Right of withdrawal, contracts and debt collection in France.
French consumer protection is comprehensive under the Code de la consommation, enforced by the DGCCRF (Direction Générale de la Concurrence, de la Consommation et de la Répression des Fraudes). Always respond to court documents and huissier notifications immediately; a single missed deadline can trigger seizure (saisie) on salary or bank account. Rights are strong but must be exercised — consumer associations (UFC-Que Choisir, CLCV) provide robust support.
Right of withdrawal (Widerrufsrecht)
Droit de rétractation: 14 calendar days from receipt of goods (or contract conclusion for services) for all distance/online/door-to-door sales to consumers. Applies to B2C sales concluded off-premises. Does NOT apply to: custom-made goods, sealed hygiene products once opened, digital content started with consent, travel/hotel on fixed dates, press subscriptions. Exercise via the standard rétractation form or any written notice. Refund within 14 days of retraction including outbound shipping (basic tariff).
Contract cancellation
For recurring contracts (mobile, internet, mutuelle, gym, press): since Loi Chatel (2005) and Loi Hamon (2015), you can terminate at any time after 1 year without justification with 1 month notice. The provider must remind you of the right to terminate 15–90 days before tacit renewal. Since July 2023 (Loi DDADUE), contracts signed online must allow online termination ("résiliation en trois clics"). Energy contracts (electricity, gas) can be terminated any time without notice.
Tacite reconduction (silent renewal) is legal but regulated. The contract must clearly state renewal terms, and consumers must be reminded in writing 90 to 15 days before tacit renewal deadline (article L215-1 CC). If you are not properly reminded, you can cancel at any time by LRAR, full refund of unused prepaid period. Mutuelle/health insurance: Loi du 14 juillet 2019 allows cancellation anytime after 1 year. Auto insurance: Loi Hamon same rule.
Debt collection — response deadlines
Informal reminders: 1st lettre de relance amiable → 2nd mise en demeure (often by LRAR) → sometimes an agence de recouvrement (private) contacts you. These stages are non-judicial and have no enforcement power. Bailiffs/commissaires de justice may contact you, but until a titre exécutoire is issued by a judge, they cannot seize your property.
Court order: Injonction de payer: a simplified court procedure at the tribunal judiciaire. You receive a signification by commissaire de justice (notified document). Follow with référé (emergency hearing) or assignation au fond (normal court). Titre exécutoire then allows saisie sur salaire (wage garnishment up to a percentage of salary per scale), saisie-attribution (bank account freeze), saisie-vente (movable property auction).
Response deadline: 1 month to oppose an injonction de payer after signification (article 1416 CPC). For ordinary jugements: 1 month (15 days if référé). Appeal: 1 month from signification of the judgment.
Consumer protection authority
DGCCRF (gouvernement) handles enforcement and investigation. Report via signal.conso.gouv.fr (government platform to report issues to professionals and DGCCRF). Consumer associations: UFC-Que Choisir (quechoisir.org), CLCV (clcv.org), Familles de France, CNAFAL. Membership €25–45/year provides access to legal advice, complaint letters, and class actions.
SignalConso (signal.conso.gouv.fr) — free state platform to report consumer issues, feeding the DGCCRF database and notifying the professional. Médiateur de la consommation — each sector has its own free mediator, compulsory step before court for most disputes since 2016. Also: Défenseur des droits for public-service disputes. Keep copies of every contract, email, CB/bank statement, and communications. Send important letters by LRAR with avis de réception.
