Consumer rights in Andorra are governed primarily by Llei 13/2013, del 13 de juny, de competència efectiva i protecció del consumidor (Law on Effective Competition and Consumer Protection), enforced by the Servei d'Atenció al Consumidor under the Unitat de Comerç i Consum (Ministry of Tourism and Trade from 2023). Andorra is not an EU member and EU consumer protection directives (Consumer Rights Directive, Unfair Commercial Practices Directive) do not directly apply. Andorra's consumer protection standards are broadly aligned with EU principles but do not fully mirror them in all areas. Consumer disputes with Andorran businesses are handled by the Servei d'Atenció al Consumidor and, ultimately, by the Batllia d'Andorra (courts). Cross-border purchases from EU sellers (Spain, France) are subject to EU consumer protection laws — the European Consumer Centre (ECC-Net) can assist Andorra-based residents with EU-seller disputes.
Right of withdrawal (Widerrufsrecht)
Andorra's Llei 13/2013 does not establish a universal statutory right of withdrawal for distance or online purchases from Andorran businesses (unlike the EU's 14-day right under the Consumer Rights Directive). Individual seller return and cancellation policies govern purchases from Andorran businesses — always check before buying. However, if you purchase from EU-based sellers (Spanish or French websites operating under EU law), EU law applies and you have the full 14-day (dret de desistiment) right from delivery without needing to give a reason. For faulty goods purchased in Andorra, you have statutory rights to repair, replacement or refund. Practical advice: buy from sellers with written return policies; pay by credit card for additional dispute resolution leverage; keep all receipts and order confirmations.
Contract cancellation
Service contracts (mobile, internet, gym, subscription boxes): standard notice period is 30 days written notice unless the contract specifies otherwise. Andorra Telecom (sole telecom provider): month-to-month residential plans require 30 days notice; no early termination fee for residential plans after the minimum term. Fixed-term service contracts: if you cancel before the agreed term ends, you may owe the remaining contracted payments — check your specific contract (contracte de prestació de serveis). Property rental contracts: 30–60 days written notice per the contracte d'arrendament. Employment contracts: governed by Codi de Treball d'Andorra (Labour Code), not consumer law. Gym and sports club memberships: terms vary — always check minimum term and cancellation notice before signing.
Andorran consumer law requires that contracts with automatic renewal clauses (clàusules de renovació automàtica) notify the consumer at least 30 days before renewal. If proper advance notice is not given, the consumer may cancel without penalty up to 30 days after the renewal date. Auto-renewing annual contracts for services (insurance, streaming, subscription software, gym) must include the renewal date prominently in the contract. Practical advice: set calendar reminders for annual contracts 60 days before renewal to evaluate whether to continue. Andorra Telecom subscription plans: typically month-to-month after minimum term — no auto-renewal trap for monthly plans.
Debt collection — response deadlines
Informal reminders: Andorran creditors typically send 2–3 written payment reminders (cartes de reclamació) before initiating formal legal proceedings. The first reminder is usually sent 7–14 days after the due date. Legitimate creditors use Andorran registered business addresses and reference the original invoice or contract. Andorra has no equivalent to the UK's bailiff system — debt collection agencies operate but have no special powers beyond those of regular civil creditors.
Court order: If informal collection fails, the creditor applies to the Batllia d'Andorra for a payment order (manament de pagament). The Batllia reviews the claim and if valid, issues a formal payment demand with a response deadline. If the debtor does not respond or contest, the order becomes enforceable (títol executiu). Enforcement can include bank account seizure and property liens. Court costs are borne by the losing party.
Response deadline: 20 calendar days to respond to a formal Batllia payment order. Failure to respond within 20 days results in automatic enforcement proceedings. If you receive a formal court demand, consult an Andorran lawyer (advocat) immediately — do not ignore it.
Consumer protection authority
Servei d'Atenció al Consumidor (consum.ad) — Andorra's consumer protection authority, part of the Unitat de Comerç i Consum (Ministry of Tourism and Trade). Role: investigates consumer complaints against Andorran businesses; mediates disputes; enforces Llei 13/2013; publishes consumer alerts.
