Family Rights & Benefits
Maternity, parental leave and child benefits in Moldova.
Moldovan family rights are governed by the Family Code (Codul Familiei) and the Labour Code. Moldova has relatively generous maternity and parental leave provisions. Key 2026 changes: parental indemnity rates updated with indexation in April 2026. CNAS (Casa Națională de Asigurări Sociale) administers all parental benefits. Access to benefits requires prior social contribution history. Expat employees contributing to CNAS are fully eligible for all family benefits after qualifying periods.
Concediu de maternitate (Maternity Leave)
Before birth: 70 calendar days pre-natal leave (110 days in the case of complicated pregnancy or multiple birth)
After birth: 56 calendar days post-natal leave (70 days for complicated births or multiple births). Total standard maternity: 126 calendar days.
Job protection: Full job protection throughout maternity leave. Employer cannot dismiss an employee on maternity leave except in case of complete company liquidation. Position, seniority and salary level are preserved. Return-to-work right to the same or equivalent position is guaranteed.
Concediu pentru îngrijirea copilului (Parental Leave)
Max duration: Up to 3 years per child (child's 3rd birthday). Can be taken by either parent or divided between parents. The parent on parental leave receives a monthly CNAS indemnity for the first 3 years.
Split rules / Elterngeld: Either parent (or grandparent) can take parental leave. The leave can be transferred between parents at any time. Only one person can take the indemnity at a time. During parental leave, the parent's job position is preserved. The employer cannot dismiss an employee on parental leave.
Benefits
Indemnizație de maternitate (Maternity Benefit)
100% of average insured salary calculated over the 12 months before birth
Duration: 126 calendar days (standard); up to 140 days for complicated births or twins
Eligibility: Employed mothers with CNAS contributions. Self-employed ÎI owners who have voluntarily paid CNAS contributions for at least 9 months. Minimum qualifying period: 9 months of contributions in the 24 months before birth.
How to apply: Submit application to employer with medical certificate (certificat de concediu medical) from the obstetric/gynaecology clinic confirming expected birth date. Employer processes claim with CNAS.
Paid via CNAS through the employer as a replacement for salary. Cannot receive both maternity benefit and salary simultaneously.
Indemnizație pentru creșterea copilului (Parental Benefit)
For months 1–12: 90% of average insured monthly salary. For months 13–36: 75% of average insured monthly salary. Minimum amount: MDL 1,000/month; maximum: MDL 13,000/month (2026 cap).
Duration: Until the child's 3rd birthday
Eligibility: One parent (or grandparent/legal guardian) who has stopped working to care for the child and has at least 9 months of CNAS contributions in the 24 months before birth. Both employed and self-enrolled persons qualify.
How to apply: Apply at the local CNAS territorial office (casă teritorială de asigurări sociale) with: birth certificate, parents' IDs, employment contract termination/leave agreement, CNAS contribution history printout. Apply within 12 months of birth — retroactive payment to birth date if applied within this window.
Can be combined with part-time work if income does not exceed the national minimum wage (MDL 5,600/month). Exceeding this threshold may reduce or eliminate the benefit.
Ajutor la naștere (Birth Grant)
MDL 10,000 per newborn child (2026 rate)
Duration: One-time payment per child
Eligibility: All parents with registered residence in Moldova at the time of birth, regardless of employment status.
How to apply: Apply at the local CNAS office or through the ASP (Agenția Servicii Publice) within 12 months of birth. Required: birth certificate, parents' IDs, IDNP, bank account details.
Universal grant — available to expats with registered residence in Moldova. Payment processed within 30 days of application.
Alocație de stat pentru copii (Child State Allowance)
MDL 700/month per child under 18 years (2026 rate; indexed periodically)
Duration: Monthly until the child's 18th birthday (extended to 23 if in full-time education)
Eligibility: All children residing in Moldova — regardless of parents' employment status. For expat children: residence permit required.
How to apply: Apply at local ASIS (Agenția de Asistență Socială) office with birth certificate, parents' IDs and residence documentation. Can also apply online through gov.md portal.
A universal child benefit. Expat families with children legally resident in Moldova are fully eligible. Paid to the designated parent account.
Sick child leave
Paid leave for parents to care for sick children under 10 years: funded by CNAS at the same rate as sick leave (75% of average salary). Duration: up to 14 calendar days per illness episode for children under 3; up to 7 days for children aged 3–10. Requires a medical certificate from the child's doctor. No annual cap on number of sick-child leave episodes.
Birth registration
Register the birth at the local ASP (Agenția Servicii Publice) office within 30 days of birth. Required: hospital birth certificate (certificat medical constatator al nașterii), parents' passports and IDs, marriage certificate if married. Foreign parents use their passports. The child receives a Moldovan birth certificate (certificat de naștere) and an IDNP (Moldovan personal ID number). For non-Moldovan citizenship children, register also at your country's consulate/embassy.
Childcare rights
Working parents with children under 3 years are entitled to parental leave without risk of dismissal. Employers with 25+ employees must provide a nursing room (cameră pentru mame care alăptează). Nursing mothers are entitled to additional 30-minute nursing breaks during the working day (paid at normal rate) until the child reaches 1.5 years. All female employees are entitled to a free medical examination during pregnancy within working hours.
