Renting in Portugal is governed by the NRAU (Novo Regime do Arrendamento Urbano), established by Lei 6/2006 and significantly reformed by Lei 13/2019 (tenant protection reform, Porta 65 Jovem), and the 2023 Mais Habitação housing package (Lei 56/2023). The rental market is under severe pressure in Lisbon, Porto, Cascais, and the Algarve — demand massively outstrips supply, pushed by tourism, short-term rental platforms (Alojamento Local), and international immigration. Expect to provide extensive financial documentation, competition from multiple applicants, and landlord-favourable terms in hot market areas. Government interventions (rent freezes for existing contracts, expanded rent-to-own programme PPPH) are evolving rapidly.
1. Finding a flat

- - In Lisbon, avoid apartments listed under €1,000 in central areas — they are likely scams or have serious undisclosed issues.

2. Before move-in
Handover protocol
Vistoria / Auto de Entrega e Recepção — a detailed written inventory (inventário) signed by both landlord and tenant documenting the state of the property, all appliances, and meter readings (água, luz, gás). Photograph every room, every appliance, every mark on walls. Both parties sign; keep a copy. This is ESSENTIAL for recovering your deposit.
Deposit
Max: Caução: maximum 2 months rent under NRAU for all residential contracts — furnished and unfurnished alike. Requesting more than 2 months is illegal and can be challenged. Total advance payment at signing: typically 2 months caução + 1 month rent advance = 3 months total upfront. Some landlords request an additional garantia for high-risk profiles — negotiate carefully.
Rules: The caução is held by the landlord for the duration of the tenancy. There is no mandatory escrow/deposit registration system. The landlord must return it within 30 days of lease end, minus documented damages. If the landlord fails to return within 30 days, the tenant may pursue via Julgados de Paz or CICAP arbitration.
Return deadline: 30 days after key return and lease termination. Request return in writing (carta registada AR — registered with return receipt). Claim default interest (taxa de juro de mora) if not returned within the legal deadline.
Alternatives: Some landlords accept a bank guarantee (garantia bancária) in lieu of cash deposit — ask your Portuguese bank about costs (typically 0.5–1% annually of the guaranteed amount).
3. During your tenancy
Gestão de Encargos e Condomínio
Frequency: Monthly or bi-monthly billing for electricity and gas. Quarterly for some water services. Condomínio fees (quotas de condomínio) are monthly, charged by the condomínio administration to the owner — ensure your contract is clear about who pays them (typically the owner, not the tenant under Portuguese law).
Dispute window: Up to 3 years to dispute billing errors under general prescription rules. Water billing errors: up to 5 years.

Repairs: Small repairs (defined as ordinary wear and tear, up to approximately €150–200) are typically the tenant's responsibility. Major repairs (structural, plumbing, boiler, roof, waterproofing, electrical installation) are the landlord's responsibility under NRAU. If the landlord refuses to carry out urgent necessary repairs, the tenant can do so and deduct from rent after sending formal written notice (carta registada). Document everything.
4. Moving out
Notice period: Tenant termination notice: 120 days before desired end date (for contracts of 1–3 years), 60 days (for contracts under 1 year under the simplified regime). With the 2019 reform, tenants may terminate with 2 months' notice after the first 6 months of any contract, paying a penalty proportional to the remaining duration if leaving before contract end. Landlord termination: at minimum notice of 2 years (for own occupation or major renovation) or 5 years (in some cases). Tenant protections are strong.
Final handover: Entrega de chaves (key return): joint inspection with landlord, photos, final meter readings. Both sign a Acta de Entrega/Auto de Vistoria Final. Request written confirmation of key return date. Leave the apartment in the same condition as the inventory (normal wear and tear excluded).
Deposit return: 30 days after key return under NRAU. Landlord may deduct only documented damages (with invoices/photos) and unpaid rent or utilities. If not returned within 30 days, send carta registada AR (registered with return receipt) demanding repayment + legal interest. Small claims: Julgados de Paz (€70 fee) or CICAP arbitration.
Your tenant rights
Tenant association: FENPROF (teachers union with tenant advice service), DECO (Defesa do Consumidor — consumer protection, membership €40/year gives legal advice access). Julgados de Paz offer cheap dispute resolution for claims up to €15,000. CICAP (Centro de Informação, Mediação e Arbitragem de Conflitos do Consumo) for mediated resolution.
Rent control: Existing long-term contracts: protected from rent increases beyond the annual coefficient (INE inflation index). The official rent update coefficient for 2026 is 1.0224, permitting a maximum 2.24% increase on existing contracts (set by Notice 23174/2025/2 of September 2025). Landlords must notify tenants at least 30 days in advance. Regarding new contracts: the 2% cap on new contracts (Mais Habitação, Lei 56/2023) that restricted rent increases to 2% above the previous tenant's rent has been repealed by the subsequent government — new contracts are now free-market in most areas (2025). Verify the current status of ZPU (Zonas de Pressão Urbanística) designations if renting in Lisbon, Porto, Cascais, or Sintra, as further legislative changes remain possible.
Eviction protection: NRAU provides strong eviction protection. Despejo (eviction) for non-payment: minimum 3–6 months legal process. Emergency social cases: Bolsa Nacional de Alojamento Urgente (BNAU) for victims of domestic violence, fire, or illegal eviction. Landlord must follow formal judicial procedure for any eviction — self-help eviction (changing locks, removing belongings) is illegal.
