Right of withdrawal, contracts and debt collection in Ecuador.
Ecuador's consumer protection framework is governed by the Ley Orgánica de Defensa del Consumidor (LODC, enacted 2000, as amended) and enforced by the Defensoría del Pueblo (dpe.gob.ec). Sector regulators: Superintendencia de Bancos (superbancos.gob.ec) for financial services; ARCOTEL (arcotel.gob.ec) for telecoms; sector ministries for health, transport, and utilities. Protection is strongest when you keep evidence: receipts, contracts, screenshots, WhatsApp chats, bank transfers, warranty cards, delivery photos, serial numbers and provider legal names. Many expat disputes involve rentals, telecoms, gyms, schools, medical/dental quotes, car repairs, timeshares, travel services and bank charges.
Right of withdrawal (Widerrufsrecht)
Ecuador does not have a universal EU-style 14-day cooling-off period for all online purchases. The LODC provides limited withdrawal rights: for purchases made at a consumer's home or workplace (ventas a domicilio), a cancellation right exists within a short period — check LODC Art. 6 et seq. for specifics. For defective goods, the consumer has rights to repair, replacement, or refund within the statutory warranty period. Marketplace return windows (Mercado Libre, etc.) are useful but are platform policies, not statutory rights. For purchases from formal retailers and e-commerce sellers, return policies vary — always check before buying.
Contract cancellation
Telecom, gym, school, insurance, timeshare, medical-package and serviced-apartment contracts may require written cancellation, account number, ID copy, final payment and equipment return. Cancel through the official channel and keep a folio, email or stamped receipt. Do not rely only on stopping card payments.
Auto-renewal appears in telecom plans, streaming, gyms, parking, cloud tools, insurance, memberships and school services. Record renewal dates and cancellation notice periods. Ask providers to confirm cancellation by email or folio number.
Debt collection — response deadlines
Informal reminders: First reminders often arrive by SMS, WhatsApp, email, phone, app notification or letters to your address. Telecom, utilities, rent and card accounts can be suspended quickly.
Court order: Formal debt claims can be pursued through courts or collection agencies depending the debt. Financial debts can affect credit bureau records. Fraud allegations, bounced payments or rent disputes can escalate beyond ordinary collection.
Response deadline: Respond quickly to formal notices. Ask for creditor identity, contract, itemised balance, interest/fee calculation and official payment channel. Translate Spanish notices immediately.
Consumer protection authority
Defensoría del Pueblo (dpe.gob.ec/usuarios-y-consumidores): primary consumer protection body for general goods and services; receives complaints, conducts conciliation, and can refer serious violations for sanction. Superintendencia de Bancos (superbancos.gob.ec): handles financial-user disputes with banks, insurers and financial institutions — online complaint portal at superbancos.gob.ec/bancos/reclamos; bank has up to 15 days to respond to complaints (domestic operations). ARCOTEL — Agencia de Regulación y Control de las Telecomunicaciones (arcotel.gob.ec): telecom and internet service complaints.
General consumer complaints: Defensoría del Pueblo (dpe.gob.ec; email or in-person at provincial offices). Telecom and internet: ARCOTEL (arcotel.gob.ec; online complaint system). Banking and financial services: Superintendencia de Bancos (superbancos.gob.ec/bancos/reclamos) — file online complaint after first escalating to the bank's internal complaints process. Fraud or theft: Fiscalía General del Estado (fiscalia.gob.ec) for criminal complaints; notify your bank immediately for financial fraud. Tourism disputes: Ministry of Tourism (turismo.gob.ec). Keep all receipts, contracts, WhatsApp screenshots, and provider legal names for any formal complaint.
