 28 calendar days paid annual leave per year under TK RF Art. 115. Additional leave for hazardous work, irregular schedules, and certain professional categories (medical workers, teachers, etc.). Leave may be taken in parts (first part at least 14 consecutive days). Unused leave is paid out on termination at the average daily earnings rate. Advance leave may be granted by agreement. Northern/Far Eastern regions: additional leave days (from 8 to 24 extra days per year depending on region and work conditions).
Anti-discrimination
TK RF Art. 3 and the Russian Constitution prohibit employment discrimination based on sex, race, nationality, language, origin, property status, position, place of residence, religious/political beliefs, trade union membership, and other grounds unrelated to professional qualities. Practical enforcement is limited. Report discrimination to the State Labour Inspection (Государственная инспекция труда — rostrud.gov.ru) or the Prosecutor's Office. For foreign nationals: formal rights exist but practical remedy under the current political environment is constrained.
Contract red flags
- !Civil-law contract (ГПХ — гражданско-правовой характер) used to conceal employment — denies TK RF protections; if you have a fixed schedule, report to one employer, and use employer tools, you are legally an employee
- !Salary partly or wholly paid as "grey" cash (серая зарплата) — reduces СФР social insurance base, sick pay, and pension accrual
- !Work begins before work permit is obtained (non-CIS/EAEU foreign nationals) or before migration registration (within 7 working days of arrival)
- !Salary below HQS threshold (RUB 167,000/month for most HQS categories; verify at mfc.rf) — HQS status invalided if salary falls below threshold
- !Salary below MROT (RUB 27,093/month from January 1 2026, Federal Law 429-FZ) for full-time employment
- !Employer retains your passport (заграничный паспорт) — illegal; provide only a certified copy
- !Russian-language contract text differs materially from English offer letter — Russian text is legally controlling in Russian courts
- !Unclear military/conscription or national security provisions — some roles carry obligations that may affect foreign nationals
- !No migration registration (migratsionny uchet) arranged by employer within 7 working days of arrival — employer is responsible for this
- !No clarity on sanctions compliance — if your home country has enacted sanctions against Russia or Russian entities, working for a sanctioned entity may expose you to personal legal liability in your home country
- !Banking and payroll — confirm how salary will be received; most international transfers are blocked; salary may only be payable through Russian banks with restricted international access
- !SWIFT/international payment restrictions — any arrangement requiring salary transfer outside Russia may not be practically feasible under current sanctions
