Family Rights & Benefits
Maternity, parental leave and child benefits in Portugal.
Portugal has progressive family law with strong parental leave rights shared between parents, a comprehensive child benefit system (abono de família), and progressive adoption and family reunification rules. The Código do Trabalho (CT) and the Social Security framework (RGSS) govern most family benefits. Portugal was one of the first European countries to legalise same-sex marriage (2010) and adoption by same-sex couples (2016). Family law is administered through Tribunais de Família e Menores (Family and Juvenile Courts) and the Segurança Social.
Licença por Maternidade / Licença Parental Inicial da Mãe
Before birth: 30 days before the expected birth date (if desired). Obrigatório (mandatory): 6 weeks after birth.
After birth: Minimum 6 weeks mandatory immediately after birth. Total: typically 120 days (4 months) of licença parental inicial, paid at 100% base salary by Segurança Social (if fully taken by mother). Can be extended to 150 days if shared with father (see parental leave).
Job protection: Protected from dismissal during pregnancy and for 1 year after childbirth. Reinstatement right if dismissed during protection period. Right to return to same or equivalent job. Cannot be required to do overtime or night work during pregnancy and up to 1 year after birth without consent.
Licença Parental Inicial Partilhada
Max duration: 120 days minimum (both parents combined), 150 days if shared with at least 30 days taken by the father. 180 days at 83% salary if shared 50/50 with the father. Father's exclusive 25 days (5 mandatory + 20 optional) are separate and on top of the shared parental leave.
Split rules / Elterngeld: The 120 days of licença parental inicial may be split between mother and father. The mother must take the 6-week mandatory period; remainder can be split. Bonus: if the father takes 30 days, the shared parental leave extends from 120 to 150 days (both paid at 100%). If each parent takes 50% of 180 days: paid at 83% each. Father's mandatory 5 days (3 business days) must be taken in the first 6 weeks.
Benefits
Abono de Família
€52.85–163.30/month per child depending on household income tier and child's age (2026 values — higher for lower income families and children with disabilities)
Duration: Until child's 16th birthday; until 24 if studying; indefinite for children with disabilities. Reviewed annually.
Eligibility: All children resident in Portugal with the responsible caregiver (parent/guardian) with legal status and NIF. No minimum employment contribution required — universal child benefit.
How to apply: Apply at Segurança Social Direta (seg-social.pt) or in person at any Segurança Social service. Documents: birth certificate, NIF, household income declaration, household registration (composição do agregado familiar). Processing: 30–90 days.
Abono is income-tested — three income tiers with different amounts. Additional supplements for: large families (4+ children), single-parent households, disability. Subsídio de frequência escolar (school attendance supplement) added from age 6.
Subsídio de Maternidade / Paternidade (Parental Benefit)
100% of base salary (for 120 or 150 day shared option); 83% (for 180 day option). Calculated on last 6 months' average gross remuneration.
Duration: For the duration of the parental leave taken
Eligibility: Workers (employees or self-employed) who have contributed to Segurança Social for at least 6 months (180 days) of registered contributions in the previous year.
How to apply: Apply at Segurança Social Direta at seg-social.pt after birth. Employer must be notified of leave dates. Father's 5-day mandatory leave: employer notified minimum 5 days in advance.
Self-employed (Recibo Verde) workers qualify if they have 6 months of contributions. Amount calculated on rendimento de base (typically monthly contribution base).
Subsídio de Doença de Filho (Sick Child Leave)
65% of base salary (for children up to 12; up to 30 days/year per child) or 100% for hospitalised children
Duration: Up to 30 days per year per child for illness; unlimited for hospitalisation
Eligibility: Parents of children under 12 (or disabled children of any age) who must provide childcare during illness confirmed by atestado médico
How to apply: Present medical certificate to employer and Segurança Social
Both parents have independent rights — if one parent exhausts their 30 days, the other parent's 30 days are separate. Adoption: same rights as biological parents.
Subsídio por Adoção (Adoption Subsidy)
100% base salary
Duration: 100 days per adopted child (up to 150 days if both parents share, with same bonus structure as biological parental leave)
Eligibility: All workers on adoption leave for a child under 15

Same rights as biological parenthood for the leave and payment structure.
Licença Parental Complementar (Extended Parental Leave)
25% base salary
Duration: Up to 3 months per parent (non-transferable)
Eligibility: Both parents after using initial parental leave, for children under 6
How to apply: Request via Segurança Social Direta; 30 days notice to employer
Allows parents to work part-time (50%) instead for up to 6 months with 50% salary supplement from Segurança Social.
Sick child leave
30 days/year per child under 12 for illness (65% salary); unlimited for hospitalisation (100% for first month). Assistência a filho: parent may take time to deal with a child's school, medical appointments, or sudden illness.
Birth registration
All births in Portugal must be registered at the Registo Civil within 20 days. Hospital births are usually registered directly by the hospital. Documents required: identity documents of parents, marriage certificate or joint statement of parentage. Foreign-born children of residents: register at the nearest Portuguese consulate (Conservatória do Registo Civil) or Registo Civil in Portugal.
Childcare rights
Right to return to same job after parental leave. Right to breastfeeding breaks (2 hours/day in the first year, without loss of pay). Right to work part-time until child reaches age 3 (employer cannot refuse without objective justification in companies with 50+ workers). Right to absence from work for urgent family matters (Faltas por motivos familiares — up to 15 working days/year).
