Right of withdrawal, contracts and debt collection in Ukraine.
Consumer protection in Ukraine is governed by the Law of Ukraine on Consumer Rights Protection (Закон України "Про захист прав споживачів", Law No. 1023-XII, as amended; current version reflects post-2022 wartime amendments). The State Service of Ukraine on Food Safety and Consumer Protection (Державна служба України з питань безпечності харчових продуктів та захисту споживачів, often abbreviated ДСГСКУ or informally "Consumer Protection Service") is the primary enforcement authority. In wartime conditions (since February 2022), enforcement capacity is reduced in conflict-affected regions, but operates normally in most government-controlled cities including Kyiv, Lviv, and other western regions. Keep all receipts, contracts, and digital evidence — practical consumer protection depends heavily on documentation.
Right of withdrawal (Widerrufsrecht)
Ukraine's Law on Consumer Rights Protection provides: (1) For distance sales (online, phone, catalogue — договір, укладений поза торговельними або офісними приміщеннями): a 14-day right of withdrawal (право на відмову) from the date of receipt of goods or contract conclusion for services — no reason required. The seller must process the refund within 7 days. (2) For in-store purchases: no statutory change-of-mind right — return rights for non-defective goods depend on seller policy. (3) Defective goods: within the warranty period, the consumer has the right to demand repair, replacement, price reduction, or refund. If the goods cannot be repaired within the warranty period or fail again after repair, the consumer may demand replacement or refund. Keep all receipts and packaging for warranty claims.
Contract cancellation
Telecom contracts (Kyivstar, Vodafone Ukraine, Lifecell): cancel postpaid plans in writing at the operator's service centre; number portability is regulated by NCCIR (National Commission for State Regulation of Communications). Gym and subscription services: cancellation per contract terms; Ukraine's consumer law prohibits clauses that entirely prevent cancellation for cause (health, relocation). Rental agreements: cancellation per written lease terms; typically 1–2 months written notice. Always obtain a written cancellation confirmation (письмове підтвердження скасування). Note: during wartime, many service contracts have force-majeure provisions — check your contract.
Auto-renewal clauses (автоматичне поновлення договору) are common in Ukrainian service contracts. The Law on Consumer Rights Protection requires that auto-renewal terms be clearly disclosed before signing. If renewal terms were not clearly disclosed, the consumer can challenge the renewal. Cancel in writing before the renewal date and keep written confirmation. Subscription services billed through Apple/Google Play or international platforms follow those platforms' cancellation rules.
Debt collection — response deadlines
Informal reminders: Creditors typically send SMS, app notifications, and written reminders before formal action. During wartime, some creditors have adjusted collection practices — banks have introduced temporary moratoriums for military personnel. Verify any debt notice comes from the actual creditor (not a phishing scam) and respond in writing.
Court order: Civil debt enforcement in Ukraine: creditor files with the district or city court (районний або міський суд); for amounts under UAH 250,000, simplified civil procedure (спрощене позовне провадження) applies. Court enforcement orders are executed by state enforcement officers (державні виконавці) or private enforcement officers (приватні виконавці). Enforcement can include bank account garnishment, wage garnishment (up to 20% of salary for most debts), and asset seizure. Note: military personnel have special protections against enforcement during service.
Response deadline: Upon receiving a court summons or enforcement notice: respond within the deadline stated in the documents — typically 15–30 days for civil proceedings. Ignoring a court summons can result in a decision in absentia (заочне рішення). Seek advice from a Ukrainian lawyer (адвокат) or contact the Free Legal Aid system (безоплатна правова допомога — legalaid.gov.ua) if you receive court papers.
Consumer protection authority
State Service of Ukraine on Food Safety and Consumer Protection (Державна служба України з питань безпечності харчових продуктів та захисту споживачів): the primary consumer protection authority; file complaints at consumer.gov.ua. National Bank of Ukraine (NBU — bank.gov.ua): financial services consumer protection, banking and payment disputes. National Commission for State Regulation of Electronic Communications, Radio Frequency Spectrum and Postal Services (NCCIR — nkrzi.gov.ua): telecoms and internet disputes.
Consumer complaints (defective goods, misleading advertising, unfair practices): State Consumer Protection Service at consumer.gov.ua. Banking and payment disputes: National Bank of Ukraine (bank.gov.ua) — NBU handles complaints about licensed banks and payment institutions. Telecoms and internet: NCCIR at nkrzi.gov.ua. Food safety: State Consumer Protection Service. Fraud and cybercrime: National Police cyber unit (cyberpolice.gov.ua or call 102). Free legal advice: legalaid.gov.ua (National Free Legal Aid System — available to all residents). Civil disputes: district/city court (with simplified procedure for small claims under UAH 250,000).
