Family Rights & Benefits
Maternity, parental leave and child benefits in Paraguay.
Family benefits are more employment-linked and less generous than in Europe. Formal employment, IPS registration, civil registration and school documentation are the pillars for expat families.
Permiso de maternidad
Before birth: Usually begins before expected birth as certified by doctor.
After birth: Paid maternity protection is commonly referenced as 18 weeks total under Paraguayan maternity rules, with IPS/employer paperwork required.
Job protection: Pregnancy and maternity protections exist; dismissal during protected periods can trigger strong claims.
Paternity and family leave
Max duration: Paternity leave is short compared with Europe; employer policies may offer more.
Split rules / Elterngeld: No statutory shared parental leave framework in Paraguay. Leave beyond the maternity entitlement requires employer agreement.
Benefits
Family allowance
Often 5% of legal minimum wage per eligible child in formal employment contexts
Duration: While eligibility conditions are met
Eligibility: Formal workers supporting eligible children, subject to Labour Code rules and employer compliance
How to apply: Through employer payroll with child documentation
Confirm with payroll; informal workers often miss it.
IPS maternity benefit
Income replacement according to IPS rules and contribution record
Duration: Maternity leave period
Eligibility: Eligible insured contributors
How to apply: Through IPS and employer with medical certificates
Start paperwork early with obstetrician and employer HR.
School enrolment support
No universal child cash benefit in Paraguay; public schooling is state-funded
Duration: School age
Eligibility: Resident children subject to school enrolment rules; MEC (Ministerio de Educación y Ciencias) requirements apply
How to apply: Enrol directly with the school and MEC documentation requirements
Sick child leave
No statutory sick-child leave in Paraguay beyond general sick leave. Employers may grant family emergency leave under contract, internal HR policy, or individual arrangement — negotiate this explicitly in your employment contract.
Birth registration
Births in Paraguay must be registered with the Civil Registry. Foreign parents should request multiple birth certificates and check consular registration with their embassy.
Childcare rights
Public childcare exists but capacity and quality vary. Most expat families use private childcare, family help or private schools.
