Consumer Rights

Right of withdrawal, contracts and debt collection in Indonesia.

Indonesian consumer rights are governed by UU No. 8/1999 (Consumer Protection Law — UUPK) and regulated by BPKN (Badan Perlindungan Konsumen Nasional — National Consumer Protection Agency) and BPSK (Badan Penyelesaian Sengketa Konsumen — Consumer Dispute Settlement Agency) at municipal level. The law grants consumers rights to safety, information, choice, and redress. OJK (Financial Services Authority) handles complaints against financial institutions and insurance companies. In practice, enforcement varies significantly — major brands and online platforms respond better to complaints than small vendors. E-commerce disputes have increased regulation through Permendag No. 50/2020 and subsequent amendments.

Right of withdrawal (Widerrufsrecht)

No universal statutory "cooling off" withdrawal right analogous to EU consumer law. However: E-commerce purchases (Tokopedia, Shopee, Lazada) have platform-mandated return policies — typically 2–7 days for defective goods and 1–3 days for change of mind on selected categories. Physical store purchases: governed entirely by store policy — no legal right to return unless defective. Electronic goods: mandatory 1-year manufacturer warranty under SNI (Indonesian National Standard) — defective goods must be repaired, replaced, or refunded by seller within 30 days. Credit card chargebacks: available for disputed transactions — contact issuing bank within 30–60 days.

Contract cancellation

Service contracts (internet, mobile phone, gym memberships): notice period specified in contract governs — typically 30 days. Cancellation fees may apply. For IndiHome/Telkom: 30-day written notice or via call centre. Mobile postpaid plans: minimum contract period common (12–24 months) — early termination fees apply. Subscription streaming: cancel anytime via app settings. Financial products: vary by OJK regulations — insurance policies have free-look period (typically 14 days after receiving policy). BPJS Kesehatan: cannot be cancelled while in debt; must settle arrears first.

No specific Indonesian legislation on auto-renewal obligations. Common practice: annual service contracts (internet, TV, subscription software) auto-renew unless cancelled before renewal date. Gyms and private clubs: auto-renewal common — check contract terms. Credit card annual fees: auto-deducted — cancel card before annual fee date if not needed. Alert: some Indonesian businesses will continue charging recurring payments after cancellation — monitor bank statements and be persistent in confirming cancellation with written confirmation.

Debt collection — response deadlines

Informal reminders: First stage: phone calls, SMS, WhatsApp messages from lender. Indonesian credit companies frequently use aggressive informal contact — sometimes contacting emergency contacts listed on loan applications. This is regulated but not always enforced. POJK No. 35/2018: debt collection must be: between 08:00–20:00 only, conducted by licensed collection agents, no threats or humiliation allowed.

Court order: If informal collection fails: creditor must file at Pengadilan Negeri (District Court) for a civil judgment. P2P lending (fintech pinjol): AFPI self-regulation governs debt collection practices for OJK-licensed fintech lenders. Secured loans: creditor can exercise security rights (fiduciary seizure of vehicle) under court process.

Response deadline: Civil court summons (panggilan pengadilan): must respond within specified date on summons (typically 14–21 days). Ignoring summons: default judgment (putusan verstek) issued in creditor's favour. Financial services dispute: BPSK resolution within 21 days.

Indonesia has a serious problem with illegal predatory lending apps (pinjaman online/pinjol ilegal) — unlicensed P2P lenders who use illegal collection tactics including: contacting all phone contacts of the borrower, sending embarrassing messages to contacts, threatening physical harm, and sharing personal data. OJK has shut down 4,500+ illegal pinjol platforms since 2018 but new ones emerge constantly. NEVER borrow from unregistered apps. Verify OJK licence at ojk.go.id before using any financial app.
