Right of withdrawal, contracts and debt collection in Moldova.
Consumer protection in Moldova is governed by the Law on Consumer Protection (Legea nr. 105/2003, updated in alignment with EU directives) and the Civil Code. The national consumer protection authority is ANPC (Agenția Națională pentru Protecția Consumatorilor). As part of EU accession preparations, Moldova has been progressively aligning its consumer law with EU directives including the Consumer Rights Directive (2011/83/EU) and the Digital Content Directive. Enforcement remains weaker than in the EU but improving, particularly in formal retail and online shopping.
Right of withdrawal (Widerrufsrecht)
For distance and off-premises contracts (online purchases, doorstep sales, phone orders): consumers have a 14-day withdrawal right (dreptul de retragere) without giving any reason. The 14-day period starts from the day of product receipt (goods) or contract conclusion (services). The seller must process the refund within 14 days of receiving the withdrawal notice or the returned goods. The consumer pays return shipping costs unless the seller agreed otherwise. Digital content once accessed/downloaded may lose withdrawal protection — check terms before purchase.
Contract cancellation
Service contracts (subscriptions, telecoms, gym, internet): consumers can cancel at any point in accordance with contract terms. Maximum early termination fee: capped at the remaining subscription value (cannot exceed the outstanding contract value). Automatic renewals (tacit contract renewal, tacita reconducțiune): provider must notify the consumer at least 30 days before the auto-renewal date; consumer has 15 days to cancel after notification.
Automatic renewal of service contracts is permitted but the provider must send a written or electronic renewal reminder 30–60 days before the renewal date. After renewal, consumers have 15 days to cancel without penalty after receiving the renewal notice. Telecoms and internet contracts: switching provider or cancelling is simplified — the Law on Electronic Communications allows porting numbers and switching within 5 business days.
Debt collection — response deadlines
Informal reminders: Creditors (banks, telecoms, landlords) typically send 2–3 informal written or electronic reminders before escalating. Reminders are not legally regulated in form but must not constitute harassment. First reminder usually arrives within 15–30 days of missed payment.
Court order: To enforce a debt in Moldova, the creditor must obtain a court order (hotărâre judecătorească) or a payment order (ordonanță de plată — simplified procedure for uncontested debts under MDL 50,000). Court orders are enforced by bailiffs (executori judecătorești). The process takes 1–6 months for contested debts, 2–4 weeks for uncontested payment orders.
Response deadline: For a payment order (ordonanță de plată): you have 10 business days from receipt to file an objection (obiecție) at the court that issued it. For a court judgment: 30 days to appeal (apel). Missing these deadlines allows enforcement to proceed.
