Right of withdrawal, contracts and debt collection in Slovakia.
Slovak consumer rights are governed by the Consumer Protection Act (Zákon o ochrane spotrebiteľa — Act No. 250/2007) and the Civil Code, with additional EU directives implemented into Slovak law. The Slovenská obchodná inšpekcia (SOI — Slovak Trade Inspectorate) is the main consumer protection enforcement body. Slovak consumers have strong statutory rights for product returns, warranty claims, and cancellation of distance contracts. EU consumer protection standards apply fully since Slovakia is an EU member.
Right of withdrawal (Widerrufsrecht)
EU-standard 14-day right of withdrawal (odstúpenie od zmluvy) for all distance contracts (online, telephone, door-to-door). The 14-day period starts from the day of physical delivery for goods, or from contract conclusion for services. No reason is required. The consumer must inform the seller in writing (email is sufficient). The seller must refund within 14 days of receiving the withdrawal notice. The consumer may be responsible for return shipping costs unless the seller failed to disclose this. The right does not apply to: personalised goods, perishables, digital content accessed immediately, accommodation/travel services.
Contract cancellation
Fixed-term service contracts (internet, mobile, gym) renew automatically in Slovakia if not cancelled before the expiry date. The minimum notice period for cancellation must be stated in the contract — typically 1–3 months before expiry. For indefinite (month-to-month) service contracts: 30 days's notice is typically required. Slovak law (Act 351/2011 on Electronic Communications) provides that consumers can cancel internet/mobile contracts for a substantial change in conditions within 30 days without penalty.
Automatic contract renewals (automatické predĺženie zmluvy) are valid if clearly stated in the original contract. Sellers must notify consumers of upcoming renewal within a reasonable time before the renewal date. If they fail to notify, the consumer can cancel even after renewal without penalty. Under EU Directive 2019/2161 (implemented in Slovakia), online platforms must be more transparent about auto-renewal terms. Check all contract terms carefully for auto-renewal clauses — mobile, internet, and insurance contracts frequently contain them.
Debt collection — response deadlines
Informal reminders: After a missed payment, creditors typically send informal payment reminders (upomienky). The first reminder is usually free; subsequent ones may carry a fee. Slovak law does not set a maximum number of informal reminders before formal action begins.
Court order: For recognised debts (acknowledged in writing or based on a contract), creditors can apply for a platobný rozkaz (payment order) — a simplified court procedure at the Okresný súd. If not disputed within 15 days, the order becomes enforceable. For disputed debts, a full civil court proceeding is required.
Response deadline: 15 days from receipt of a platobný rozkaz to file an odpor (objection) disputing the claim. If you receive a platobný rozkaz, respond within 15 days even if you believe the claim is unfounded — failing to respond means you have the debt enforced against you.

Handles complaints about: unfair commercial practices, product safety, price labelling, misleading advertising, warranty breaches, and distance selling violations.
