Maternity, parental leave and child benefits in Curaçao.
Family law in Curaçao follows a Dutch-model civil code framework. Marriage, civil partnerships, divorce, child custody, and family reunification immigration are governed by local legislation. Same-sex marriage is recognised. The Gerecht in Eerste Aanleg (First Instance Court) handles family law matters. Divorce does not require proof of fault. Child protection is administered by the Voogdijraad (Guardianship Council). The SVB Curaçao (Sociale Verzekeringsbank) administers maternity benefits and social insurance. Family reunification permits are available for immediate family members of permit holders.
Bevallingsverlof (Maternity Leave)
Before birth: 6 weeks before the expected birth date (mandatory minimum under the Landsverordening Ziekteverzekering)
After birth: 6 weeks after birth (mandatory minimum). Total: minimum 12 weeks. The SVB Curaçao reimburses the employer for the maternity period — the employer pays the employee and claims reimbursement from SVB.
Job protection: Employers cannot dismiss a pregnant employee for reasons related to pregnancy or during maternity leave. SVB pays maternity benefit equivalent to the employee's daily wage up to the maximum daily insured wage — employer is reimbursed by SVB. Return to the same or equivalent position is protected.
Vaderschapsverlof / Ouderschapsverlof (Paternity / Parental Leave)
Max duration: Statutory paternity leave: 2 days paid at 100%. No statutory extended parental leave in Curaçao law (unlike the Netherlands). Many progressive employers offer additional paternity or parental leave contractually — check your employment contract and applicable CAO (collective labour agreement).
Split rules / Elterngeld: Paternity leave (2 days) must be taken around the birth. Extended parental leave, where offered contractually, may be taken in agreed arrangements with the employer. Curaçao has not implemented the Dutch extended parental leave legislation — confirm what your specific employer offers.
Benefits
Kindertoelage (Child Allowance)
Approximately XCG 50–100/month per child depending on household income and number of children (verify current rate with SVB Curaçao: svbcur.org)
Duration: Until child reaches 16 years (or 18 if still in education)
Eligibility: All legal residents of Curaçao with dependent children. Apply at SVB Curaçao.
How to apply: Apply at SVB Curaçao (Sociale Verzekeringsbank, Pater Euwensweg 9, Willemstad; svbcur.org) with: child birth certificate(s), proof of residence, and income documentation.
Designed to partially offset child-rearing costs. Lower-income families receive higher amounts. Confirm current XCG amount with SVB — Curaçao switched to the Caribbean Guilder (XCG) replacing the Netherlands Antillean Guilder (ANG) in 2025.
Maternity Benefit (SVB Curaçao)
Equivalent to daily wage up to the maximum insured daily wage set by SVB (reviewed annually — verify current maximum at svbcur.org)
Duration: 12 weeks (6 weeks pre-natal + 6 weeks post-natal)
Eligibility: All employed women enrolled in BVZ (Basisverzekering Ziektekosten) / SVB Curaçao who go on maternity leave. Contribution period requirements apply.
How to apply: Employer notifies SVB Curaçao of the maternity leave. SVB reimburses the employer for the leave period. No separate application needed by the employee — the employer handles the SVB claim.
SVB reimbursement covers the employer's obligation during maternity leave. If the employer fails to notify SVB, the employee may need to apply directly. Keep employment and BVZ enrollment documents accessible.
BVZ Child Healthcare Coverage
Healthcare services for enrolled children at contributing healthcare providers — no cash payment
Duration: While enrolled in BVZ and parent contributions are current
Eligibility: Children of BVZ-enrolled employees are included in the basic health insurance scheme. Employer contributions fund the BVZ, which covers primary care, specialist referrals, and hospitalisation.
How to apply: Children are added to the employee's BVZ coverage through the employer. Notify your employer of the birth and request that the child be enrolled in the BVZ scheme. Contact SVB Curaçao or GGD Curaçao for the child's vaccination schedule and health passport.
Expat families with employer-sponsored international health insurance may prefer to use that alongside or instead of BVZ for broader coverage. Check waiting periods and hospital network for the BVZ plan your employer uses.
Sick child leave
No separate statutory sick-child leave entitlement in Curaçao law. Parents may use their own sick leave entitlement (with medical certificate) or negotiate with their employer for temporary caregiving absence. Some CAOs (collective agreements) provide for short emergency caregiver leave. Many employers allow use of personal days or unpaid leave for child illness. Negotiate sick-child flexibility explicitly in your employment contract.
Birth registration
All births in Curaçao must be registered at the Censo (Dienst Burgerzaken — Civil Registry) within 10 days of birth. Required documents: both parents' passports, birth certificate from hospital or midwife, and marriage/partnership certificate if applicable. Children of Dutch citizens acquire Dutch citizenship by birth regardless of birthplace. Non-Dutch parents' children do NOT automatically acquire Dutch citizenship by being born in Curaçao (no jus soli). Foreign parents must register the birth with their home-country embassy or consulate in Curaçao or via post/online for the child's own national citizenship and passport documentation.
Childcare rights
No universal public childcare subsidy for all residents in Curaçao. Private daycare centres (crèches) and pre-schools are available in Willemstad and surrounding areas — costs vary by facility. Government-subsidised early childhood care programmes exist for lower-income families through the Ministerio di Enseñansa, Siensia, Kultura i Deporte. International and English-language pre-schools serve the expat community. Childcare voucher schemes may be available through some employers — check your employment contract. Child custody after separation: joint parental authority (gezamenlijk gezag) is the default under Curaçao civil law; custody arrangements are determined by the courts based on the best interests of the child.
