Consumer Rights

Right of withdrawal, contracts and debt collection in Latvia.

Latvia's consumer protection framework is governed by the Consumer Rights Protection Law (Patērētāju tiesību aizsardzības likums) and implements all EU consumer protection directives. The Consumer Rights Protection Centre (PTAC — Patērētāju tiesību aizsardzības centrs) is the main enforcement body. Consumers have strong rights for returns, refunds, and protection from unfair commercial practices. Latvia participates in the EU's online dispute resolution platform and is part of the European Consumer Centre network.

Right of withdrawal (Widerrufsrecht)

For distance contracts (online, phone, mail-order): consumers have the right to withdraw within 14 calendar days from receipt of goods, without giving any reason (EU Directive 2011/83/EU, implemented in Latvian law). The seller must refund all payments (including original delivery cost) within 14 days of receiving the return notification. The consumer bears the cost of return shipping unless the seller agrees to cover it. The right does not apply to: custom-made goods, perishables, sealed software/media once opened, hotel reservations, or event tickets.

Contract cancellation

Consumers have additional rights for service contracts entered at a distance or off-premises. For financial services: separate cooling-off periods apply. For gym memberships and recurring subscriptions: the Consumer Rights Protection Law requires clear cancellation terms to be disclosed upfront. Automatic renewal clauses must be prominently disclosed. Consumers can cancel subscription contracts with the notice period stated in the contract (maximum 1 month for consumer contracts).

Latvian law (implementing EU Directive 2019/771) requires that auto-renewal contract terms are clearly and prominently disclosed. The consumer must be given advance notice before auto-renewal. If not adequately notified, the consumer can cancel without penalty. Common with mobile phone contracts, gym memberships, and online subscriptions. Always check terms for auto-renewal clauses before signing.

Debt collection — response deadlines

Informal reminders: Creditors typically send 1–2 payment reminders (brīdinājuma vēstule) before escalating. These are informal and do not carry legal weight, but should be taken seriously. Respond to payment reminders — ignoring them does not make the debt disappear.

Court order: Creditors can file a claim in court (rajona vai pilsētas tiesa) or through the simplified debt collection procedure (saistību piespiedu izpildīšana brīdinājuma kārtībā) for undisputed debts. Court judgments are enforced by sworn bailiffs (tiesu izpildītāji) who can garnish wages, freeze bank accounts, and seize property.

Response deadline: You have 10 working days to respond to a court debt collection warning (brīdinājums). Failure to respond leads to automatic judgment against you. Respond in writing even to dispute the debt.

Unpaid debts appear in the Latvian credit registry (Kredītu reģistrs at Latvijas Banka) — affecting your ability to get loans, mortgages, and sometimes rental agreements. Debt to the state (VID tax arrears) carries 0.05% daily penalty interest. Never ignore official debt collection correspondence.
