Renting in France

Full lifecycle: finding, moving in, during tenancy, leaving.

Renting in France is regulated by the loi du 6 juillet 1989 (for unfurnished main residences), which sets strong tenant protections. Paris, Lyon, Bordeaux, Lille, Nice and Montpellier are classified "zones tendues" — reduced notice periods for tenants, encadrement des loyers (rent caps), and restricted justifications for non-renewal apply. Budget 1 month rent + 1–2 months deposit + 1 month agency fees (honoraires, capped by decree).

2. Before move-in

Handover protocol

État des lieux d'entrée (EDL) — mandatory by law. Document every defect, take photos of each room, floor, walls, equipment and meters (eau froide, eau chaude, gaz, électricité). Both parties sign; you receive a signed copy. Request an EDL contradictoire (face-to-face with landlord or agent) rather than a unilateral one. If you notice defects after signing, you have 10 days to report cold/heating defects by LRAR and 1 month for others.

Deposit

Max: Maximum 1 month rent hors charges for unfurnished; 2 months for furnished. Higher caps are illegal.

Rules: Paid at lease signing. Not held in escrow (landlord keeps it directly). Cannot be used as last month's rent.

Return deadline: 1 month if no deductions, 2 months if justified deductions (EDL de sortie differences). Late return triggers 10% of monthly loyer penalty per month delay since Loi ALUR 2014.

Alternatives: VISALE from Action Logement: replaces both deposit and guarantor free of charge for under-30s and certain workers. Loca-Pass: interest-free advance to cover the deposit.

3. During your tenancy

Régularisation des charges

Frequency: Annual (typically in spring following the reference year)

Dispute window: 3 years to contest in writing any charges that appear on your décompte (under article 7-1 loi 1989). After that, the claim is barred.

Watch for
  • - Charges not listed in décret n° 87-713 of 26 August 1987 (exhaustive list of récupérables)
  • - Landlord's taxe foncière being passed on (only the ordures ménagères portion is recoverable)
  • - Administrative or banking fees of the landlord
  • - Work qualifying as "grosses réparations" (article 606 CC) — landlord's responsibility
  • - Gardien 100% cost (cap is 40–75% maximum)
  • - Missing supporting invoices — you can request justificatifs for 6 months after the décompte

Repairs: Small repairs and day-to-day maintenance (entretien courant, menues réparations) are on the tenant per décret n°87-712 of 26 August 1987: changing washers, bulbs, taps, clearing drains, etc. Everything else is the landlord — notably heating/boiler replacement, structural defects, worn-out appliances. If the landlord refuses repairs, send an LRAR mise en demeure, then file at the tribunal judiciaire.

4. Moving out

Notice period: 3 months for unfurnished (1 month in zone tendue, or for job changes, retirement, health reasons, first job, RSA/ASS beneficiaries). 1 month for furnished (any reason). Notice by LRAR, remise en main propre with signed receipt, or bailiff delivery. The 3-month clock starts on the day the letter is received.

Final handover: État des lieux de sortie (EDL sortie). Compare with EDL entrée. The flat must be rendered in "bon état d'entretien locatif" — clean, holes filled, walls repainted if you chose to paint them a strong colour. Natural wear and tear (vétusté) is not deductible; use a grille de vétusté if annexed to the contract.

Deposit return: Dépôt de garantie returned within 1 month (no deductions) or 2 months (with justifications). Each month of late return adds a 10% of monthly rent penalty. If withheld beyond 3 months for an anticipated régularisation des charges, 80% of deposit must still be returned immediately, with the balance after the décompte.

Your tenant rights

Tenant association: CNL (Confédération Nationale du Logement), CLCV (Consommation Logement Cadre de Vie), ADIL (Agence Départementale d'Information sur le Logement — free legal advice in every département, funded by the state). Membership €40–60/year for CNL/CLCV. ADIL is always free.

Rent control: Encadrement des loyers applies in Paris (since 2019), Lille, Lyon, Villeurbanne, Bordeaux, Montpellier, Plaine Commune, Est Ensemble. Rent cannot exceed the reference rent (loyer de référence) majorised by 20% max. Excess is recoverable for 3 years (action en diminution de loyer).

Eviction protection: Very strong. Landlord can refuse renewal at end of 3-year lease only for: sale (congé pour vendre, tenant has a pre-emption right), personal/family occupation (congé pour reprise), serious tenant breach. Notice: 6 months. Trêve hivernale (1 November – 31 March): no eviction execution possible during this period. Even with a court judgment, the landlord must apply to the préfet for a concours de la force publique.
