Estate & Inheritance in Armenia
Wills, intestacy, inheritance tax, and cross-border estate planning for expats.
Armenian succession planning is essential for expats with property, bank accounts, businesses, or family in more than one country. A local will, foreign will, marital-property rules, and citizenship can interact in surprising ways.
Intestacy — What Happens Without a Will
Without a valid will, Armenian intestacy rules distribute assets to statutory heirs. Unmarried partners, stepchildren, and foreign family arrangements may not be treated as you expect.
Types of Valid Will
Notarial will
Նոտարական կտակWill signed through a notary, usually the safest local option for Armenian assets.
Strong evidentiary value if properly executed and registered/kept.
Recommended for property, business shares, mixed-nationality families, and non-Armenian speakers.
Private written will
Գրավոր կտակA privately written will may be possible but is easier to challenge if execution, language, capacity, or witnesses are disputed.
Depends on meeting Armenian legal formalities.
Do not rely on a home-country template for Armenian assets without legal review.
Forced Heirship
Protected-heir or mandatory-share concepts may affect freedom to leave everything to one person. Get advice if excluding spouses, children, disabled dependants, or parents.
EU Succession Regulation (Brussels IV)
Armenia is outside the EU Succession Regulation. EU-law elections may help with EU assets but do not automatically solve Armenian probate.
Inheritance Tax
Armenia does not have a formal inheritance tax system. Check with a local lawyer for current registration fees, notary costs, and any asset-specific transfer charges.
| Relationship | Tax-Free Allowance | Tax Rate (above allowance) |
|---|---|---|
| Close family | Check current exemptions and registration fees | Often favourable compared with distant/non-family transfers |
| Distant relatives and non-family heirs | Limited or none depending on asset and rule | Verify with notary/accountant before transfer |
Property registration fees, notary costs, foreign tax, and bank compliance can matter more than nominal inheritance tax.
Cross-Border & Multi-Country Estates
Use coordinated wills for Armenia and foreign jurisdictions. Tell heirs where documents, bank accounts, crypto keys, company records, and property extracts are stored.
Certificate of Inheritance
Heirs may need notarial/court succession documents before banks, cadastre, or companies release assets.
Will Registration
Ask a notary how your will is stored and how heirs will locate it.
Living Will & Healthcare Power of Attorney
Advance medical directives and powers of attorney should be reviewed by an Armenian lawyer if you want them relied on locally.
