Family Rights & Benefits
Maternity, parental leave and child benefits in Azerbaijan.
Azerbaijan's family law framework provides maternity leave, paternity leave, and child benefit, governed by the Labour Code and the Law on State Social Insurance. Foreign nationals employed in Azerbaijan and contributing to the State Social Protection Fund (DSMF) are entitled to the same benefits as Azerbaijani citizens. Family reunification TRPs allow spouses and children of TRP holders to reside legally in Azerbaijan.
Decree Leave (Analıq məzuniyyəti)
Before birth: 70 calendar days before birth (increased to 84 days for multiple births)
After birth: 56 calendar days after birth (increased to 70 days for complicated births or multiple births)
Job protection: Full job protection during maternity leave. The employer cannot terminate employment during pregnancy or while the employee is on maternity leave. Position must be kept open and the employee must be reinstated at the same salary level.
Childcare Leave (Uşaq məzuniyyəti)
Max duration: Up to 3 years from the child's birth. This period can be taken by either parent (mother or father) or shared between them. The first 1.5 years are paid at the state benefit rate; the second 1.5 years are unpaid (or paid by a generous employer).
Split rules / Elterngeld: Either parent can take the childcare leave, or it can be split between them. Only one parent can be on childcare leave at a time. Grandparents can take childcare leave in some circumstances under Azerbaijani law.
Benefits
Maternity Benefit (Analıq müavinəti)
100% of average daily salary for the duration of the maternity leave period (126–154 calendar days)
Duration: For the full maternity leave period (70 days before + 56 days after = 126 days standard)
Eligibility: Employed women who have contributed to the State Social Protection Fund (DSMF). Requires minimum social insurance contribution history.
How to apply: Apply through your employer — HR submits to the DSMF (sspf.gov.az). The employer pays the benefit and is reimbursed by DSMF.
Applies to employed women with valid employment contracts. Self-employed women have limited access and should consult DSMF directly.
Childcare Benefit (Uşağa qulluq müavinəti)
Approximately ₼100–200/month (government minimum rates; employers often top this up)
Duration: Until the child reaches 1.5 years of age
Eligibility: Parents who have taken childcare leave and have contributed to DSMF. Minimum contribution requirements apply.
How to apply: Employer processes the application and submits to DSMF.
The benefit level is relatively modest. Many employers in international sectors supplement the state benefit to maintain a proportion of normal salary.
Paternity Leave
14 calendar days at 100% of average salary
Duration: 14 days from birth
Eligibility: Employed fathers covered by the Labour Code.
How to apply: Notify employer and HR on or after the birth. HR processes the leave and DSMF claim.
14-day paid paternity leave was introduced in recent Labour Code amendments. Fathers are also entitled to take childcare leave (up to 3 years) in lieu of the mother.
Family Reunification TRP
No cash benefit — grants legal right to reside in Azerbaijan
Duration: Tied to the primary permit holder's TRP validity
Eligibility: Spouses and children under 18 of foreign nationals holding a valid TRP in Azerbaijan.
How to apply: Apply at the State Migration Service (SMS, migration.gov.az). Documents: marriage certificate (apostilled and translated), birth certificates for children, primary holder's TRP, proof of accommodation.
Family TRP holders can study and access healthcare. Working rights require a separate work permit.
Sick child leave
Parents are entitled to paid sick leave to care for a sick child under 14 years of age. A medical certificate from the treating doctor is required. Payment is at the sick leave benefit rate (tied to social insurance history, minimum ₼60/day). Duration is limited under DSMF rules — consult your HR department for the current approved limits.
Birth registration
All births in Azerbaijan must be registered at the local Civil Registry Office (ASAN Service centre or akt-lar.gov.az) within 30 days of birth. Required documents: hospital birth confirmation, parents' passports and TRPs. The child receives a birth certificate (doğum haqqında şəhadətnamə). For an Azerbaijani birth certificate to be used abroad, it must be apostilled at the Ministry of Justice.
Childcare rights
Children of TRP holders are entitled to enrol in state-funded preschool education and compulsory primary and secondary education. Birth certificates must be apostilled and officially translated into Azerbaijani. School enrolment is through the District Education Department (Rayon Təhsil Şöbəsi).
