Family Rights & Benefits
Maternity, parental leave and child benefits in Poland.
Poland has a comprehensive system of family benefits and parental leave protections. The flagship programme 800+ (formerly 500+, increased to 800 zł from January 2024) pays 800 zł/month per child under 18. Parental leave is generous — 41 weeks (52 weeks for multiple births) split between parents. EU citizens and legal residents with work rights are entitled to the same benefits as Polish citizens.
Urlop macierzyński (Maternity Leave)
Before birth: No formal pre-birth mandatory period. 2 weeks can be taken before expected due date.
After birth: 20 weeks total (26 weeks for twins, 28 for triplets). First 14 weeks mandatory for mother. Remaining weeks can be transferred to father or other parent.
Job protection: Complete job protection during maternity leave. Cannot be dismissed. Return to same or equivalent position guaranteed.
Urlop rodzicielski (Parental Leave)
Max duration: 41 weeks (52 weeks for multiple births). This follows maternity leave. Can be split between parents. Since 2023 reform (EU Directive implementation): at least 9 weeks of parental leave reserved exclusively for each parent (non-transferable) — use it or lose it.
Split rules / Elterngeld: Parental leave can be split into 4 parts between parents. Maximum of 1 parent at a time (except for first 8 weeks simultaneously). Father's exclusive 9 weeks cannot be transferred to mother. Flexible part-time use possible (work part-time + partial leave pay).
Benefits
800+ (Świadczenie Wychowawcze)
800 zł/month per child
Duration: Until child turns 18
Eligibility: Polish citizens and legal residents (including EU citizens with work/residence rights) with children under 18. Universal — no means test. Income from 800+ not taxable.
How to apply: Online via ZUS PUE (zus.pl) or mObywatel app. Also in person at ZUS or Urząd Gminy (MOPS/OPS). Submit within 3 months of birth for backdated payment from birth. Annual renewal required confirming child is still in your care.
Increased from 500 zł to 800 zł from January 2024. One of the most popular social programmes in Poland. Non-working parents can also receive it. Children in school education up to 18; not extended to college age.
Becikowe (One-time Birth Grant)
1,000 zł (one-time payment per birth)
Duration: Single payment
Eligibility: Parents of newborns. Income-tested (net family income per member under ~1,922 zł/month). Mother must have been under medical supervision from week 10 of pregnancy.
How to apply: Apply at local MOPS (Miejski Ośrodek Pomocy Społecznej) within 12 months of birth.
Income-tested unlike 800+. Much smaller benefit but easy to apply for if eligible.
Rodzinny Kapitał Opiekuńczy (RKO — Family Care Capital)
500 zł/month (2nd and 3rd child aged 12–35 months) or 1,000 zł/month (only child in that age range)
Duration: Up to 24 months (between 12th and 35th month of child's life)
Eligibility: Parents with children aged 12–35 months. Universal — no means test.
How to apply: ZUS PUE portal or ZUS office. Apply from child's 12th month.
Introduced 2022. Designed as an alternative/supplement to żłobek subsidies for parents who keep children at home or in private nurseries. Can be split with the government żłobek co-financing (Aktywna Mama).
Zasiłek macierzyński (Maternity Benefit / Parental Pay)
100% salary for first 26 weeks (maternity leave). During parental leave (urlop rodzicielski): 81.5% if whole period taken by one parent, or 70% if both parents take their parts.
Duration: Duration of maternity (26 weeks) + parental leave (41 weeks). Total up to 52 weeks at full/partial pay.
Eligibility: Working parents (umowa o pracę) covered by ZUS sickness insurance (chorobowe). Self-employed who pay voluntary chorobowe ZUS also entitled.
How to apply: Employer handles application to ZUS for employed workers. Self-employed apply directly to ZUS.
Paid by ZUS directly to employee. Combined maternity + parental = 52 weeks of paid leave is very generous by EU standards.
Zasiłek rodzinny (Family Allowance)
95–135 zł/month per child (age-dependent)
Duration: Until child is 18 (23 if in education)
Eligibility: Low-income families. Income threshold: net income per family member under 674 zł/month (800 zł/month if child has disability).
How to apply: MOPS/OPS at local gmina.
Means-tested supplement for the poorest families. Much lower than 800+ but includes additional supplemental benefits (for school start, single parents, etc.).
Sick child leave
Opieka nad chorym dzieckiem: employee entitled to up to 60 days/year unpaid leave to care for sick child under 14 (or 30 days for child 14+). ZUS pays zasiłek opiekuńczy (care benefit) at 80% of salary base during this leave. Both parents can alternate caring days.
Birth registration
Birth must be registered (rejestracja urodzenia) at the Urząd Stanu Cywilnego (Civil Registry Office) within 21 days of birth. Hospital automatically notifies USC in most cases for births in Poland. The USC issues aktu urodzenia (birth certificate) and registers PESEL for newborn automatically. Foreign births must be transcribed (transkrypcja) into the Polish Civil Registry.
Childcare rights
Children have the legal right to a żłobek (nursery) place from 20 weeks. Przedszkole (kindergarten) place from age 3 — guaranteed by law from age 3. Free przedszkole for the 5-hour core session. Municipality must provide childcare options — if public places unavailable, municipality may be required to fund private alternative. Compulsory school attendance from age 7.
