Isle of Man (IM)
The Isle of Man is a self-governing Crown Dependency of the British Crown in the Irish Sea, known for its favourable tax environment (no capital gains tax, no inheritance tax, low income tax), world-famous TT motorcycle races, and a thriving financial services, e-gaming, and technology sector.
Employment Rights
Sick leave, dismissal protection and red flags in Isle of Man.
Manx employment law is distinct from UK law — it is not automatically copied across when UK rules change. Core rights (written statement of terms, unfair dismissal, minimum wage, discrimination protection) are established under Manx statute, primarily the Employment Act 2006 and related legislation. Always check gov.im for current legislation rather than assuming UK employment guidance applies. Work-permit status, ITIP payroll coding, and immigration leave are separate from employment rights but interact with them. The main enforcement and advisory body is the Isle of Man Employment Tribunal and the Department for Enterprise.
Sick leave
Rules: Employees are entitled to self-certify sick absence for up to 7 calendar days. After 7 days, a medical certificate (fit note) from a GP or other approved practitioner is required. The statutory sick pay framework is administered through Manx Social Security; not all employees qualify for Statutory Sick Pay (SSP) — the lower earnings limit applies (£129/week from April 2026). Many contracts offer contractual sick pay above SSP; check your written statement of terms.
Doctor note: Day 8 — after 7 days of self-certification
Employer pay: Manx SSP for 2025/26: approximately GBP 116.75/week; the 2026/27 rate is expected to align broadly with UK changes (check gov.im for the confirmed Manx figure). SSP is payable for up to 28 weeks. Contractual sick pay varies by employer; finance, legal and government roles typically offer 1–6 months at full or partial pay. Zero-hours and casual workers may not qualify for SSP if they do not meet the lower earnings limit.
Long-term: After SSP exhaustion (28 weeks), Incapacity Benefit may apply through Isle of Man Social Security, subject to National Insurance contribution record and medical assessment. Disability-related benefits depend on residence, contributions and degree of incapacity. Get advice from Citizens Advice Isle of Man before SSP runs out.
Dismissal protection
Law: The Employment Act 2006 and related Manx employment legislation. Unfair dismissal protection generally applies after 1 year of continuous employment. Automatic unfair dismissal (no qualifying period) applies for dismissals related to pregnancy/maternity, whistleblowing, trade union activity, health and safety grounds and certain other protected acts.
Deadline to sue: 3 months minus 1 day from the effective date of termination for most employment tribunal claims (unfair dismissal, discrimination, unlawful deductions). Missing this deadline typically means your claim is out of time. Seek advice from Citizens Advice Isle of Man or an employment advocate immediately if you believe you have been wrongfully or unfairly dismissed.
Probation
Probation periods of 3–6 months are standard; senior roles may have up to 12 months. During probation, notice periods are usually shorter (often 1–4 weeks) but unfair dismissal protections may be limited until 1 year of continuous employment is achieved. Work-permit obligations, ITIP tax coding and National Insurance contributions all apply from day one regardless of probation status.
Notice periods
Statutory minimum notice: 1 week after 1 month service; 1 additional week per complete year of service up to 12 weeks maximum. Many contracts offer longer contractual notice (1–3 months for professional roles; 3–6 months for senior positions). Payment in lieu of notice (PILON) is common if the employer terminates immediately. Garden leave clauses require you to work out notice but release you from duties.
Working time
Max hours: The Working Time Regulations (Isle of Man) 2003 limit average working time to 48 hours/week (measured over a 17-week reference period) unless the worker has signed a valid opt-out. Junior roles, trades and hospitality typically use 37–40 contracted hours. Finance and professional roles often see longer actual hours around reporting deadlines.
Min rest: Minimum daily rest: 11 consecutive hours between working days. Minimum weekly rest: 24 consecutive hours per 7-day period (or 48 hours per 14-day period). Rest break of at least 20 minutes when working more than 6 hours continuously.
Overtime: Overtime is not mandatory unless the contract specifies it. Premium overtime rates (1.25–1.5× base pay) are common in trades, hospitality and shift-working; professional roles more often use time-off-in-lieu. Confirm the overtime policy in writing before working extra hours.
Vacation
Statutory minimum annual leave: 4.8 weeks (approximately 24 days for a 5-day week) including bank holidays. Many professional employers offer 25–28 days plus 9–10 bank holidays. The Isle of Man has 9–10 bank holidays per year (2026 includes TT Bank Holiday on 5 June and Tynwald Day on 6 July). Accrual starts from day one; employees leaving partway through the year are entitled to a pro-rated payment in lieu of unused leave.
Anti-discrimination
The Employment Act 2006 and related Manx legislation prohibit discrimination on grounds of sex, pregnancy/maternity, race, disability, religion or belief, sexual orientation and age. Harassment and victimisation are also prohibited. Claims must generally be brought within 3 months of the act complained of to the Isle of Man Employment Tribunal. Manx law does not yet have gender recognition reform aligned with recent UK changes — check the current position if this affects you.
Contract red flags
- !Start date written before work permit approval is confirmed in writing — never begin work without confirmed immigration permission.
- !Salary set below the Manx minimum wage of GBP 13.46/hour (from 1 April 2026, for workers aged 18+); check gov.im for the current rate as it is reviewed annually.
- !No written statement of terms provided within 1 month of starting — this is a statutory obligation under Manx law.
- !Overtime, on-call or travel time excluded from minimum wage calculations — all working time counts toward the minimum wage.
- !Employer asks you to call yourself self-employed while controlling all aspects of how and when you work — this may be false self-employment and creates tax and employment-right risk.
- !Restrictive covenants (non-compete, non-solicitation) wider than 12 months or covering the whole Island without clear justification — may be unenforceable but will still be used as leverage.
- !Accommodation, equipment or tools costs deducted from salary in a way that takes pay below the minimum wage.
- !No mention of pension auto-enrolment, work permit conditions or right-to-work checks.
